From: Garcia's Renovations Date: Thu, Nov 5, at 6:PMSubject: Re: [redacted] Complaint ( [redacted] )Below is our response to the complaint.In March 2015, we were hired by a homeowner and his wife to remodel a kitchen and bathroomWe began work in early AprilOnce we began work, the homeowner made additional change orders to the contractWe focused on the change order because they were items that needed to be taken care of before completing any renovation workThe change orders were completed, and the owner of the apartment requested us to stop work in two different occasions throughout the project for a week each, due to one week the owner would be traveling for business and he didn't want anyone at the property, two his wife was traveling to Brazil and wouldn't be homeThe homeowner had originally delayed the project with change order, and then the delay of two weeks of stopped work per owners requestOnce we were able to return the the property, our company discovered a lot of plumbing issues that needed to be addressed and fixed by property management, due to the damages affecting other apartmentsWe addressed this issue to the owner and the owner stated he would talk to building management since the plumbing issue was out of the contractor's handOnce the owner spoke to building management he was given a feedback that the apartment complex wouldn't take care of the issue, that it was the owner's responsibility The homeowner wanted Garcia's Renovations to be responsible for the existing issues and damages the plumbing had, we disagreed and issues began sinceOnce this disagreement began, so did problemsThe homeowner's wife began verbally harassing our workers, which resulted in employees refusing to work at this specific projectThe homeowner's wife did not only verbally harass our employees, but she smoked marijuana in the presence of the workers, offered them drugs and made them feel uncomfortableAt one point through the harassment, the homeowner's wife chased one of the employees across the street because he was terrified of herShe had been using drugs, cursing, harassing the employee, chose to walk out until she calmed down and she chased him across the streetThat same day both homeowners called in the contractors and they were extremely rude, aggressive and cursing at the contractorThe owners verbally told the contractor to not go back into the property (their was never a written termination of contract) , and demanded to get his money back, and threatened to make statements in any social media, internet google, or any business bureau we were associated withAside from all of the homeowners threats, the homeowner called in the supply store where his kitchen cabinets were being held upon pick-up, cancelled the order and collected his $that had been paid towards kitchen suppliesGarcia's Renovations would also like to address that without a company insurance no company (our company) could not do any work in the apartment building, therefore this states that before any work was done we had submitted our paperworkGarcia's Renovations had a bad experience with these homeowners, lawyers are currently involved, and these homeowners have to remove any negative statements they have made against our companyBoth parties have agreed that the fair money being refunded is $3,out of the $10k originally requested by the homeownersWe are now in the process of clearing any negative outcomes these homeowners complaints have caused our company.Please let me know if you need anything else, and what is the time frame or process of getting this complaint resolved and having our Revdex.com grade corrected.Thank you,Leticia M [redacted]

Garcia's Renovations accountable for the cabinets that were not listed under our price in the contractAn argument occured between Jose and *** ***, the only thing that was included in the contract was the installation of the cabinets, not the purchase of the cabinetsJose walked out upset out of the job because *** *** was not complying with the terms of the contract and wanted Garcia's Renovations to purchase the cabinetsAfter him complaining to BB, Jose reached out to himThey settled to finish what was left of the project, and *** *** would purchase cabinets on his own and have them installed on his own as wellPlease let me know what further steps I need to take to get this cleared from BB. I am rejecting this response because:It is very difficult to go
point by point through the response letter submitted by this business
because so much of what is in the letter is pure fabricationI will do
my bestContract was signed March 10, $5,was paid
immediately as per contract to order supplies (manly kitchen cabinets
and countertops)The contract stipulated a 3-week turnaround time for
fabrication of cabinets and countertopsIn the 3-week period that
ensued, the contractor made no inquiries related to kitchen design or
layout and no order for supplies was ever submittedWork
began on April 15, Prior to that date $3,was paid to
contractor as per contract as payment "to commence work"Furthermore,
prior to that date another $2,was paid to contractor beyond what was
required in the contract in good faith because the contractor
complained about issues with his bank putting a hold on the previous
paymentThere were NO change orders made to the contractAll
of the work that needed to be done was laid out in the contract that
was signed on March One week-long work stoppage was a
result of the contractor not being able to provide an insurance
certificate that was required by my homeowners association and that the
contractor previously indicated he hadBuilding management stopped all
work in my unit until the insurance issue was resolved - the reason the
contractor was unable to provide an adequate insurance certificate was
due to an unpaid balance with his insurance provider that resulted in
his insurer refusing to provide any new insurance certificates until the
balance was paidBuilding management shut down the work site on April
and allowed work to resume on April My wife was out of
the country until May The contract stipulated that all work would be
completed in a 2-week time frameWith work beginning on April 15, per
the contract, everything should have been completed by the time my wife
returnedIn fact, the project timing was specifically agreed upon and
discussed with contractor such that all work would be done in my wife's
absenceThe plumbing issues that the letter references were
caused by the negligence of the contractorAll plumbing valves in
bathroom and kitchen were old and needed to be replacedThe reason
building management had to get involved is because the contractor's
employees left the kitchen partially demolished with a leaking valve for
three consecutive days, which flooded my kitchen as well as the unit
belowBuilding management called in an emergency plumber to shut off
water and the building and replace the leaking valves so as to prevent
further floodingOn April I received a letter from
building management with an invoice for $for repair of various
damage caused by the contractor's employees to the common areas of the
building as well as for the work performed by the emergency plumberThe
contractor reviewed the invoice and verbally agreed that this balance
would be deducted from the final payment under contractThe
statement made regarding us supposedly collecting $3,that was paid
towards kitchen supplies is falseNo money was ever collectedEven if I
had wanted to do that, I would not be able to because despite repeat
requests the contractor refused to tell me where the kitchen cabinets
are being ordered fromAll statements made regarding my wife
are purely fabricatedAgain, all work in the unit was supposed to be
completed by the time she returned on May She may have at certain
points expressed her frustrations to the contractor and her employees
due to the fact that they skipped a number of work days and when work
was being done, typically workers arrived on site between 10am and 11am,
and departed between 2pm and 3pm, which did not appear reasonable given
that the project was already delayed by 1-weeks at the timeAs far
as drug use goes, the only thing that I am aware of is that the
contractor inquired whether my wife had any friends that were interested
in purchasing large quantities of marijuana and offered to produce
samples of his productMy wife politely declined to entertain the
conversationThe contract was terminated in writing on May
At contract termination, the kitchen was fully demolished, the
bathroom was partially demolished, no materials had been ordered and/or
brought to my unit save for about $of cement boardThe contractor's
immediate claim at contract termination was that $6-7,worth of work
had been performedGiven the fact that no materials had been ordered
and that only demo work had been partially completed, and combined with
the fines imposed on me by building management, the property damage
inside my unit that was acknowledged by the contractor, as well as the
$1,refund that the contractor promised to my wife in writing to
compensate us for the repeated delays and gross negligence on the part
of the contractor, I firmly believe that I am owed at a minimum the full $10,that was originally paid to the contractor
The parties have never agreed to a refund of $3,I have retained an
attorney to assist with this matter and we are proceeding with filing
suit due to the contractor's continued refusal to make things rightThe
contractor has been made aware that damages sought by the civil claim
will be in excess of the $10,originally paid in order to adequately
compensate us for various damages resulting from this breach of
contractI believe I am protected by the 1st Amendment when
submitting online reviewsI have been extremely dissatisfied by the
work performed by this contractor and highly inconvenienced by what at
this point amounts to $10,being stolen from me, which prompted me to
submit a number of online reviews so as to help protect other residents
in this area from falling victim to this dishonest businessOn two
occasions, the contractor has threatened to sue me via text message as a
result of the online reviews that were submitted.Attached are
pictures of the state of my kitchen and bathroom at contract
terminationPlease note that the toilet in the bathroom was purchased

