RevDex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my dispute. Please enter your reason(s) for rejecting the business response below. As previously mentioned the description of the vase was not accurate , I pursue the complain..I sent some pictures to some people via the net , they also noticed the chip missing on the border line of the fishbowl but did not notice the hole . Do you really believe that I would spend usd 200 plus fee for a broken bowl fish .See the real price on ebay and at some specialists stores. I do work on eBay and invaluable for years . I will start to send some complain on some social media sites about Gallery 70two way of working and acting toward their customers . I will not agree in getting this bowl . To prove you of my sincerity I prefer to leave the bowl to this auctioneer and do what he/she want with it . they can sell it again if they want and I agree with that . I never bid for some damage this great . I always mentioned that the chip was ok and minor BUT never will I buy an object as much broken as it is . Regards, [redacted]

I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my dispute
Please enter your reason(s) for rejecting the business response below. The reasons are very clear I talked few people arts seller in NY , here who also agree that we do not see that was a mega hole ( why pay usd !!) I was accepting the chip ( bowl damaged ) does not mean broken .The chip was just a chip not meaning bowl was broken ..I already show thru my mail that thru Paypal and eBay /Amazon and Invaluable ( where I have bought objects above usd I had no complaint from any seller concerning my purchases and payments since ..).I am just requesting to credit my card ..IT is a matter of correctness in Trading fairly with a client ,the seller had no other buyer !!my question is WHY ??? even people in the room did not buy ..I am an honest buyer, I would be certainly doing business and other purchases with the seller I have nothing per se against the seller BUT definitely damaged had not the same connotation than BROKEN .I hope the Revdex.com will help me .I think this way of doing business is TOTAL FRAUD , you are a merchant you do NOT want to get rid of an object that nobody would buy ..it is not sincere, and certainly NOT the way to do business ;if he had a sincere description he would not hide behind the acceptance agreement .The acceptance agreement is .The wording is incorrect , and I am ready to show this to a lawyer and act against this auctioneer I will Talk to Baker Mc Kenzie law Firm in Houston. The seller ( auctioneer ) in this case fail to disclose the information as well as he should have be for an online seller to see in equality term that a client being physically in the room in front of object The failure to disclose information that was NOT REQUESTED can be regarded in a court of law as fraudulent, and give the party harmed by the nondisclosure the same remedies as if a statement were intentionally made ( easy case in a court of law) the exceptions fall into two categories: Unknown defect or REAL condition and active concealment by intentioned manipulation of description wording Many court would hold that there is a duty for one party , who knows of a defect or a harmful condition , to disclose correctly in appropriated words this information to the pother party and is of nature that the other party would be unlikely to discover or inquire about the defect condition. Best Regards *** ***

Per the terms of the contract the complainant's funds have been issued and mailed to the address on file on 5-25-check number #***

Our previous response adequately covers the issues and as such we will not issue a refundThe customer was well aware of the damage prior to bidding

This is a fast talking scam artist. What was actually agreed upon was a fee to be paid at time of pick up. We scheduled the pick up a week in advance...We had been told several times that the check was on its way...it never showed up. I even told the representative, [redacted], that we would like the check before the final pick up.  Finally, a week before we were to close on the house, we called and set up the pick up time for 10-14.  The company called 30 minutes prior to pick up (we still have the phone message saved) to cancel due to some accident with the truck. We asked if they could come the next day(u-haul rents trucks) and they said no, not at all, ever.  The owner yelled at us on the phone when we called to change the address to mail the check (which we never even got to because of his rudeness) The check wast postmarked 10-15, the day after the first bad review was written online and a day after the rude phone call. Please alert others that this is not a fair business to deal with.  They took advantage of an 87 year old lady and cheated her out of her valuables.  The amount paid was beyond ridiculous...way to low.

I am rejecting this response because: I ;have not received the check the owner says he sent in your message to me on 6/6/17, It is...

less than 20 miles from Bedford to the post office here. The documents I requested verifying the results of the sale of my property was ignored in his response. In case there is any question as to my address in his records, it is the only address he has from his day long visit here to my house to pick up my property. Simply more delay in paying me what he owes me. I will appreciate the Revdex.com help in resolving this issue. It is getting pathetic.

The response is all lies.  I am 87 years old and have been scammed by this place. I was told there was a $60.00 fee for pick up, payable at time of pickup.  This fee was waived for the items they took with them at the first meeting.  The valuable items they took and reported as auctioned on August 29, 2015 are now showing up on ebay at more than three times the amount they reportedly received.  This is a scam.  It needs to be investigated by the authorities.  Furthermore, as more evidence of the lies, I have the envelope with the check stub which is postal dated 10/15.  A day after the online complaints began, and a day after they failed to pick up items as scheduled a week in advance.  These are scam artists so I don't expect them to try to resolve this complaint. I will be contacting appropriate agencies.

