My name is [redacted] . I am sole owner of Sophic Sage. My company sales quality wholesale healing products to retailers and online. A store named [redacted] in Pacific Grove, California placed a very small order with my company. On the day that I delivered the placed order, I purchased... some food in [redacted] - a hand made chocolate in the shape of a [redacted] and a jar of salsa that [redacted] (initiator of this complaint) said was made by her and her brother. I soon became ill after eating her product and I alerted her. She became very irate and irrational. I meant no threat, only that she should check her product for safety. I later learned that she was making the chocolate in her home and selling it at her store called [redacted] . This is in direct violation of health and safety codes. She did not possess the proper permits to sell such food, made in her home kitchen, to the public. Eventually, Monterey County Health Department became involved and an inspector found this violation of codes to be true. [redacted] has been asked by Monterey County to cease the violations and apply for the proper permits. Shortly after my conversation with [redacted] about the food poisoning, [redacted] started asking me to reimburse her for the product that I sold her saying that she was of the understanding that she would be an exclusive seller. She knew that my business is selling wholesale to retail stores everywhere. I don't understand why she wanted exclusivity of my product when all of the stores in her area carry the same soaps, candles, pictures with sayings on them, even Burt' Bees. So, why does she want to limit my product? I never promised her such a thing. Soon, it came to my attention that [redacted] and her mother were seeking out other retailers who carry my products and telling them that I offered her exclusivity of my product. I believe this to be in retaliation and an effort to discredit me, should I file against her for becoming ill, of which, I had no intention. In one conversation, I told [redacted] that I might consider taking my product back because I had another store in that area that I should like sell primarily (not exclusively) to. Sometime after that conversation, [redacted] and her mother entered into the particular store that I told [redacted] about and confronted the store owner about carrying my product. The store owner is an 80 year old lady with an exceptional store. The elderly store owner called me immediately and was frightened by the confrontation with [redacted] and her mother. She asked me to come pick up my product because she was too old for such "confrontations" and didn't need such stress. I asked her to write me a detailed letter of why she wanted to terminate our business relationship and to name [redacted] in the letter and she said that she would be too frightened to do so because [redacted] knows where to find her. I lost that account because of [redacted] and her mother and that particular account was worth a substantial amount of money to my company. I owe [redacted] nothing and I will not buy my product back from her after she has caused such loss. On the contrary, she owes me. [redacted] continued to stalk my social media and to reach out to other retailers through finding their information on my [redacted] and social media. I had to block her and her family from seeing my accounts, even though, I'm sure she will find other ways to get my information and I have actually become very frightened of her and am limited in my ability to promote my retail customers for fear that she will continue her scary behavior. Finally, after [redacted] showed up in my hometown of Grass Valley and called me to say she was here looking for me, I hired an attorney. Attached, you can find the letter that my attorney sent to her. Besides ***'s actions being retaliatory (driven by the violation of unsanitary food products in her store), her claims of exclusivity are preposterous. Exclusivity angers our customers and limits our ability to share our awesome products with a wider audience. Exclusivity increases the dependence of our company and the dependence of our valued customers upon a single retail outlet, especially if customers are also having problems with the same store owner and do not wish to shop at her store. If Sophic Sage offered exclusivity to specific retailers, we would not be properly diversified. My goal with Sophic Sage is to make our wonderful product easily available to customers around the world. The focus of my company is on the customer being able to find and benefit from our products and in no way offer exclusivity to one retailer who has the audacity to think that she can claim rights to something she had no hand or part in creating. Exclusivity is like telling a customer that they can shop at [redacted] , but, not [redacted] . It is hard for me to discern whether [redacted] is delusional and seriously thought that her small order could lock up rights to my product or if she was creating a case against me in return for the fear she felt when her illegal food product made me ill. My intentions were not to cause her any trouble, only to alert her to the fact that the food she was selling in her shop might be harmful (especially to infants). I owe [redacted] nothing and [redacted] has caused me much loss of time and money worth much more than her small order placed with my company. Her request for me to buy the product back is denied and I only hope that her pitiful life gets better soon. If she should continue her stalking behavior, I will ask my attorney to file for relief in court. And that is my final response.
