Thank you for your email, but I DID have an appointment with Ms***. You can ask ***, who made the appointment in front of me. I also left her a voicemail confirming my meeting with her on October 14th at 11am. In addition, the lady at the office who on Thursday October 15th spoke to me and informed me that *** *** would not be making her appointment, also promised that I would receive a call back that same day to try to set up another time. I am not to cause problems for people, but this repeated behavior by your office not to return phone calls and messages, as done by your property manage and ***, the assistant manager, is unacceptable
I want to let you know that I am going to prorate next month’s rent by nights and deduct the damages to my book case caused by your repairmen from my next month’s rent, unless I get a face to face meeting with your corporate representative to discuss my grievances. To Whom It May Concern,
This morning I took work off to have a meeting with *** *** at 11am. She failed to show to this meeting and an assistant told me that she had another meeting and was never told about my appointment with her, which was booked on 10/13/by ***, a front desk person. This is also in spite of the fact that she received a phone message from me confirming this appointment yesterday, 10/14/at around 12:30pm. I would expect someone in her position to regularly check her voicemail, and it is reasonable for me to assume that she did receive my message, because I left her the voicemail in response to a message from her asking for permission to enter my apartment, which I granted on my return message. The repair personnel did enter my apartment yesterday suggesting that she must have received my message, but chose not to show, confirm, or cancel our meeting!
I have been a tenant at your property since the May and have encountered a series of problems, which after consulting with a lawyer, qualify as a breach of contract by Garden Communities. I have tried repeatedly to reach a resolution to my concerns by stopping by the office on our premises, but lack of follow up and communication via my unanswered emails, have left me with no choice, but to raise things to your level. At best, we can reach an amicable resolution, and I am hopeful that the corporate office will show more response to my worries. At worse, I have claims against you that will hold in a small claims court
I request that someone from the corporate office, above *** ***’s level, contact me as soon as possible to arrange a meeting regarding my concerns. I cannot tolerate the incompetence that has been shown at the local Costa Verde office and I request help from someone directly located at the corporate office
Thank you for your attention to this matter

Resident(s) signed at term lease agreement. Next resident to occupy unit *** moved in September 2, 2015; hence, full amount of rent due to end of lease term.
See excepts from Lease below:
The term hereof shall commence on September 16, and continue through and until August 31,
Upon expiration of the term, the tenancy shall automatically convert to a Month to Month agreement
on the same terms and conditions as the Lease, unless lessee gives the Landlord at least thirty (30) days
written notice that he/she intends to terminate the tenancyLandlord also reserves the right to terminate
tenancy, with or without cause, by serving Resident with at least thirty (30) days written notice of intent not to
renewTenant may not terminate the lease before the expiration date above
Resident is obligated to pay rent through the end of the Lease term even if Resident vacates earlierIf
Landlord finds a replacement resident before the end of the Resident's term, Resident will receive a credit for
the rent paid by the replacement residentThe amount of rent for which Resident will be responsible will vary
depending upon how long it takes the Landlord to find a replacement residentThis amount cannot be
determined in advance and is difficult to estimateTo avoid this uncertainty, Resident may choose to pay a
flat fee in advance to terminate the lease early, rather than remaining liable for rent due through the end of
the lease termTo exercise this option, Resident must deliver to Landlord:
• a written notice stating that Resident has elected to exercise this option;
• an early termination option fee equal to one month's rent; and
• rent and other amounts due through the accelerated termination date

I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below. I did with Ms*** ***, who offered to repair the book case, but no one showed up to my apartment for the repair. In addition, I was never informed that they agreed to the proration of the rent and I submitted the full amount to the rental office this month. I will look for an updated adjusted invoice for next month's rent and will update this complaint accordingly. The invoice usually arrives in the middle of each month.I did speak to Ms***s this morning after a week of trying to reach her. She did not mention anything about why the repairman did not show, nor did she mention her acceptance of the rent to be prorated. I also spoke to her aboutt the incessant trash problem that infests our building and mentioned a phone call that I have to the City of San Diego department of health. She agreed to considering to having a trash patrol to make sure other tenants are not leaving their trash. The management is very professional and pleasant to speak to, but the lack of action continues to be the problem that I originally filed a complaint about (e.grepairs that are scheduled that do not happen, meetings that are set up, but do not take place)

