***,I was just made aware of a complaint you made with the Revdex.com regarding your billing for [redacted] unit #I wish you had called or emailed me to discuss the situation prior to your complaintI was unaware there was an ongoing billing issue until I received a call from the Revdex.com yesterday.I had Bookkeeping pull all the documents from your file and it appears you did send letters asking about your billing and when the due date each month is to avoid late feesThose requests for information were responded to by BookkeepingJust to clarify, ***, according to the [redacted] HOA Collection Procedures and Policies, (sent to you previously and attached here) the monthly fees need to be received within days of the due date which is the 1st of eachmonth.Also to clarify, my office has never charged you a late fee even if the payments were receivede 15th of each monthMy office has also never reported any late, or otherwise, information to any of the three credit bureaus about you or your account.In your homeowner file, there is a letter dated February 11, stating your tenant brought to your attention that the front patio floor is in need of repair (attached)Those letters do not come directly to me since you send them with your monthly checkIn the future, it would be more logical and reliable if you address any concerns you may have directly to me either by mail or emailMy email address is I [redacted] That will prevent oversight or delays.I will have our crew go to unit #and repair the patio by the end of this monthPlease make sure any items preventing the work are removed by February 26, Please also let your tenants know the work will be done and to expect our handymen.As there have never been any late fees assessed nor any credit bureau reporting against you, I will consider this resolved unless I hear from youMy office number is ###-###-####.Thank you[redacted] Community Manager

I have reviewed the response made by the business in reference to complaint ID ***, and find that this resolution would be satisfactory to me. I will wait for the business to perform this action and, if it does, will consider this complaint resolved. I have written her a letter back to let her know that the Only action I took when my credit score decreased points was to contact youFortunately my credit score has increased points. I also showed her several instances where she was in error that I had Not paid my monthly HOA fees & she was going to require me to pay $for fees I had already paidI had to spend several hours getting all the information to prove I had already paid the fees & they were not late to days; this statement was sent to me 9/18/The other statement sent to me on 12/19/said I was $short on my payment for October which was their error & I again spent my time showing her I had paid my feesMY hope is that in the future she will be more competent so I won't need to spend time correcting her errors

May 25, 2017RE: GALLERY PROPERTY MANAGEMENT RESPONSE TO COMPLANT if *** - *** *** Gallery Property Management*** *** and was accepted at one of the homes managed by Gallery Property Management located at *** *** in Costa MesaI did a move in inspection with this tenant and
his concerns were documentedThere were no major items identified upon move inHis minor issues were addressed*** claim that the property needed major repairs is completely falseThis was a fully renovated property and the Landlord had a previous tenant in the property that had rented the unit with no issuesAt the time of move in, *** requested a fence be put up to close off his carportI explained I would ask the owner but I didn't know if that would be doneThe owners did not want to incur the additional expense since they had just rehabbed the homes on the lot so *** was told noMonths after on one of my drive by inspections, I noticed there was a fence upIt was nicely done but I called *** and told him the fence should not be up and attached to the homeHe explained it was not attached to the home and was simply a roll-away fence attached to iron footings Sturdy enough so his son could not get out of the back yardI let the owner know the fence was upSince it was not attached to the home but attached to the post, it was allowed to stay providing the property was returned to its original condition after removalBeing told no originally set the tone for any future communication with this tenantHe would do what he wanted, when he wanted and not inform management.During his tenancy, there were sink backups and Gallery had a plumber on site the same day on both occasionsOn one of them, the owner and I personally checked the problem as well to see what could have caused it and the plumber was called out immediatelyThere was also a shower cartridge that was replaced and a sprinkler leak which were both handled right awayI don’t know what the tenant is referring to that took months to get repaired and therefore the claim that the Management company doesn’t respond to repairs is without basis or meritThere was also a dishwasher issue which was handled but that took a little while due to the brand of dishwasher, a part being ordered, etcThe technician was out within days but the part was backorderedThe dishwasher was also repaired. At no time did any staff or contractorshired by Gallery Property Management enter the home without sufficient notice and/or the tenant being on siteThe tenant had the keys changed to the front door without Gallery's knowledge so the tenant did provide a key to us after the fact but heI am unaware of any repairs the tenant made himself except for a switch plate cover and a bulbHe sent an email with the receipts and was reimbursed.always met us at the homeHis work was a few minutes away from *** ***.Near the end of the lease, the tenant asked me if he would be receiving a lease renewalI explained the owner of the property typically went month-to-month with his tenants after a year instead of signing a new lease but I would askI also indicated in some instances the owners do not renew and extend the lease termThe owners decided not to renew the lease and had different plans for the home so Gallery Property Management sent an email to the tenant at the direction of the owners explaining there would not be a lease extension and giving the tenant sufficient notice to find another homeThe email is copied and pasted below:On March 22, sent the following email to the tenant:Hi ***,wanted to contact you right away regarding your lease at *** ***.The Landlord has decided not to renew your lease.Since your lease ends on March 31, 2017, you will need to vacate by that dateThe Landlord is willing to extend that date by or days, but not beyond days.Please get back to me by no later than tomorrow to let me know what your time frame will be.if you do automatic payment for rent, please stop that prior to sending out your April paymentThe owner will not be accepting the full rental amountcan provide you with the pro-rated amount when you let me know tomorrow what date you will be setting as your move out date.The tenant did not respond to me after multiple attempts to get an answer from himSince there was no answer from the tenant after weeks of trying, the owner was forced to turn it over to his attorney to handle it and I was advised to have no further communication with the tenant*** claim that he was “given little time to relocate” is erroneous and does not accurately depict the situation*** failed to respond to our multiple requests since March 22, to set the final move outdateWe gave him the choice of 3-31-17, 4-15-(days) or 4-20-(days)After ***' failure to respond, the owners were forced to take legal action.The construction *** is referring to in his last sentence was some trench work being done at the homes located on this lot to improve drainage issues at the propertyThe work began, a trench was dug, piping redone, City approval had to be received and inspected throughout the processDuring this process, Gallery Property Management had plywood placed over the trench area for safety purposesAll tenants of the homes were treated with respect and updated periodically of the progress.*** desired settlement references a full refund of the deposit in the amount of $(which was actually $2850.00) and refund of legal fees in the amount of $It should be noted that *** received a security deposit refund of $He forfeited a portion of his security deposit ($445.80) due to the Landlord incurring costs for the following:- Carpet cleaning for stains in the bedrooms - Power washer rental to clean carport concrete from fence footings installed without Landlord approval- Oven cleaning, shower cleaning, and bathroom cleaning- Common area expenses for utilities that *** failed to pay per the lease terms - Patch and repair nail holes in drywallI was not involved in any of the legal procedures and am unaware what, if any, werecosts for suchGallery did not hire an attorney or take any legal action against *** so I am not sure what he is referring to.*** ***
