On 12/28/12 [redacted] Dacey was contracted to replace my hot water heater at my home The total contracted price was $3,300. Mr. Dacey persuaded me to give him a large deposit of $1,800, 55% of the contracted price, assuring me he would get the job done on 12/31/12 so I could be eligible for an $800 refund offered by our local gas company for the year 2012. After Mr. Dacey left with my deposit my husband and I had a few additional questions on the hot water heater that was being installed. As such, we made several phone calls and delivered several texts to him on 12/28/12 that went unanswered. Mr. Dacey was scheduled to come to my home and complete the job on 12/31/12. On 12/31/12 I waited for him to arrive to do the contracted job. Mr. Dacey never showed up to perform the work. I missed work and waited for him most of the day. Throughout the day on 12/31/12, my husband and I made several attempts to contact him, via phone calls and texts, to find out what time he planned on coming to perform the work. We never received any response from him until that night at 5:23pm on 12/31/12 when he sent a text requesting to reschedule the job. On 01/02/12, we got in touch with him and notified him that the due to communication and other issues we experienced with him, we no longer wished to work with him and requested that our deposit be refunded ASAP. Mr. Dacey has refused to return our deposit after several weeks and a multitude of calls and texts. Mr. Dacey has noted he will not return any of the of our money unless we agree to sign a release agreeing to pay him an unspecified restocking fee. There was no restocking fee in the initial agreement and he has been unwilling to tell us what the fee is he is trying to charge us.
