Gagnon Painting & Decorating

Review: Gagnon Painting did some painting work for us in 2012 involving a deck railing, driveway gates and mailbox post. Less that a year after the work was completed, the paint began to fail on the deck railing and the mailbox post. There is now bare wood exposed. When I contacted Mr. [redacted] about remedying the situation, he told me he would get to it "when he was in the area." That was over two months ago, and he still has not yet made the repairs. I would like the repairs to the failed paint to be made by an early date definite.

The company's response was that it would not fix the problem unless I withdrew the complaint.

Response:

On 3-15-2012 our company provided an estimate to touch up / repaint misc. peeling paint areas at the [redacted] residence. The total quote came to 940.00 and the work included was as follows:

Front Side of deck:

-Prepare and paint the peeling part of the railing system, skirt/stringer

Driveway Gate:

-Prepare and paint the wooden gate

Mailbox Post:

-Prepare and paint the mailbox post

We completed all the work as was promised and received payment in full on 3-23-12. There was no warrantee expressed or implied.

After 1 year had passed Mr. [redacted] called in the spring of 2013 to report that there was some peeling paint on a part of his deck and the mailbox post. As a good will gesture we offered to touch up the peeling spots at no charge but that we would be able to do this at the same time as another job on same street that we are contracted to work. At that point the customer and I were both waiting for the nearby job to commence. Several weeks went by and still the nearby job had not started but Mr [redacted] called me to ask when we would be coming. I told him "when we are at the other job" he said ok. To date the nearby job has not commenced due to circumstances beyond our control as I am only a sub-contractor there.

Of course I am surprised that Mr [redacted] would complain being as we offered to do the work at no charge and seeing that there was no warrantee either expressed or implied in the job that we completed for him on 3-23-12. As a side point, it's entirely possible that a mailbox post and a deck may need to be maintained on a frequent basis due to these being subject to standing moisture or buried under snow each winter. Peeling paint like this would be considered simple maintenance done at a home owners expense. This would not be considered defective workmanship.

Even still we are willing as a goodwill gesture, to touch up the peeling areas at no charge and help the customer as long as we can do this when we are employed at the nearby job as I promised. I cannot say exactly when the nearby job will be ready but according to the general contractor it should be very soon. And for sure will be done this season.

The customer can choose to hire someone else to do his touchup painting or we will do the work as a good will gesture at no cost as I promised. Please let us know what he chooses to do.
