Contractor breached the contract to perform remodeling , took payments and never started any workKept making excuses why he couldn't show up He was paid for services and did not do any work but wanted more moneyHe is a fraud stealing from honest people by promising great work only to never show up

I hired mr Gabriel cogswell on may to do some work on a property that I currently own three contracts were done and a total of $5,125,was paid , and as of today the jobs have not been done or is incomplete He is very difficult to get in contact with through text or phone calls , and when I do get him its always an excuse either its too hot outside , the weather man says its , going to rain , or his workman is sick or he lost his phone this has been going on since may at this point something needs to be done cause I am out over $dollars and nothing has been done I think at this point he has abandoned the job , so I would li8ke my money back I feel he is very dishonest and has done this to other people My tenants has called the city to complain and I was told that the rubble that the contractor left has to be removed within days or I will get a citation the contractor knows this which was weeks now and he still has not done anything

Dear *** ***,In response to *** *** *** complaint filed 3/8/ID *** I am writing this letter.I will start out by immediately stating that *** *** is lying and distorting the facts pertaining to this situation*** paid up front an initial $retainer fee for
cabinet layout and design work and a labor deposit of $at the contract signingMy design retainer clearly discloses my labor rate which is $per hourWe agreed on an initial start date of 3/6/and signed a contract to do his jobThe contract price of $is for labor only and it is clearly stated that the customer is responsible for material costs*** *** requested that he buy the material because he couldn't afford to pay cash and had to use credit cardsMy dog became seriously ill the week before ***'s was to beginI had to take her to the wetShe was put on medication and needed constant care for several daysThis caused a 2-day delay in ***'s job startHe was informed of this situation the day before the approximate start date*** said he understood and expressed empathy because he too is a dog loverWe attempted to start ***'s job on 3/8/instead of 3/6/which was still within the acceptable start date timeframe disclosed in the contract.Upon arriving to ***'s home to start work on 3/8/he was irateHe was ranting and rambling on about me getting the job doneI asked him where the materials wereHe did not have anything on sitebegan making a list of what we needed to get this project StartedHe was insisting that I not worry about the materials and get the spackling doneI told him that I am responsible for the management of production and order in which the work is done on the job site, I also denied his request for me to buy the material out of my moneyAt this point and considering his conduct I did not trust him and wanted to stick to the contractI offered him the options of either going with us to pick up materialso he could pay or having *** *** do a phone sale where they would call him for a credit card numberAt this point he again asked me to buy the material out of his labor deposit and I said no*** *** completely lost his cool after denied his second request for me to purchase materials out of my labor deposit, he began to rant and rave about calling the cops and having me arrested*** was storming in and out of the work zone making threats to call the police and calling me a crook and a thiefI warned *** several times that if he didn't stop acting this way we were going to leaveHe continued his behavior and Sol instructed my helper to get our tools together because we were leaving.Upon attempting to take our tools *** locked us out of his house and refused us access to Collect the rest of our thingsI called the police and thankfully they allowed us access to get our stuf* over the next day or began slandering me online through social media and the website I got his estimate request from, which was ***.com***.com made available to us free arbitration services which *** refused to cooperate withHe denied arbitration*** owes me $for services rendered and opportunity costs incurred due to his conductI am not planning on pursuing any collection efforts for moneys owed to me at this timeI just want him out of my life so I can go on with my business.Below is a clear break down of charges for *** ***.Second site visit: hours equaling $First trip to *** ***: hours equaling $Second trip to *** ***: hours equaling $Wasted time on my schedule: hours equaling $1760.00Total combined costs $Less received funds of $Balance unpaid equals $1560.00I strive to help my customers the best way I can and under circumstances I would probably just give a refund and go on my merry wayHowever, in this circumstance I must stand my groundI will not give *** ***a refund of any amount because he is in fact the one who owes money and has been unwilling to resolve this situationIf his harassment does not stop I will take legal action against him.Regards,Gabriel Cogswell
