property [redacted] had met Ms [redacted] at the home, showed her the property and understood that Ms [redacted] wanted to write an offer [redacted] had explained to her that HUD homes are usually in worse shape, they usually need more work, and the process of submitting an offer to HUD, including when the earnest money would need to be delivered They sat at the home and went over the process, including inspection process that HUD allows On paperwork that Ms [redacted] signed off on, [redacted] explained how HUD was not allowing the utilities to be turned on during the inspection process, unless buyer would pay for a generator to complete the inspection They did not say she could not have an inspection Ms [redacted] signed, agreed and committed to submitting an offer that was accepted This information included the HUD information that gave the condition of property from their own inspection Once under contract, Ms [redacted] had waived the inspection, telling Selly that she would not have one After a few days, Ms [redacted] changed her mind, which then [redacted] had updated her on how she needed to proceed with the inspection She lined out for Ms [redacted] to get a generator, but Ms [redacted] did not want to pay the extra costs and have the inspections performed once again Ms [redacted] wanted out of the contract, she used her right to dismiss the contract, but was not in compliance to receive her earnest money back from HUD without an inspection or lender letter saying she was no longer qualified Again, [redacted] explained how she could have an inspection performed and with appropriate issues cancel and retain her earnest money [redacted] has done her job as noted in an agency relationship, and even still has Ms [redacted] 's mother's home listed for [redacted] and I agreed to meet at her office one or two days later to discuss the process and sign paperworkAt her office I was asked for the earnest money up front before the process was responsibleAs I stated before I have no way of knowing when [redacted] was told that the utilities would absolutely not be turned on for an inspectionIf she was not told until after the earnest money was collected then she needs to retrieve the earnest money back from HUD [redacted] did not go over the rules about the earnest money until at least a week later when it became known that I could not have an inspection done with the utilities turned on [redacted] also told me that a plumber informed her that thousands of dollars of damage could be done if there was a leak behind the walls in the house or that some houses have been vandalizedIf copper pipes or other plumbing parts have been vandalized, I assume this could also result in expensive repairsThis information was also obtained at least a week after the earnest money had been collectedIf I would have been told this information from the beginning, I would not have turned any earnest money in and would have given up on even considering making an offer on this houseI can only logically conclude that someone is hiding something significant about the condition of this house and therefore I should receive my earnest money back Also the statement saying that I was shown the paperwork that has the statement showing utilities could not be turned on was not available until at least a week after the earnest money was
