Initial Business Response / [redacted] (1000, 5, 2015/10/29) */ Claimant States - We entered into an agreement with FY Homes to construct a new home on land we purchased in Yukon FY Homes gave us an estimate of approximately $279k to complete the 2,square foot home and a detached 19' x 24' shop aBuilder's Response - Correct, a PRELIMINARY ESTIMATE of $279k which was before finish materials were selected Claimant States - I purchased a set of engineering drawings at the beginning of the project and these plans were approved by FY Homes These plans were not changed by us except where we were forced to due to mistakes by the builder aBuilder's Response - Correct, plans were not changed However, client's made extensive changes to finish materials that ultimately drove up final charges Claimant States - The agreement was to charge us actual cost plus percent and we paid the builder in full monthly for their work aBuilder's Response - Correct, a contract was agreed upon between clients and builder to complete a cost plus ten percent project As previously stated, the clients were given a project preliminary estimate of $279k Claimant States - The builder failed to give us budget updates during the process aBuilder's Response - Builder provided weekly itemized updates on the financial status of the project Each draw request that was submitted to the client had current itemized charges for the draw, as well as overall itemized project costs These current charges for each respective draw as well as project totals were broken down by category - project management, concrete, framing, plumbing etc Claimant States - The home was started in December of and we moved into the home in July of aBuilder's Response - True, ahead of schedule Claimant States - I never received any written budget updates throughout the project aBuilder's Response - Builder provided weekly updates on the financial status of the project Each draw request that was submitted to the client had current itemized charges for the draw, as well as overall itemized project costs Claimant States - After making repeated requests for a budget update I finally received a short email on May 28th which I quote "Projected total cost as of today comes to $291,404" aBuilder's Response - True, client asked for current project totals and they received them Claimant States - We moved into the home only a month later over the July weekend We continued to pay nearly $16k in additional charges above and beyond the $291,to nearly $307k aBuilder's Response - True, and the client was informed that all invoices had not been received by the builder from subcontractors and material suppliers, and that additional funds would be needed to cover the additional costs Claimant States - The plans were not changed and the house was nearly complete in May so there is no possible way they can justify the additional charges aBuilder's Response - All invoices were not complete at the time of the project estimate at the end of May All invoices/prices from subcontractors and material suppliers had not been received Claimant States - We were in no way informed of the additional charges and absolutely no verbal or written approval was given for the additional charges aBuilder's Response - Untrue Client's were made aware of changes that they requested would amount to additional charges Claimant States - Ultimately the cost of the home was falsely driven up due to the incompetence of the project manager There were multiple mistakes made during the build process which caused re-work which drove the cost up aBuilder's Response - The cost of the home was driven by the client's enhancement to finish materials requests This project's re-work items were minimal in terms of overall project cost, many of which did not result in any additional cost to the client There were punch lists provided to some sub contractors with items to correct, however, the completion date was moved up twice during the course of this project at the request of the client Claimant States - Several of the contractors that the builder hired were unscrupulous and incompetent and had to be fired but FY had already overpaid them for the work they had performed which caused double payment aBuilder's Response - No contractors left the project unfinished, except to remove them to make way for additional contractors that could meet the client's expedited timeline to move into the home Initial Consumer Rebuttal / [redacted] (3000, 8, 2015/10/29) */ (The consumer indicated he/she DID NOT accept the response from the business.) The word extensive is subjective The house was appraised by a communication federal credit union of $305k total including land Subract off $40k for land and that leaves $265k, slightly under the initial estimate FY's own documents show that major cost overruns were due to items like dirtwork and other reasons already stated that were not subject to individual choices made by buyers 4, 6, The builder still doesn't understand the difference between knowing how much was spent to date and a running total budget estimate Cost to date is meaningless without a running budget estimate which was never provided Builder NEVER provided me with a percent complete so I had no way of knowing what percent of the budget they had spent They cannot provide any written proof of that because it doesn't exist I only received an updated written estimate exactly one time via email approximately one month before move in of $279k The builder continues to respond with subjective hearsay like "made aware" Please respond with facts like written documents We were never "made aware" of how any changes affected the total budget because the builder did not keep a running budget estimate I have a professional appraisal by communication federal credit union of 305K dollars total including land If you subtract out the land cost of $40k that leaves $265k I can provide that document at any time The builder cannot provide written proof of the subjective statement "enhancement to finish materials requests" In addition we already paid $29k over the original estimate which should more than account for upgrades we made to tile and woodwork The Builder did not provide gutters, sprinkler system, fence, or site cleanup which should account for tens of thousands in deductions Completion date move up is untrue and they cannot prove No date was ever talked about until we sold our home The July move in date was set when we sold our home at the first of May which was in our contract which gave them two months to complete our house months after starting which should be more than enough time The builder cannot provide any documents that give authorization for increased charges to finish before a certain time Untrue The paint contractors left the job unfinished They were contracted to paint the entire inside and outside of the home and they did not complete the job Brad Easley told me they fired the contractors, change the key codes and hid the paint from them He told me if I saw them on the job site to call him [redacted] told me they had paid the contractors more money than the value of the work they completed [redacted] told me they had to bring in the "good" paint contractors they normally use for commercial jobs to finish what the others started There are other examples with concrete contractors In addition I requested a copy of the original contract for my attorney to review but have never received it They also promised to send receipts for all the draws but have not done so Brads email on May 28th: "Projected total cost as of today comes to $291,404" Final Business Response / [redacted] (1000, 9, 2015/10/30) */ Business supplied email: ***@fyhomes.com Use this address for any contact with the Revdex.com
