Dunn-Rite Construction response as a defendant is as follows :Work was performed by our company for the plaintiff's neighbor.It was that neighbor (Contractee) who spoke directly with the plaintiff two weeks before the project started and who told the contractor that the plaintiff had approved of
what the project would entail.The contractor specifically asked the contractee if that permission had been approved and the contractee assured that it was.The contractor would have never otherwise involved the plaintiff at all and would have found other means to complete / bid the project.The contractor knocked on the plaintiff's door but received no answer four times ; the night the contract was signed, the day work began, the evening of the first day and the beginning of the second day.First day, no comments from plaintiff either to the contractor or the contractee.The second day of work involved stacking broken sidewalk onto the plaintiff's property, not a single piece ever touched its house and only the yard and no flowers, bushes, trees, fences or anything other than grass was affected. When the plaintiff met with the contractor that late afternoon (in person) it said it didn't want its house damaged (it wasn't) and as little as possible against it, the ground restored to what it was beforehand (except new grass seed) , and it be done as quickly as possible as its way of giving its blessing. The plaintiff agreed that it could pass through its house or possibly go around the other side if it wasn't for too long.The contractor gave a verbal commitment to the plaintiff that day (right then) that everything would be done professionally and as quickly as was possible but it all had to be done by hand and weather permitting.The entire project (photographed) took aprox a month (workable days) and that verbal commitment from the contractor has been lived up to too both parties.Upon completion the contractee was completely satisfied and it has paid the contractor in full.The furthest point between the two homes is aprox 9' and the narrowest is aprox 6' and the homes parallel each other for aprox 55'.The french 18"-22" wide hole for the drain empties into the provided downspout drain (19"deep) at the rear of the home and is 68" deep at the front of the home, this is a considerable amount of dirt.No problems, comments, visits or anything from plaintiff for two and a half weeks then "How long until you are done ?" Was asked and the answer was"ASAP, we have hit sandstone with shale at the 50" depth and it has to be broken out with a digging bar plus it has been raining, doing our best."Silence from plaintiff for another week.Plaintiff's next meeting with contractor was 1/days before finish of project, at the end of a very muddy day (5:pm), when the hole was 3/of the way backfilled.The plaintiff began by being hostile (tone) and insisting that what was left be magically completely backfilled by morning.The something plaintiff then went on to say that it was felt the workmanship was terrible (unbeknownst to them it was the exact same contactor who had done the other two sides of the home years before without incurring any problems at all then or since furthermore, french drains of the same nature (others throughout the neighborhood) had been done by the same contractor of which none have had a single problem since they were completed.).The plaintiff was given the answer of ; "ASAP but doubtful due to the conditions probably until Monday, Tuesday latest.", this was on a Thursday. This wasn't good enough for the plaintiff and it began raising its voice, offered more advise on construction, said more derogatory remarks and the contractor's response was the same even reply of "As fast as we can." each time ......so naturally within minutes the police arrived.The policeman who arrived just told the contractor to "Do your best.", the contractor agreed and did its best.The plaintiff left the contractor alone to finish after that, but took the time to file this complaint.The plaintiff's property now is exactly as it was (never any damages) except for it now has more grass.Dunn-Rite Construction apologizes for the delays caused by the weather, geology and the original builders workmanship, none of which it can control
