I have contacted Gains Fit Inc. regarding a reservation to a fitness retreat for an event that I signed up for in November 2019 to attend for August 2020 in *** before the pandemic occurred. I contacted Gains Fit multiple times to find out the status of the event because they were not providing any updates. My initial contact was by phone & then the remainder of the correspondence has been via email. When I was notified by the fitness instructor in AZ who invited me to attend the event that she was no longer attending due to concerns she had about catching COVID-19 there, I reached out to Gains Fit via email to let them know that the reason why I initially signed up for the event and thought that due to the pandemic & AZ being a hotspot along with CA & NV that I should be issued a full refund to cancel the event. If the AZ instructor wasn't going due to concerns she had that spoke volumes. Plus, I live in AZ & we have been a hot spot for quite a while. I had hoped the organization would use wisdom in canceling the event & allow me to get a full refund as a result of the pandemic being an unusual circumstance. However first the company said they were sticking to their cancellation policy to only give you a portion of the refund based upon the date you notified them. I notified Gains Fit of my request to cancel on 6/12 & at that time they were only giving refunds based upon their cancellation policy. After my email they followed up with another email with 2 other options (none of which I was interested in). I sent another email on 7/14 telling them I wanted the refund and would be going through other avenues to get a full refund and 1 week after that email, they send a follow up email dated 7/21/2020 telling me have to go onto their website to make my election by August 4th on the 3 options regarding the event. Their website won't process my request because they want me to pay the balance of the event even after I canceled on 6/12. The refunds will be processed after the event in 60 days.

Refund To get a full refund of the amount paid for this event. I believe the company has negated their cancellation policy when they offered the other two options to include staying at the hotel and not attending the fitness classes in order to receive a $200 credit or to apply the full amount paid toward next year's event. No where in their policy does it state other options in lieu of a refund would be granted if there were conditions without their control.
Our event is scheduled August 27-30. We provided updates on June 13 and July 21.
Our cancelation policy is as follows:
Refund Policy and Cancellation Fees:
September 15, 2019 to December 31, 2019, cancellation fee is 25% of the total package cost
January 1, 2020 to April 1, 2020, cancellation fee is 50% of the total package cost
April 2, 2020 to July 15, 2020, cancellation fee is 75% of the total package cost
After July 15, 2020 there are no refunds, cancellation fee is equal to 100% of the total package cost
The property that we have a contract with for the event has not canceled that contract. The state of Nevada is in Phase two which allows for up to 50 people to gather. Therefore, they were not obligated to cancel the contract.
Despite the venue not canceling the event, we gave attendees 3 options; attend and not attend class and receive a $200 credit, transfer 100% to next year, or receive a 75% refund.
We did not request further payment. We instructed all attendees in the emailed dated on July 21 that the only required was to select an option on the transfer option page. We did not instruct them to complete anything else or pay anything else. Once they made that selection there was nothing else they needed to do for their option to be processed. There was nothing wrong with the website. It did what it was intended to do which was record the option to be processed.