I searched for many different companies online before making my selectionI called this company's references, the owners of the company met with my husband and I to discuss my home renovationI felt very comfortable with the gentleman, he showed me pictures, past projects and I loved itI needed my basement finished and remodel my master bedroomI couldn't be happier with the resultsThis company promised and fulfilledThey are a small company but know exactly what they are doingThey are very easy and smooth to work withThey gave me a list of options to chose fromHighly recommend them

Date: November 5, at 6:57:PM ESTTo: Jose G*** , Reno Subject: Fwd: *** *** Complaint (***)Sent from my ***Begin forwarded message:From: "Garcia's Renovations" Date: November 5, at 6:11:PM ESTTo: *** *** Subject: Re: *** *** Complaint (***)Good afternoon *** ***,Below is our response to the complaint.In March 2015, we were hired by a homeowner and his wife to remodel a kitchen and bathroomWe began work in early AprilOnce we began work, the homeowner made additional change orders to the contractWe focused on the change order because they were items that needed to be taken care of before completing any renovation workThe change orders were completed, and the owner of the apartment requested us to stop work in two different occasions throughout the project for a week each, due to one week the owner would be traveling for business and he didn't want anyone at the property, two his wife was traveling to Brazil and wouldn't be homeThe homeowner had originally delayed the project with change order, and then the delay of two weeks of stopped work per owners requestOnce we were able to return the the property, our company discovered a lot of plumbing issues that needed to be addressed and fixed by property management, due to the damages affecting other apartmentsWe addressed this issue to the owner and the owner stated he would talk to building management since the plumbing issue was out of the contractor's handOnce the owner spoke to building management he was given a feedback that the apartment complex wouldn't take care of the issue, that it was the owner's responsibility The homeowner wanted Garcia's Renovations to be responsible for the existing issues and damages the plumbing had, we disagreed and issues began sinceOnce this disagreement began, so did problemsThe homeowner's wife began verbally harassing our workers, which resulted in employees refusing to work at this specific projectThe homeowner's wife did not only verbally harass our employees, but she smoked marijuana in the presence of the workers, offered them drugs and made them feel uncomfortableAt one point through the harassment, the homeowner's wife chased one of the employees across the street because he was terrified of herShe had been using drugs, cursing, harassing the employee, chose to walk out until she calmed down and she chased him across the streetThat same day both homeowners called in the contractors and they were extremely rude, aggressive and cursing at the contractorThe owners verbally told the contractor to not go back into the property (their was never a written termination of contract) , and demanded to get his money back, and threatened to make statements in any social media, internet google, or any business bureau we were associated withAside from all of the homeowners threats, the homeowner called in the supply store where his kitchen cabinets were being held upon pick-up, cancelled the order and collected his $that had been paid towards kitchen suppliesGarcia's Renovations would also like to address that without a company insurance no company (our company) could not do any work in the apartment building, therefore this states that before any work was done we had submitted our paperworkGarcia's Renovations had a bad experience with these homeowners, lawyers are currently involved, and these homeowners have to remove any negative statements they have made against our companyBoth parties have agreed that the fair money being refunded is $3,out of the $10k originally requested by the homeownersWe are now in the process of clearing any negative outcomes these homeowners complaints have caused our company.Please let me know if you need anything else, and what is the time frame or process of getting this complaint resolved and having our Revdex.com grade corrected.Thank you,Leticia M***
