January, 2, 2017Dear *** ***:I am writing concerning the letter that you sent to my client, Furniture Chief, regarding the claims made by *** *** ***(Revdex.com# ***) concerning a bedroom set which she allegedly wished to purchase.The history of this claim is as follows: *** *** ***
came to the store on the 22nd of June, *** *** *** stated a desire to purchase a certain item of furniture and made a deposit of $toward the total cost of $1,for the furnitureSee Sales OrderThe Sales Order identified the sale as Layaway and the stated terms of the sale are spelled out in full in the Sales OrderSpecifically clause #states that Layaways expire after months and any layaway deposit is forfeited after six months.Despite the contract terms, Furniture Chief attempted to work with *** *** and accepted payments of $on July 25, 2014, $on October 31, 2014, $on December 14, 2014, $on March 24, 2015, $on April 2015, $on September 3, 2015, $on April 16, 2016, $June 13, 2016.There was no further contact with the customer from June 13, The total paid by the customer over the two and a half year period amounted to $500.Furniture Chief had the furniture in stock at the time that the parties made the first agreement for layawayAs you may or may not know, Furniture in a retail store such as Furniture Chief is there at a cost to the retail merchantThe Wholesaler charges the retailer for the use (display of furniture) in the retail settingWhen something is held in layaway it cannot be sold to another customer, but, retailer must continue to pay for the display of the furniture to the wholesale merchantThat is the explanation for the harsh terms of the layaway sales orderThe customer was privy to all of the terms shown on the layaway sales order and signed the agreement despite the harshness of the terms.Furniture Chief made the business decision in early Summer of that it was time to close up the business and during the period of July and December of Furniture Chief repeatedly advertised in the area papers and other means that there would be a going out of business saleAt no time during that period did the customer make contact with the RetailerThe advertisements were in all of the local newspapers and by roving vehicle announcement *** *** resides in the immediate area of the business location and could have made contact with the retailer to resolve the outstanding matter.From a strictly legal point of view it is hard to find an argument to support *** ***.The contract which is signed by *** *** indicates no cash refunds and layaways expire after months and any layaway deposit is forfeited.Sincerely,*** ** ***,Esquire

Review: I went into the store on Sunday 9/8/2013 and looked atthe Matt and Box springs that were on sale- they were standing up on my right and some were set up on top of each otherset up as a bedroom- when I went to pay for the set I saw another set and purchased it instead and set up delivery the next day -I paid $300.00 in the store and needed to pay $70.00 dollars when it was delivered and I did- however after it was delivered I noticed that the mattress was a one sided-(mattress on one side plain and hard on other) I called the store and he tells me that he can order me a two sided mattress for additional $40.00/$50.00 dollars-I told him to order it and then I thought about it over night and feel that he never mentioned that the mattress was one sided when I paid for the set in the store and how much it would have cost- I cancelled the order and decided to write into Revdex.com-it was suppose to be a sale not half over materialDesired Settlement: I paid for a two sided mattress and since I got a one sided mattress I feel they owe me half off the mattress-matt and box on sale was $350.00 ($20.00 -dollards was for delivery)I feel $100.00 refund is fair

[redacted] as stated in her complaint came to purchase a set of matrs and box spring from our store (Furniture Chief) on 9/8/13, **. [redacted] was her sales man. We had around 18 sets of mattress on display, and among some of them were on clearance sale. [redacted] was impressed with one set on clearance marked $199.99. That matters was a double sided matters. She inspected the matters and decided to buy the set. Then [redacted] and [redacted] were proceeding towards the desk (invoice desk, which is placed in the middle of the store.) On the way she happened to see another set of matters, which is one sided and prized 350, [redacted] was more impressed with those matters, and changed her mind to buy that set. At that point **. [redacted] or [redacted] didn't discuss anything about the one side or two side thing. Most of the matters (95%) we stock up are one sided. That is the industry standard now a days. Even though that set was more expensive than the first set, she diseded to buy that. Mattress was delivered, and collected the COD amount of $70. Later [redacted] called the store complained about that mattress is one sided. **. [redacted] replied to her that mattress (elegance) never been 2 sided. Then, told her if she is particular about two sided mattress we can ask factory to custom make one for her. They charge us $40 for that. Then delivery and exchange we will do free, to make her a happy customer. She agreed first, then called and cancelled*

On our side, our salesman never miss guide or gave wrong information to [redacted] Since most of the matters are one sided now a days, we don't talk about that matter unless customer ask.

It is unfortunate she miss understood the mattress she purched was two sided s if we know that [redacted] was particular about two sided matters, we could direct her to another sets.

I am rejecting this response because: if most mattress are one sided then how come the stand up matteress were two sided- not one was one sided and they were cheaper- but the higher mattress was one sided- I have not ever heard of a one sided mattress and as a good customer service rep he should have put this in as his sales pitch- : example: this mattress is one sided since they are now making them this way-and then explain they benefits of a one sided mattress. (it's in my guest room for grand children to sleep on when they come over)

this set looks and feels like two box springs- I shall pass on my experience about this particular store to others

. I had just left [redacted]'s on [redacted] and they never mentioned a one sided mattress- I wished I had purchased from them. so I will never be going back to this store
