This is Patrick Gallagher of Gallagher Property Management I am responding to complaint ID#*** In May of 2013, we took on a client who wanted their single family house rented and managed by us We did work to the house to make it "rent ready" It was during this time
that I really should have told the client that we were no longer interested in managing her property She did end up paying most of the bill (except for the $vanity that we purchased and installed) She was extremely taxing with constant emails and phone calls and it was to the point where I was willing to give her a day notice and we could part ways I decided to stay on as her property manager because all of the work (prior to the tenant move in) was done, and the new tenant was a solid candidate to rent her property Plus it would take about five months of property management to pay for the vanity that we installed The tenant rented her house from June until June Never a late payment, and rent was always paid in full During the one year lease 100% of the rent was collectedWe paid specific bills for the client and subtracted our property management expenses and the remainder was always given to the client The delinquent tax bill that the client mentions is completely false This house was in great shape and the tenant was extremely clean Soon after the tenant moved in, he did state that the refrige leaked a little water on the floor We responded to the house and didn't find the refrige leaking any water Several months went by and the tenant called to state that it was an intermittent problem, but now it needed to be fixed We notified the client about the issue and she did not want to fix the refrige The lease states that the tenant is responsible for repairs, which is true, however, this problem started right after the tenant moved in and that's why we brought it to the client's attention As we tried to resolve this with the client she called, texted,and emailed us at all different hours of the day She would not stop and was "bullying" and argumentative with my staff The tenant and our company ended up paying the bill by splitting the cost At some point in May 2014, the tenant came into our office and signed a new month lease which started July 1, I was unaware of this until my office manager told me the news My office manager did not know that the client did not want her residence re rented She felt terrible as did I We immediately contacted the client and told her about the new lease Again, constant phone calls (harassing), emails, texts at all hours of the day The client was threatening and aggressive to my staff over the phone This was troubling my staff and this client would not stop We apologized for re renting her house The tenant signed a new lease and therefore a day notice was pointless We tried to resolve this but the client didn't want to hear it and also threatened to smear us on all social web sites Since she was calling daily and bullying my staff, I told her she was not welcome to our office We would gladly mail or personally drop off her paperwork to a third party I did state that if the client did trespass on our property, we would call I removed myself from communicating with this client because she would try to mix my office manager and my words up in an attempt to confuse us and/or get us to say something different so she could use it against us At no time did the client tell us her intentions with the possible sale of her house or plan with furniture etc As it turned out, the tenant did understand our dilemma and he moved out prior to June 30, We were able to cancel the new six month lease and the client had possession of her house as per the original one year lease dictated Prior to the tenant moving out he offered the client the house to store her belongings This tenant is an attorney and a local judge The client refused If the client would have not harassed my staff I would have offered free storage for her The point is that she had no legal right to store anything at her property until July st Her property was vacated prior to July 1st, and left in spotless condition Did we make a mistake by re renting her house, yes We worked very hard to fix that and were successful It was clear right away that the client was not going to pay for the refrige repair, so we just paid it so we could move on The client mentions us being "unethical" This quote troubles me the most I pride myself with training my staff on ethics I don't need to pull any fast ones and I never will This is not an easy business to run and it's challenging This is what drive's me to be the best Because of our "ethics" we have grown over 50% each and every year over the last years

Mr. Gallagher's response is full of inaccuracies. The tenant originally signed a lease on 7/1/2014 the same day I signed my agreement with the management company, later the lease date was changed by the management group to  12 July, so the tenant did not rent from June 2013- June 2014.
It is true that the management company made some installment payments for my property Taxes, but I received  notice that the final payment was not made. It was a final delinquent notice  stating my name would be publicized in the newspaper if it was not paid including a penalty. I was mortified as I have never been late with my taxes. This is truly an example of the sloppy business practices employed by the management company. I have a copy of the delinquent notice I can forward to you if you would like proof.
It is true that I refused to pay for the vanity installation. After the lease was signed and the tenant negotiated a reduction in rent he began making demands to have ceiling fans installed, vanities etc.. Mr. Gallagher called me and we discussed the request and I offered to let the client out of the lease if he wasn't happy, I made it clear that I did not want a vanity installed, Mr. Gallagher installed one anyway, so I refused to pay for it. My agreement states that I had to approve any expenses over 200.00 unless it was an emergency.
When the refrigerator needed repair I received several texts from the property company trying to force me into paying for the repairs, the lease clearly states that the tenant was responsible for all repairs. Initially  I was planning on storing the appliances, Mr. Gallagher asked why I wouldn't leave them? I stated that I would but didn't want  the responsibility of repairing or replacing if necessary. He then convinced me to leave them with it clearly stated in the lease that the tenant would be responsible. It wasn't until I made arrangements to have the refrigerator removed that Mr. Gallagher decided to split the repair with the tenant. I often wondered who Mr. Gallagher was representing.
Mr. Gallagher denies knowledge of a possible sale of my home, another false statement. I had a conversation with the property management company on 5/16/2014 when I was informed the tenant would vacate the home on June30, 2014.  I was led to believe that this was secondary to the 30 day notice that Ms. [redacted] stated was possible because of my intention to list the house. She also inquired what the selling price would be since she knew someone who was interested . I have an email confirming the points of our conversation so we wouldn't have any misunderstanding. I can also produce a copy of this email.
As for multiple calls and emails they did occur at times since emails, messages, and text would go unanswered for days. At one point I set up a specific time to discuss issues with Mr. Gallagher , the time and date were set by Mr. Gallagher. I finally received a call 4 hours after the arranged time . I consider this very poor customer service and extremely unprofessional.
Mr. Gallagher did not resolve the issues .I called the tenant directly, he said he never was given a 30 day notice and he was not aggressively looking for another place, but now that he was aware of my plans he would do his best. It wasn't until I contacted an attorney and stated that I would be writing the Revdex.com that Mr. Gallagher contacted me by email offering to pay me rent over the agreed rate if I did  not contact the Revdex.com, not very ethical by my standards. I can also produce a copy of that email.
I feel that other prospective clients need to be at least aware of Mr. Gallagher's poor business practices as well as decisions he is making that I believe are unethical. Any assistance you can provide in resolving this matter would be greatly appreciated.

Our first experience with Patrick Gallagher, owner of GPM, was when we called him to check on a sewage backup in one of our rental homes. He called us, immersed knee deep in sewage in the basement of the first house we had just bought in Rochester, explaining what had happened and how he could remedy the problem. He spent several nights dealing with the sewage, cleaning up and placating the tenants. We knew then that he was someone we could rely on when things got rough. That was 8 years ago. As out of country owners (we live in Toronto) of 4 rental homes in Rochester, 3 side by side duplexes and a triplex, we have relied on Pat to rent and maintain our properties in Rochester since then, always appreciative of his immediate response to our emails and calls. When we were scammed by an unscrupulous agent a few years ago, Pat helped us retrieve our deposit. When we wanted to buy additional houses he always checked them out for us first, giving us the pros and cons of each. When one of our homes experienced water damage totaling $ 16,000 due to a frozen pipe, Pat took care of the whole thing for us, from the paperwork to the complete renovation. We rely totally on Pat for his advice and experience, knowing that he will always be available and honest. In a world in which we are often surrounded by unscrupulous people it's refreshing to have someone you can trust who is professional, dependable and maintains a friendly and positive rapport with both tenants and owners. We feel very lucky to have found Pat to manage our properties.
