Review: On April 15, 2014 American General Contracting and myself entered into a contractual agreement dealing with fixing and repairing of my concrete driveway at my residence. Three thousand dollars was given to [redacted](main contact or supervisor at the office) for the total performance of the work. Even though I did not agree that the total payment should be made [redacted] insisted to move forward with the project. The contract also requires that [redacted] ( Contractor who had previously perform work on the driveway) to also enter into the agreement and a copy of such be added to the body of the entire contract. No work has been performed to date nor is there any time schedule for the work to be performed. I asked Mr [redacted] for a copy of Mr [redacted]s commitment(contract) and was not furnished a copy. Mr [redacted] told me recently he did not sign a contract. Mr [redacted] did not enter into the agreement thus making this contract useless. I have asked [redacted] to return the monies for breach of the agreement and he has been continually avoiding me and refusing to comply. I have called at a minimum of 15 times to try and talk to [redacted] and he does not return texts or calls or if he does respond in texts, he tells me he will get back with me at a later time which doesn't transpire.Desired Settlement: Return all monies that were paid to the company to do the job.

Response:

We have reach a agreement on a return on amount of said money. I believe Monday or Tuesday a refund will be giving after Mr. [redacted] signs a document for us. I will get a copy of his contract over to you which clearly states a deposit is non refundable and states way. So to be honest we are going against policy for him as it is . I cant even believe the lies. I would love to pull phone records and message history just to prove a point. That we have talk more then we have needed to probably and the office doors are always open as well. We will be taking from the check to cover monies spent on planning project, time spent ordering and picking up materials, etc Down time that the crew that should be working on project is now going to be not working. We still have to pay for that labor we schedule months ago to work on his project. This was all stated in his contract as well. We should have this over with first of next week.

I have reviewed the response offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

I have no documents that suggest anything as to what he claims. You have all documents I received from him. He kept a copy of one part of the contract without letting me have a copy. There was no materials order by him and it was not supposed to be ordered by him. I was not even placed on any time schedule. The total amount must be received for no work being performed

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution would be satisfactory to me.

This complaint was resolved on July 11, 2014. The contractor provided a full refund as requested. No further action is required. Thanks for helping esolve this issue.

Regards, [redacted]

Review: [redacted] contracted to build a deck made from new evolve material. Installed the deck improperly. [redacted] had to redo the deck. Reused the same material which he had damaged in taking the deck apart and ran out of new material. When asked about the construction damage, [redacted] stated it is plastic and he could melt it so the scratches will not show. He has sanded the areas which are still visable. Five areas of the deck, the wood grain is running the wrong way. One post cap is still left unfinished. Hand rails are not centered to posts. Close uneven gap between house and deck. Areas are pieced together where he ran out of material. [redacted] has not responded to resolve the matter.Desired Settlement: Replace damaged evolve boards and posts. Use single board on areas pieced together. Place the five pieces in line with the wood grain. Close one uneven gap between house and deck. Center hand rails to posts. Finish last post cap.
