We have been communicating with Ms [redacted] We are building her roof the day after her material is delivered we had hoped delivery would have been last week but order will be delivered till this week

Nobody is asking Mr*** or Lone Star to control or take responsibility for the weatherThe problem here is not the weatherThere have most assuredly been periods of good weather in the past four months in which a replacement roof could have been placed on my houseLone Star relieved me of in excess of $10,then utterly failed to communicate with me in any capacityI have no confidence that if I were not making a pariah of myself at the present time Lone Star would communicate with me nowThe company damn sure can and legally must control and take responsibility for its business practices
Mr*** states that correspondence from my insurance company allows up to two years to complete the replacement of our roofThis correspondence references a contract between State Farm, my wife, and ILone Star is neither a party to this contract nor a third-party beneficiaryAs such, my contract with State Farm has no bearing on the contract I signed with Lone Star or my rights thereunderThe documents that are attached, which actually govern the relationship between Lone Star and I, do not contain any reference at all to the time in which work is to be completedTexas law will therefore impute a “reasonable time” deadline(Seriously, is Lone Star actually taking the position that it can take $10,000, sign a contract, then wait up to two years to perform?) I’m willing to bet that I (or my attorney) can convince a jury that four months with no communication is not a reasonable time
Sure, Lone Star is happy to discuss a date with me at my convenienceThe problem is that my convenience (and patience) ran out about forty five days agoI have inquired with other homeowners in my neighborhoodOne paid for services at the same time that I did, then didn’t hear anything for monthsThat homeowner now has a replacement roof, but regrets her choice of rooferAnother states that after paying Lone Star a significant down payment back in June, materials were delivered to the residence two weeks ago, but Lone Star has not contacted the homeowner, has not responded to calls, and no one has appeared to actually replace the roofThis is not a one-off instance where I am being an unreasonable consumerThis is a pattern of deceptive behavior that could easily be the subject of individual DTPA actions or an action by the Texas Attorney General
Lone Star is in breachI do not want Lone Star on my property and I will not have them replace my roofRather, I would like a refund of the payments made that were not expended in re-piping my windows and replacing my screensFailing this resolution, I will file suit on November 9,

Mr. [redacted] repairs were completed and have been now for at least 2 to 3 weeks. The wrong color roof was installed but was due to not having a firm color selected on contract if I understood correctly. The delay wasn't on us as far as completing project near as much as we had to wait on Shingle...

availability from supply house. I personally spoke to Mr. [redacted] and I believe he is happy and satisfied when we completed repairs. Unfortunately with the color not being correct we were at the mercy of supply houses and availability of material. I will get more details and send a more detailed response.

[Provide details of why you are not satisfied with this resolution.]While I was finally able to get a return of my deposit, and thankfully the check cleared the bank before this outfit goes out of business, I did not agree to withdraw my complaint, I simply do not have to elevate the complaint to the [redacted]s. The company owner said he would mail my deposit, which was an outright lie in my opinion. It took 3 weeks and multiple telephone calls and a trip to their office and additional wait time to get the check. I immediately went to the bank to ensure funds were available and cashed the check. This is a lousy company to do business with. Nothing but lies and I am so glad that they did NOT do the roof repairs as contracted as I am confident it would have been a lousy job with absolutely no hope of getting any warranty or repairs of any kind. My advise is do not walk away from doing business of any kind with Lone Star Contracting in Houston, Conroe, or Dallas Texas....RUN away as fast as you can and find a real company, in my opinion. BUYER BEWARE really applies here.

I have reviewed the business' response. We are now merely repeating ourselves. I do not want Lonestar or Mr. C[redacted] working on my home. This is not an acceptable resolution.

Mr [redacted] confirmed his color at 7:29pm 7/27/16 [redacted] No color was indicated on original contract 05/14/16 causing production to pause until color was selected so that we can order materials for the project I contacted Mr [redacted] on 7/27/16 and agreed to a build date on August 5th or...

6th weather permitting Milt C[redacted]
