Initial Business Response /* (1000, 10, 2015/10/05) */
[redacted] D[redacted] came into my vintage boutique in Palm Springs, Ca in April and purchased and Egyptian Revival necklace and bracelet by costume jewelry designer [redacted]. The necklace and bracelet were created in 1971. In order for an item to...

be considered vintage it must be at least 20-25+ years of age. All of the items sold in my boutique are in pristine condition for their age, original condition is essential in order for them to keep their value. [redacted] purchased the set, the following day I received a call from [redacted] stating that the necklace had broken, that it was fragile and that she wanted to return it. Unfortunately I am not a Macy's or Claire's, so per my store policy listed on my front door or at the bottom of the receipts, there are no returns, refunds nor store credits.
I had [redacted] explain to me over the phone what was wrong with the necklace and send me pictures. Per the pictures the necklace was not broken; one of the beads had come off its hook. I had [redacted] pack the items and ship them to me so I was able to tighten the components and add a stronger clasp for extra security. I received the items and shipped them back to her fix, later to find out that she was having buyer's remorse and wanted her money back, the reason, " It's an expensive and fragile piece of jewelry and I am afraid to wear it." Diamond rings, gold necklaces are all also fragile but she was wearing them. I tried to educate her on couture costume jewelry and the meaning of vintage but she would not listen.
I closed my store for a little over three months as I was heading abroad to study and conduct research. I was firm with Mrs.D[redacted], when it came to my store policies. I always tell my clients before they purchase.
As I was abroad I received a dispute with my credit card company from [redacted] through pay-pay and automatically the amount she paid was deducted from my account (I have a record of the deduction). So I disputed it back. When I am in Israel with limited internet connection I receive and email from [redacted] saying that she had mailed the jewelry back to me and she wanted someone to mail it back to her? This was impossible. After months, towards the end of my studies I receive an email from pay-pal stating that the dispute had been closed and that [redacted] had won the dispute.
I arrived home and picked up the jewelry from the post office. According to my credit card provider the case was closed and the money was returned to [redacted], so I thought. With pay-pay these cases sometimes take up to 90 days. I called pay-pal mid September and they said that the case was closed whoever they weren't able to transfer funds into [redacted]'s account due to the longevity of the dispute. Pay-pal issued me the disputed funds to my account and I mailed [redacted] a check. Case closed.
Mrs. D[redacted] should really educate herself on vintage jewelry and the meaning of vintage, before buying vintage (used and old). I pride myself in having a collection of inventory that is nearly impossible to find as most pieces are in private collections or museums.
Initial Consumer Rebuttal /* (3000, 12, 2015/10/11) */
(The consumer indicated he/she DID NOT accept the response from the business.)
It is important to note that [redacted] omitted many details. First and most important is that the vintage necklace had loops holding the beads that were so weak, the beads broke off of it twice.... Once on my 2 hour drive home and once when Car.os mailed it back to me. As he stated to me, nothing could be done about this. When I addressed the fact that I couldn't wear it, he said he would not refund my money. He said he had a do not return policy. I was NEVER told that in his store, nor was that indicated on my receipt from Paypal.
I tried to communicate with [redacted] via email as I knew he went out of the country. I sent back the necklace and bracelet. I disputed his $1,000 charge. My credit card company took it off my bill only to recharge me 2 months later. Because there was such a long time frame between the purchase date and recharge, my credit card company dropped my dispute. Now I was out $1,000 and [redacted] had the products. I tried to communicate with [redacted], again via phone and email ..... With no response.
Only after I called my girl friend who had originally taken me to [redacted]'s shop in May and told her my story did [redacted] do something. He wanted to be in good graces with my friend as she had been a good customer of his. He sent my my refund check of $1,000. I am happy this is finally a closed issue, but concerned about [redacted]'s ethics and business practices. If it hadn't been for my friend interacting, I would be out the money and the products.
