***, As to the complaint sent by *** ***, the actual events were as follows.*** leased a vehicle from us on 12/31/2015. Her down payment was $1000. At time of lease she only paid $of the down payment.On the first Monday of the lease
she called me and let me know that the power steering was starting to go bad so I made her an appointment for the following week to have it looked at and fixed. I believe it was days later on Wednesday when she called me and told me that the power steering had completely went out on herI agreed to have it towed and she told me she was going to drive home from work that day and then we could tow it from her house in blue springs. I eventually had it towed in that same evening. Unfortunately while her vehicle was on our lot we had about vehicles broken into I believe it was on Thursdayevening. Her *** *** had been slim jimmed and they had broken her ignition and steering column. When she called to check in on her car I told her about the incident and offered to switch her out cars or give her a loaner car until we could fix her steering column. I went out to the vehicle that morning when we found the damage and retrieved a black bag from her vehicle and gave it to her when she came into the office. We talked when she came to the lot and I told her I would fix the damage to the vehicle at no cost to her and I could give her a loaner until the work was done. She stated that since the vehicle had been broken into that she just didn’t feel right about the vehicle and that no matter what she just didn’t want the vehicle back. When we lease our vehicle we require that they test drive the vehicle and they sign a form stating that they can and should have the car checked out by anyone they would like before leasing the vehicle. We offer a powertrain warranty that cover engine, transmission, and drive axles for miles or whichever comes first. The power steering is not something that would be covered in the warrant but I did agree to fix it, and I did offer to fix the damage due to the vandalism. Unfortunately *** only wanted her money back and that was the only thing that was going to make her happy. We offered to make everything right but the fact that the vehcle had been broken into she stated she never wanted it back no matter what. As to the property that was inside the vehicle… She stated that there was a tablet in the vehicle…I don’t know if there was ever even a tablet in the vehicle. *** knew her vehicle was being towed into our lot for a couple days for repair and she had time to take any valuable posessions out of her car. I don’t have the ability to replace something that could or could not have been taken from the vehicle. Thanks,*** ***City Wide Motors.###-###-####

I am rejecting this response because:Simply because the issue was not ever with the  the power steering being broken, had that been repaired and the vehicle returned in the same condition with-out the vandalism and or missing items I would have been elated to take the car back and continue my journey. The problem is that I paid my money and with-in less than a week the car was taking into their care  for repairs and was broken into.  My intent was only for THAT car in which I LEASED from City Wide I explained that to [redacted] many times, which is why I declined another vehicle further more he wanted me to put down more money down on top of what I had already given to get another car, with-out credit for the $500 I gave him few days before . I did not have the car more than a week I called the car lot as soon as a problem occurred and I was told to file a claim with my insurance. When I attempted to do so I was told that it was not the responsibility on my insurance to cover personal property the lot should have insurance to file a vandalism claim. It should be not one else's responsibility to replace my items removed from the car except the lot. When I asked [redacted] for a copy of the police report several times he refused to provide one I also called the local police station less that 2 miles from the lot and they had not had any reports being filed for vandalism from City Wide.  I called and spoke with the attorney general's office and was advised to see what other options the lot was willing to offer before filling a claim, I called several times and I was not given any, not even to have the $500 down payment I paid to be transferred as a down payment on another car.  When [redacted] said that they would accept the car back and void my contact my money should have been returned to me.  Since no resolution has been met my next step will be in small claims.
