I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below
Store owner's statements are untrueFacts are as I stated in my complaint and as I have taped on my phone from 2/20/14. I was in the store a total of minutes and the owner wasn't even there, so for him to state otherwise and what I was looking for, is jibberishI did not spend much time in there at all and again -- had I not been noted the receipt by 2/14, I would have gone elsewhere. Of course I told him to get out of my space, as he was inches from my face, as previously noted. Anyone being screamed at in such a manner would do the same. Note: Directly after I finished my Revdex.com complaint that SAME DAY after getting home from their business, I received a voicemail from I also have a SAVED VOICE MAIL MESSAGE from *** who apologized, advised he was new and that he didn't follow procedure (possibly error in his training)He offered for me to come in and pay the money out of his pocket to lower the price of the chairs by $100. As previously noted, I had already purchased other chairs and did not, nor do not need more. I am more than happy to send the saved voice mail to the Revdex.com, or anywhere else needed for that matter. It is a salesman confessing he was in the wrong and offering me my money off the sale! Right there proves my case and I would appreciate my $back in check form as soon as possible. With this voice evidence I have (also showing the date of 2/20, time of 3:pm on my smartphone), if I need to go to court for my $it will not only cost the store my $100, but court costs for both sides as well, as the voicemail I have (and taped visit to the store 2/20/14) is factual evidence in my favor and a judge would order my monies + court costs returned. Mrs *** came in the store asking for a bladder which we told her we don't stock and told her all bladders are special orderUs being a waterbed store she asks for an alternative because she can't wait because her bed is leaking all over her bed we suggested tubes which was totally disclosed to
her and which clearly is stated on the packaging that it's for a soft sided water bed and that's the only waterbeds we ever sold are soft sidedMrs *** said that's fine I'll take them except for her neighbor that said no I want to see them first and measure them then go home and make sure they work at that point no transaction was made they personally took measurements and left the store and an hour later came back and requested tubes and made the transactionweeks later they come back yelling that the tubes aren't as comfortable and that they're waveless which she's not used to, we made it clear no used tubes can be returned*** suggested ordering her a bladder and selling it to her for cost which was fine with her*** calls the company Monday July 21st then calls Mrs *** and quotes her the price which she agreed on so Ted ordered the bladder with no down payment and received it by ups on Friday which we called Mrs *** and told her we have the bladder in our hands she said "that's good now you can have a taste of having something you don't need" and hangs upWe didn't do her any wrong nobody ever told her it was 8" high like she claims and it was disclosed to her it was for a soft sided mattress and she made sure to do her measurementsIt's not a matter of measurements it's a matter of her being used to her old mattressConclusion no refunds on used tubes.

This is *** *** in reference to the Furniture & Mattress Discount King Document #*** I went to Furniture & Mattress Discount King on 07/06/around pm to look and buy furniture I had spoken to sales people that dayI looked at a loveseat and couch
When I ask about a warranty I was shown the Eco premium warrantyDue to my partner having Seizures I was told that it would be the best warranty since it covers burn holes and etcThe warranty coast $and I was giving the eco premium pamphlet the technicians brand fabric cleaner kitThen months ago my partner had a seizure and dropped his cigarette and burned two holes in the cushion of the loveseatWhen I called the store I was informed to call the warranty companyWhen I called the warranty company I was told that I wasn’t on file So I went to the Carlisle store and I showed him the pamphlet that I was given the day I bought the furnitureAnd that’s when he told me that was not my warrantyThat I bought another warranty and that the warranty that I showed him he said they didn't even have in He gave a photo copy of a warranty that I was never givenIt shows HHWS warranty on my invoice But that is not what I was told I hadI was given no paperwork on HHWS just the eco cleaner and pamphletHe proceeds to tell me that I went to another store and got this kit and pamphlet And he also said that the warranty that I have was not even available in So I called the warranty company back and I ask if they had a contract with Furniture & Mattress Discount King I was told that they did have a contract with them in But they would not release any of that info to me I then email Mary Beth F* from Furniture & Mattress Discount King customer service I sent her pictures of the loveseat and a copies of the pamphlet She said she would see what she could do for me then she emailed me and said that there was nothing that she could do I email her back telling her that I was contacting the Revdex.com I have witnesses that was there the day I bought the warranty If I would have known that it was a different warranty I would have never bought it I bought it because of it covering burn holes I either want my money back for my warranty or to replace my loveseat not repair REPLACE.

