In May 2012, I signed a residential lease in Sherwood with Callahan Real Estate. The monthly rent of $1425 was paid on the first day of the month for 53 consecutive months. This came to $75,525. The house was professionally cleaned two times a month. The yard was professionally maintained twice monthly year round. Neither Callahan or the home owner had to worry about the property being maintained. The lease was a general lease stating that the tenant would be responsible for any damages due to negligence.
Callahan charged $99.25 to drive over to flip a breaker but never investigated the cause. It could have been a short. They proved to me that I could not afford to contact them on safety issues although the lease required it.
Two bedrooms in the home were only used 4 times during the lease therefore, I left the HVAC ceiling vents closed the entire lease. At one point, the AC would not complete a cycle but continuously kicked on and off. I made a call and was charged $130.20 for them to open the vents. When I came home that night, I closed them again but the A/C continued to work fine. I had no other problems with the HVAC after they came out. (If HVAC vents were not intended to open and close, they would not come with the option to close them.)
The bathroom sink that was never used as there was 2, had an area where very little product was used. I had samples to show Callahan as well as a video of the thin material. The sink was so thin, the particle crumbled. After providing video, photos and asking Callahan to meet me so that I could show him, he refused. He charged me $238.83.
The only thing he has done is responded back advising me that all of this was due to neglect. He turns a deaf ear to every call and email that I have copies to prove.
He does not have the best interest in the homeowner or tenant. If I was a negligent tenant, it would have been mirrored in my rent payments and the lack of keeping up the home.
Callahan's business practices are unprofessional. For a tenant to have to make the choice to not make a service call complaint because Callahan charges for it regardless of the root cause is not being fair to the consumer.
The lease does not support him charging what he has charged for. His writing in email and letter that this is negligence does not make it true. Photos, video and sampling of the sink is hard core material that he has refused to consider.
My point is: Be careful when using them. All the documentation that you keep will be necessary to prove your case in court.