Foremost the consumer signed a moving agreement dated 8/22/2015 stating that the charges for moving items is a $60 trip charge and 2 hour minimum of 4 personel at $110 per hour for a minimum total of $280.00.  Time taken beyond that would be charged at $110 per hour thereafter.  Said inital fee is to be paid PRIOR to scheduling and without the initial payment we will not schedule a pick up as was explained to the consumer who stated she would call in with payment when the time got closer to the sale of the home.  Consumer failed to make said payment as as such no scheduling was done.  This is SOP for our company.  (See attachment) This was explained and written out and the conversation was recorded by our rep. Consumer states that we cut a check after her initial complaint.  This is incorrect in that the complaint with the Revdex.com was first initiated on 10/21/2015.  The check was written on 10/1/2015 and thereafter mailed. Per the contract we have 21 business days in which to issues checks to consumers from the time the auction is completed and all payments are recieved and cleared.  We are on 4 international platforms with bidders world wide as such it can take up to 2 weeks from the end of the auction to collect all payments. This was fully explained to the consumer both via the written contract and verbally which was reorded by our rep.  Consumer and consumers alternate rep [redacted] was both present and both agreed that they understood said terms. Said check was issued within the time frames listed per the contract. (See attachment submitted within the initial compaint.)  Lastly,  All of our auctions are conducted live in house and live online in real time and completly open to the public. All results of said auction are also posted on invaluable and auctions zip platforms. That being said the consumers items were sold to the highest bidder in a fair and ethical manor without reserve. (Per the contract).  Consumer has not offered any factual documentation to support a claim and as such we request that said complaint be dismissed with prejudice.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my dispute.Subject: In regards to my complaint #[redacted], after having talked to a few people I have some new element to consider, which I did not even knew as the seller did not mention this fact, and could be very serious and infringing us Law  Concerning the product mentioned on jabber site and the Revdex.com site, which was on invaluable site and on e bay site offer for auction, the seller did not inform E bay, Invaluable  or the futur auctioners that this large Vaseline glass bowl was made of glass which contain different  radioactive elements toxic for human and animal being. http://www.invaluable.com/auction-lot/antique-victorian-fishbowl-on-iron... it is written in the description of the LOT 328;"Seller assumes all responsibility for this listing"LOT 328Seller's Estimate: USD 0 - 0With large Vaseline glass bowl the bowl is damaged The seller should have notified that a Vaseline glass bowl, specially a large one, is containing radioactive elements which can be particularly dangerous for human health. To make it simple for the novice, a Vaseline bowl is containing the following radioactive particules;·    U234  which is the most radioactive isotope of uranium as being and alpha emission·    U238 which is also a radioactive isotope of the uranium as being an alpha emission and which is disintegrating in different isotope and ending giving radon, a radioactif gaz which has been seen a long time proved  to be carcinogen·    Th231, Thorium 231 which is radioactive as being and alpha emission of  U235·    Th234, Thorium 234 which is radioactive as being and alpha emission of  U238Th234 produce Pa234, Protactinium 234, which is radioactive Th234, Pa 234 produce radioactive bêta and gamma emissionsPa 234 produce U234 which is a radioactive alpha emitter for a  period  of 250,000 years ! Moreover, disintegration of radioactive elements cause the emission of alpha particles, beta or gamma which are more or less impact on human and animal organisms. Some parts of the desintegration of those elements may give also radium radioactive element. Finally, the fact that the seller writes that the bowl is damaged is very worrying because the product can easily crumble or deteriorate and thus turn into dust inhalation which is highly toxic and impossible to prevent in a domestic setting as requiring the implementation of professional devices. All these causes of major radioactive toxicities through a domestic environment linked to the presence in the Vaseline bowl of radioactive elements with life period of several thousand years should have:·    been indicated by the seller. None of those indications were notified on both site where the seller put this article·    prevent the sale on e bay or invaluable for such a product containing dangerous radionuclides and banned from sale in many countries·    prevent the sale of such products are banned from export in many countries and transport within the country without special precautions for the staff concerned and the environment in case of deterioration of the element (which according to the seller's is already the case, which is even more oblivious of him and makes him guilty of serious health and environmental négligences!) As a professional in the medical field and radio protection against radiation, we consider it our duty to intervene in this debate and inform the necessary authorities and the sites concerned by the serious  lack or relevant information in the description of this product of the GALLERY 70TWO by selling on a site open to non-professional public, an article containing radio active elements without any information, in contravention with several international laws and risking serious injury to the safety of the buyer and it immediate environment. Thank you very much fo your prompt answer. [redacted]

We rely on our earlier response

Foremost the consignors check for auctioned items was written on 10/1/2015 and was mailed to [redacted] (Please see attached file) As to the pick up of items at the consumers address it was explained on 8/22/2015 in person (And said conversation was recorded) that an...

initial deposit for pick up services of $180.00 would need to be paid in advance in order to have said pick up placed on the schedule.  Consumer acknowledged this and stated that when the time got closer she would call in with payment.  Consumer failed to do so and thereafter called in on the day she wanted a pick up done. (Advance notice is required as is deposit for scheduling purposes) She was informed that our truck was involved in an accident and as such we could not move forward on immediate notice even if we wanted to. (Please see attached file) She said she fully understood. Consumers failure to follow policy lead to this situation and Gallery 70Two is in no fashion at fault.

We are sorry to hear of the issue from this customer.    As to our policy governing items dropped of,  it is always by appointment only and further we request that the custormer call the morning of the appointment to confirm that they will in fact be in at the scheduled time....

When this customer came in and met with [redacted]a she did not elect to fill out the paperwork for consignment at that time but instead stated that she would do so at a later point in time. At a later date the customer called into the office and stated that she could possible have the item delivered on Tuesday.  [redacted]a explained that the custome needed to call in the morning of the drop off day to make sure that staff was available to recieve the item.  The customer failed to do so. On the afternoon that the customer did arrrive it was explained that there was noone at the office to recieve the items and initiate a contract and as such would have to return on Wednesday in which to do so and the employee apologised for the misunderstanding.  The customer stated that she would not be coming back and therein left. The only employeed that this customer delt with was [redacted]a governing the drop off of the item and as such she was not told several different things by other employees because there was no other employees she could have spoken with since [redacted]a handles all inhouse customers. Again we are sorry for the confusion and of course the customer is always welcome to drop the item off at a future time.