This issue is not resolvedSince Garden Communities has previously failed to communicate openly and respond to any questions I have in regards to this situationGarden Communities did not seal the hole back up upon completion of their inspection of the wall on 10/16/2015, and there is still a very strong mold scent coming from the carpetI am requiring I be compensated in full for rent I have paid from 10/16/to 11/30/2015, release from my current lease with no penalty or negative notes, and a return of my security deposit in full According to Garden Community’s calculation of rent being $per day, I am owed $for October 16-31, and $1,for the entire month of November as well as my $security deposit which equals $2,to be paid in fullFurthermore, upon rearranging my belongings to allow space for *** and *** to cut open the wall, I have noticed my personal belongings including my queen-sized mattress and box spring have a strong mildew smell to them as well, which I consider to be unsafe and ruinedThis will add $for the mattress and $for the box spring to the total, bringing the grand total to $I believe I have done everything within my power to assist Garden Communities: reporting the issue at first notice and allowing Garden Communities to do everything they thought was necessary to remedy this situationI have gone home on my lunch break on every occasion when someone from Corporate or my property manager needed to visit the unit to be sure everyone was on the same page and stress the importance of handling this situation professionally The reason I am still in my unit is because within such a short time I have been unable to financially cover the costs of: finding another place to live, moving all of my belongings by myself without a vehicle, putting a deposit down in a new community and immediately paying higher rent than I am currently since I need to stay in the same area to be close to my workI chose this community because of the convenience of location and pricingI was not expecting to move until January at the earliest, if at all.I feel victimizedI do not believe Garden Communities has given the proper attention to me as a tenant and my concernsThe terms and conditions I was offered were not within a reasonable timeframeI do not feel as though Garden Communities has set up a plan that includes everyone’s best interestsI did not ask for my wall to be cut open- this was purely ***’s doingI did not delay Garden Communities from making repairsI did not create a mold or moisture issue in my apartmentI am entitled to a safe, inhabitable unit and I have not been provided with one since October 16th, I am choosing to be released from my lease and move out of La Jolla Canyon community, however, I did not agree on staying until December 15thI simply asked if it was an optionAll of my personal belongings have been removed from the apartment as of Sunday, November 29th, I have completed a walk-through of the unit today with ** and he has confirmed the unit is currently is great condition and I will be receiving my full deposit back, minus a final *** bill

• an early termination option fee equal to one month's rent; and
• rent and other amounts due through the accelerated termination date

Good morning ***,
Following up on your complaint to Revdex.com.
Since you are not named on the Lease the privacy act does not allow us to respond with specific details of the rental transaction. We follow the guidelines of state and federal fair housing
Responding in general terms and not discussing apartment specifically, we do not advertise AC, AC is not included as an amenity on our brochures or the website. *** has not at any time indicated to a potential resident that we have AC at La Jolla Canyon. If asked about AC *** and any other employee in the leasing office would answer “no”. You will find most communities built in the same timeframe as La Jolla Canyon do not have AC
If you did not inquire about AC prior to move in and voiced your concern to the leasing office in a reasonable time after moving in and discovering no AC the Owner would approve releasing you from your lease without penalty waiving the requirement for a 30-day notice allowing you to move to a community with AC at your earliest convenience. You would be responsible for prorated rent based on the number of days you had possession of the apartment.
Landlord shall furnish Resident with an itemized written statement of the basis for deductions and amount of Security Deposit withheld after the termination of Lease Agreement, if any; along with the current disposition of the Security Deposit, and shall return remaining portion of the Security Deposit in accordance with the requirements of the law, no later than twenty-one (21) days after return of possession to Landlord of the Premises
We hope you find the information above helpful. Have a wonderful day

