We hired a contactor named Tommy J to replace our roof, some siding and our fence due to a hail claim that he helped us with. He was working under a certificate of formation who had a name of Mike Lacy. He was referred to me by my sister in law. He came out to our property to help us get our max amount for our claim. He assessed all the damages and even talked to the insurance company to make sure everything needed was submitted. He also met with insurance adjusters to go over the damages. He did this at his own free will, we did not ask him to. After months of back and forth between the insurance and mortgage companies, he finally got the mortgage company to release checks for all the money he needed for materials, my husband signed his part of the check and gave them to Tommy so that he could get the materials ordered and get started. After that, he made little contact with us. After about 3-4 weeks I emailed him and asked why nothing had been started and what was going on. He has told me twice that roofers were coming to get started and they never showed. Tommy then responded saying that we never gave him the last check from the mortgage company. I then verified this with my husband just to be sure and sure enough, we had given him all the checks he needed to start the job. I emailed him back and told him that I got in contact with the mortgage company and they gave me copies of all 3 checks issued to my husband and G-Force. I attached those to the email and he responded and said that he did not receive the 3rd check and that the signature on it was not his (Tommy) or Mike Lacy's and that if we kept the check and signed Mike's name, that we were committing fraud. I was livid! I did some research and called Mike Lacy and he said he did not sign the check and he was going to get to the bottom of it. He said he would call us back on a conference call with Tommy on the line. That never happened. The checks were all cashed at their banks, for some reason they cashed the last one off of a different account at a different bank. I went to this bank and verified it. Needless to say, Mike now says that he is not involved in this yet it is his companies name, G-Force General Contractors, a tax form with the name Lanning L, so everything is in his name. I am guessing that none of Tommy's paperwork was legal or legit and that is why he was back and forth with the mortgage company for so long (paperwork kept getting denied) and then ultimately used Mike Lacy's paperwork instead. Neither of them will answer my calls, neither of them will give any of the money back. The total was $11,788.73. The last time I called from a different number, Tommy answered and claimed that he does not owe anything back though the contract stated that we could cancel with $1500 cancellation fee. He said that I have no idea how much roofers get paid and he owes me nothing. I told him he could keep the $1500 and give us back the remaining balance. He hung up on me. The last time I called Mike, he said he had nothing to do with it and hung up on me as well.

Desired Outcome

Refund As stated previously, they can keep $1500.00 or as much as $1770.00 (apx 15%) as stated per the contract but not one bit of the repairs, or replacements were started. We believe that we are entitled to the remaining amount as a refund to us to make repairs to our home.

This is Mike Lacy, unfortunately in today's society, we have to have contracts in order to do business, which is a written agreement, not a hand shake. Mr. & Mrs. S signed a written contract which legally binds them to do business with me. There may have been money accepted, but not in the amount that was stated, as a good faith agreement. However, in the State of Texas, any and every contractor that decides to do business the way that it was agreed upon, has to receive, under the law, a "deductible". Mrs. S attempted to break the contract with G-Force, in order to create a new commitment with another contractor, that had agreed to let her keep the deductible and place money in her personal account. The public adjuster that was working with her, had asked that we not move forward at that time with replacing her roof. The adjuster was working to assist her getting the maximum benefit for her damage. No jobs can be started with my entity, until the deductible has been paid, which was never paid. This is state law. After a length of time, Mrs. S did use another contractor, which allowed her to place money in her personal account. After talking to my attorney, I have the right to demo the property and repair it as contractually agreed. However, if Mrs. S wants the property repaired, in order to move forward, she needs to make a commitment on how she will be able to pay for the repairs that will take place. We have two ways to resolve this and they are as follows: #1 Let her out of the contract, #2 Repair the property.

We went with another company because Tommy was not responding to calls or texts for where our money was and why he had not started the job. Only after I told him that we wanted to cancel our contract did he begin accusing of us forging a check. We paid the deductible in May of 2018 so none of this has to do with getting out of a deductible that was already paid. I asked by text and by email to cancel the contract because we got suspicious as to why after they had all the money they needed for materials, they stopped communicating with us. And be honest, who would want to do business with someone who accuses them of forgery and theft and threatens to get lawyers involved when we wish to cancel after that atrocity.?! Why would we agree to continue and then have to give you more money to steal?

I sent this text to Mike Lacy after I read his response:

Your response online still made no sense. Tommy did not come start anything after having the money for over a month. He said more than twice that roofers would be here to start the roof and he had all the money he needed to start the job. He also accused us of forging your name and keeping the money from the last check we gave him knowing all along that y'all signed and deposited/cashed it. And you acted like you didn't know what was going on. Would you want to continue to work with someone who accused you of forgery and stealing and kept lying about when work would be started? You said you were going to call him and us and do a phone conference and you didn't do that either. You never even got back to us. So now you're going to say we went with someone else to get extra money back? We went with someone else because of the crappy way that Tommy does business. You should not lie to your customers, accuse them of forgery knowing one of y'all signed it, he committed forgery and theft. You are in on it too which is the sad part. I have a husband and six children that we both provide for! Nothing was ever given to us. We have worked hard for what he have. This is not okay! I pray all the time and I just wish you guys would have a heart, a conscious, an awakening that will open your eyes because no work was done to keep $11,000. You can not justify it in any way...we did not owe you anything but the 15% to get out of the contract even though we shouldn't owe that either because we were accused of fraud and theft!
