Thank You for The opportunity to document certain facts concerning this account. Much of the information described in the complaint is inaccurate.
Concerning the sale price- stated by the complaint at $5000.00 this is incorrect.
The correct selling price of the 1999 Grand Prix. Sale Date...
Aug. 7, 2014 was $3995.00
Indiana Sales Tax is $279.65 Making the "final selling price $4274.00 Another vehicle was traded in deal that was not paid for an amount of $335.94 being owed to be paid off this amount was added to the contract to he paid.
In order to help the purchaser we allow the sales lax to be paid in 4 installments of $70.00. The 1st payment being due Aug. 9,2014 and the every week there after ending Aug. 30, 2014.
There was no payments received until Sept. 12, 2014. 1 month and 3 days late. We received 3 more Partial payments during Sept. and Oct ending Oct 10, 2014. There is still $60.00 due to be collected for payment of sales tax.
The final amount financed was $4351.59 with interest added the total of payments adds up to $5467.00.
The contract was set up on a Weekly payment plan of $50.00 per week to begin after the tax payments were completed making 1st contract installment payment starting Sept 6, 20l 4. No installment payments have been made.
In an attempt to get the customer on track we made approximately 11 calls communicating with them that was necessary to get payments caught up.
Analysis: We sold the customer this vehicle with no down payment sales tax being set up on a payment plan. We are still short of collecting sales Tax of $60.00 we are required to pay and we have payed to the State of Indiana.
In Order to protect our interest in the vehicle it was necessary for us to repossess the vehicle.
Based on facts there is no refund due all that was collected was not adequate to pay sales tax. And there was no personal items in the vehicle upon repossession.
