On July 30th we purchased a *** Bedroom set from ***, with the same address that you have on your website as *** Furniture and Mattress. *** the owner showed us the set which was comparable to the *** set we had seen at another store. The only difference was the color of the Furniture according to ***. We had also showed him a photo of the desired set so he could compare and if he had it available.
On 9/6/19 The set was delivered and during set up I immediately noticed the headboard was not the same as the one we showed *** and his wife *** on 7/30/19 when we went in. The *** company Headboard picture was a panel headboard. While we were in the store inquiring the differences between the two sets, *** stated they were exactly the same the only difference was the *** product was a different color. He did not inform us that the set from *** Product only came as a Sleigh headboard which is what we received. We would have not chosen that set if we had been informed at the time of purchase that it only came in a Sleigh not a Panel Headboard. *** was contacted immediately, as the two men continued to unpack and finish setting up.
( ***). Both men heard the conversation between my husband *** and I, that this is not what I ordered because we never wanted a Sleigh headboard. Two numbers, a mobile and a Landline were left messages of the problem and the delivery man *** checked his invoice when he saw how upset I was. *** returned the call approx. 45 mins later, he spoke to my husband *** and he was unwilling to cooperate and return the set and replace it with the correct one. He insisted that we were informed of the difference at the time of purchase. My husband explained this was not true, and if it was disclosed we would have purchased the other *** bedroom set. again he was shown the picture. ***'s first response was it says on my website that there is a 40% restocking fee, we had never been to his website nor we were told about this at the time of purchase. He told us he would have to see how it could be handled but needed to look at the price differences etc. and maybe come up with a solution. We did not hear from him again until 9/12 and he had to still look at the numbers. On 9/14 he said he was still working on it, and as of this day 9/16 there has been no further contact. The furniture is in our Master bedroom untouched and we are presently sleeping on couches to keep them in totally new condition.

There is nothing posted in the store stating that all sales are final.

To whom this may concern,

*** and *** purchased a bedroom set on 7/30/2019. We showed them the bedroom set on our showroom floor and confirmed their request. We ordered, delivered, and setup the correct bedroom set they ordered and signed off on. Although, they were pleased with the bedroom set, unfortunately, they desired a different shape of the headboard. We explained this bedroom set had only one headboard option.

This must be an older or prior claim, because on 9/23/2019, *** came back in and selected a different bedroom set and paid the difference. *** and *** are free to contact us with any questions. Thank you

and *** confirmed and purchased a bedroom set, but wanted to a slightly different headboard. Since we could not change the headboard, we allowed a return and new selection on 9-23-2019. This new bedroom was delivered 10-15 days ago. Please contact us with any further questions at ***. Thank you.

The furniture store is refusing to cancel a order that was not asked for or agreed on writing or other wise
They are now saying that we can’t use the deposit on one item and they can’t cancel the order that they it on with out consent
They are saying now they will distribute the down payment to other items in attempt to force use to buy the furniture
No one gave him permission to order the furniture.
Plus they were attempting double tax us

Sorry, we only charge sales tax once. Your special order arrived a week or 2 ago. Unfortunately, we cannot refund special orders (we did explain this to you before the purchase and you signed off on the purchase order). We are willing to work with you to resolve the situation. Please give us a call at the store when free to go over options.