November 20, 2014We exchanged the sofa for *** *** on 8/23/for a new oneAt that time, her sofa and loveseat were fineThe foam will compact a little, as any set or mattress will after the initial ‘break-in’ periodThere is no defect in her current sofa and loveseat.We aren’t sure what *** ***’s expectations are for a $sofa and loveseat, but we are not willing to exchange it again or refund herWe feel we’ve gone above and beyond with *** ***.Sincerely,Lisa V

The warranty claim was not honored because of the accumulation of damages to the table and chairs that was not reported within days. Please see the attached comments from the warranty company that accumulation of damages is not covered under their warranty. To

This sofa and loveseat set was only ever sold by us in two colors, one being mocha ,which this customer ordered and received, and the other was gray. I have attached a copy of the customer's original order. This is the first that we have heard
from the customer regarding receiving the incorrect color. When the third party warranty company replaced the loveseat originally, the manufacturer mistakenly sent the loveseat in a fawn colored fabric which the customer seemed to prefer. Being that this was a manufacturer error, we are taking the steps to acquire another loveseat that matches their original sofa, but it must be made and shipped by the manufacturer once more. There is nothing we can do to improve the manufacturer's lead time as they are built in North Carolina and must be shipped up by truck. We did offer to order the customer a fawn colored sofa to match the incorrect loveseat that the customer received and let them know that we would sell it to them at our cost as a courtesy.We will call the customer when the loveseat arrives so that it can be exchanged with the fawn colored one.Thank You,Furniture & Mattress Discount King

September 3, 2015[redacted]’s recollection of the warranty offered is incorrect. In 2013, we did not offer an Eco Premium Warranty. At the time of his purchase the only thing we offered from [redacted] Warranty Services, were mattress protectors and the cleaning/protection kit he mentioned. We did not start offering the warranty that he mentions until the fall of 2014; therefore, it would have been impossible to register the warranty, which is why [redacted] does not have his purchase on file.Since there seems to be a breakdown in what [redacted] actually purchased and what he remembers to have purchased, we are willing to refund the amount of his warranty. I will process this today and he should look for the refund check in the mail in approximately 7-10 days; taking into consideration we are approaching a holiday weekend.Sincerely,Lisa V.Director of Operations

Unfortunately, there has been a breakdown in communication between the store and home office. After the [redacted]' canceled the order with the store, no one ever sent the proper paperwork to request that a refund be issued.

After receiving this notification and researching a few details,...

check #[redacted] was issued on 5/12/13 in the amount of $323.99 to [redacted], the original name on the sales order.

This customer started her layaway order in November of 2013.  Over the past two years, she has changed the merchandise on order multiple times.  The last of the furniture on order was delivered on February 22, 2016.  All of the merchandise has been signed for.

I am rejecting this response because:
First of all yes I was forced to sign the recipet before the delivery guy would leave my house and he told me he was going to talk to [redacted] the store manger when he got back the delivery guy tried to fix the zipper 
On the arm rest before leaving saying they do this to their customers all the time and he gets stuck fixing them and it isn't his problem. At the store I did look over and these damages were not there I am not going to stand there and look over each tiny zipper and all the arm rests were off and was told because it was so they could show customers how they can come off to be washed and was reassured it was just the last one and the company would not be making any more that's why it was sold as is never once did any one of the salesmans say that it was because it was a floor sample and there was nothing wrong with it ! The salesman lied to make a sale and now I get stuck with junk! I should not have to do any repairs on the couch after spending $999.99 on a couch! And I was spoke too Rudely by everyone I dealt with through the company and I am not going to be disrespected by a company like that. I was in contact with customer service about 10 days after purchase because I was dealing with [redacted] at the store and he said he was looking around in the warehouse and other store to get this swapped out then I was told to contact the district manager and then he referred me to customer service so that is were the almost 10 days later come in to play . Again these are all unknown answers because the store manager is no longer with the company . Also makes no sense to me if no one knew about the damages to the couch  before delivery too my house how come the delivery guy from the [redacted] store that assisted with the  delivery that day knew it was broken when he was no where around when I purchased the couch ? [redacted] told him that it was like that when he was putting the couch on the truck for delivery ! Someone needs to get there stories straight  every time I. Deal with this company it's a different person and different story ! I think $500 is reasonable considering it is gonna cost  $400 to get it fixed .
