We finished the job for [redacted] ***, when he arrived home he immediately sent me a text saying that’s not what he wanted, when in fact it was exactly what we talked about in July I immediately went over there after receiving the text, he brought up the idea of removing the rock and I told him if he would remove all the rock in the ditch that I would come back and fix itI showed up on September 29th, and dropped my Bobcat offSeptember 30, my guys show up to fix it and The Rock had not been removed from the ditch, it was thrown further back in the ditchHe never removed any of it, he told me that he was going remove it and give it to his neighbors when in fact he did not, When I spoke to him on the phone on September 30th, he told me just to throw dirt over the rock and I told him I could not because it would cause a drainage nightmare because the dirt would settle, then he whole another problemI told him to call me when he got back in town and I would meet with him again We met that following Friday, the first question he asked me is when is this job will be finished and I told him when you remove the rock out of the ditchI told him, once he remove the rock and Debra my part, that when he became very argumentative, so I got my truck and was getting ready to leave And he threaten me with legal actionI told him that my lawyers name was [redacted] and he can take it up with him, the last words that I told [redacted] If you remove the rock I would come back and take care of itThe next thing that I know he is putting up reviews on Google, Facebook, Angie’s List, Yelp, attacking my Christian values I never told him that I would not finish the job, I told him clearly if he would remove the rock as he promised that he would that I would come back out and fix itIt was his idea to remove the rock, not mineThe reason why the estimates changed is because he had several trees removed, I told [redacted] that grass will not grow with woodships in it, he agreedI have did everything that was asked of meHere are the texts from our conversation, after I seen the reviews I sent him a text, That I would not hold any resentment towards him for attacking me on social mediaThen replies and calls me names and told me to stop harassing him if I wasn’t going complete the job, this whole time I have never said I wouldn’t finish it, I told clearly if he removed the Rock like he promised and it was his idea then I would fix it

I am rejecting this response because: Gary (owner) of Garrison's Landscaping did not perform the work correctly as discussed, agreed upon and quotedHe specifically asked for the money near
completion to pay his workers and promised he would complete the remaining workSeveral days later he had the concrete repaired that was broken during the jobHowever he did not complete the rock placement, dirt, seed and strawHe refused to complete the job and argued with meWe agreed that if I moved several tons of rock on my own, that he placed in error, he would finish the jobI moved the rock as discussed. Several days later he again refused to place a dump truck of dirt, seed and straw in the agreed and quoted areaThe last meeting I had with Gary to ask what I can do to help finish this job, he argued with me (customer) again and drove offHe simply refuses to finish the job

I am rejecting this response because: I do not accept the response from Gary of Garrison’s Landscaping as factual or relevant to resolving the situationThe documentation I received from Gary and what I’ve provided to the Revdex.com clearly shows that rock and DIRT was supposed to be placed in the designated areaI have text documentation that the grass and straw were supposed to be placed over the dirt from the additional job on my lawnThe picture provided earlier clearly shows no dirtI communicated to Gary that the rock was placed in the WRONG location and is MISSING the DIRTHe argued with me at my homeI did not feel comfortable with his nature and so we agreed that if I personally moved a portion of the rock that he would return and fill the area with dirtWhen he finally returned to my home he said the rock hasn’t been moved to his satisfactionI expressed that I did exactly what was discussed and moved the rock on my own since he wouldn’tThis job is NOT finishedHe ADMITS in his response that the job is not finished and will add the dirt when the rock is movedI’ve since received estimates from other landscapers and the rocks are perfectly placed to keep the dirt from eroding awayAll that simply remains is grading in a dump truck of dirt and adding grass and strawIt is apparent to me that Gary refuses to finish the job and make it rightAny reviews that I’ve placed are simply honest reviews from a dissatisfied customerMy only regret is that I made the mistake of paying him in full and believing him to be an honest manI would prefer not to seek legal action but it appears I have no recourseI’m willing to accept a compromise that if Gary will simply grade in a dump truck of dirt (sloping downward toward the rocks by the drain) I will place the grass seed and straw myself; as well as take full responsibility for any future erosionI wish to express my thanks to Revdex.com for attempting to resolve this situation