Good afternoon ***,
We apologize for any miscommunication.? Additional repairs will not be scheduled until you move out in December.?
We will send a representative from our corporate office to the community next week for a follow up inspection
As reported to you after air quality inspection your home is not uninhabitable.? A small section of drywall was removed to view thru to interior of wall and back side of exterior wall and then replaced.?
You were offered a comparable apartment to transfer and offered release from lease waiving the requirement for 30-day notice if you prefer to move to another community instead of transferring to another location in the community
Again, the offer to transfer to a comparable apartment, if available, or move to another community at your earliest convenience without penalty is available
You requested to stay until December 15.? See correspondence pasted in below

I have already paid rent through November and wish to be released of my lease at the end of this month or December 15th
I have multiple family trips planned in November, some of which have been planned a year in advance:? ~11/5-11/in Mexico~11/20-11/in San Francisco,? ~And Thanksgiving is 11/26-11/29th up to Shader Lake, CA
Moving in November is going to be really difficult and a huge inconvenience
As far as financials are concerned, I am up to date on all of my rent and bills and have never had any issues with missing payments since 2/I was not going to be penalized for missing it now even though this situation is still continuing to disrupt my routine
The best I can do at this point to make the unit available to be worked on is to try to get everything moved out after work every day in NovemberIf I can have some wiggle room with this, extending it to December 15th, that would be extremely helpfulI will be moving things alone for the most part while working full time and in between all of these planned trips
The hole in my wall needs to be covered and sealed with a piece of drywallI don't mind if it isn't painted, just so no outside elements or bugs can get inside during my final weeks here
I'm asking my entire deposit is returned at end of this new lease end dateI have been nothing but respectful to the apartment and communityI will not be held responsible for any additional feesI have lived here since 2/2014, this is all resulting from use
Furthermore, I would like my file to state my lease was ended early due to construction needed on the unit and reflect nothing negative for future renting

It is our policy to release only the conclusion which summarizes the report.? The report does not indicate a health concern.? We are offering a transfer or lease break without penalty to expedite repairs not for any reason related to the current air quality
Additionally, the Owner has approved a transfer to an upstairs apartment in a desirable location as a courtesy for the inconvenience of moving.? We are holding apartment as an option after resident moves out this weekend.? Apartment *** will be ready for move in by end of next week, we need a few days to clean, paint and install new carpet

Hello,
Thank you for getting back to meThe reason I am asking for the report is for my records and for my own health concerns
Is there a reason why I am not allowed to have access to the full inspection report and results regarding the unit I am currently residing in and have been residing in since February 2014?

Good afternoon **,
I appreciate you keeping me updated on this situationOf course I would like to be present when the corporate rep is at the property if possibleI am available 12pm-1:30pm or after 5pm Monday-Friday
Can you please explain to me what goal we are working towards with bringing someone from corporate out to visit the property again? We did moisture testing twice in the bedroom with positive reads and I can still smell the musty odor in the same general areaThe smell is stronger when the carpet and pad are lifted and when the temperatures are high
I definitely would like your and corporate's advice on what our next steps are: mold testing by a professional inspector, complete carpet and padding replacement, or otherwise
As I have stated before, this is an important health issue that deserves close attention and speedy action to resolve
Thank you,

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below. I did with Ms. [redacted], who offered to repair the book case, but no one showed up to my apartment for the repair. In addition, I was never informed that they agreed to the proration of the rent and I submitted the full amount to the rental office this month.  I will look for an updated adjusted invoice for next month's rent and will update this complaint accordingly.  The invoice usually arrives in the middle of each month.I did speak to Ms. [redacted]s this morning after a week of trying to reach her. The management is very professional and pleasant to speak to, but the lack of action continues to be the problem that I originally filed a complaint about (e.g. repairs that are scheduled that do not happen, meetings that are set up, but do not take place)
