We hired Garry to install a deck, started out well. Garry then turned the job over to another man and a couple kids. Garry very rarely came to check on the job. Several issues evolved. During construction, food was thrown on roof, screws and trash left all around pool area after being told they clean up each day. We cleaned it up to prevent the screws damaging our pool liner. When finally settling bill, we were charged $2800 over quote but still paid in full on the day the job was complete. We were then told Garry was telling others we did not pay is the reason he's not responding to issues. Garry also told us he guarantees his work and to go over it and give him any concerns. When doing that it took him several days to weeks to respond and then he was rude and argumentative about fixing the concerns. Even though when Garry did come to initially look at some of the issues, he made agreeing remarks to the poor craftmanship that his employee used, but now is not standing behind his guarantee. What he did finally repair, was a quick, poor fix that will not last. During construction we asked that he use our ***'s account. He did a couple times then switched to his *** account. He informed us on several occasions that since he used ***, we will have a rebate on the materials. We have asked him for the rebate several times and he is avoiding to turn that over to us. At one point he told us that *** puts it in his construction account first. When calling ***, they informed us that is not true. Garry has also informed us that employee no longer works for him which leads us to believe our issues weren't the only ones. However, Garry is still responsible for who he hires and allows to do the work. Unfortunately, we made the mistake of trusting his word and did not get much in writing and paying in full - lesson learned. We are hoping he will stand behind his word, come to an agreement and be able to settle this problem that has lasted several months longer than it should have.

I am responding to a complaint about my business, case number ***.

I was hired to build a partial deck on one side of ***'s pool. After we finished the initial job the homeowners were please and wanted to know if we could deck the entire backyard around the pool and install a fence around the pool.

Response 1) I did not at any time turn the job over to another man and a “couple of kids.” I had 2 or 3 adults there at a time along with myself and my 16 year old grandson that helps with many of my projects.

Response 2) I was at the job site every single day, all day with the exception of one afternoon when I left for a few hours and left my work partner in charge, who is a qualified builder and has been in the profession for many years.

Response 3) During the construction of this massive deck there were materials left daily and stacked neatly in the backyard. We swept and used the leaf b***r to blow off any dirt, dust, etc on the deck. Everything was tidy and picked up each day before we left. There was one day that the 2nd time I came back to do some repairs we left a few boards on the ***r deck in the back but I text both homeowners and let them know (*** and ***) saying I apologize, that I forgot to pick up the boards and they said “no problem we will get it.” And I thanked them. I don’t have any idea what she is saying about food on the roof as none of my crew threw anything on the roof.

Response 4) The reason the job was $2800 over quote is because they added an entire lower part of the deck which added more materials and more labor. That is where the $2800 came into play and they were aware of this as we had talked about it before we ever started on the lower deck.

Response 5) I don’t know what she is saying when she says “I was going around telling people that she was not going to pay and why I was not responding to issues.” Which makes no sense to me.

Response 6) I do guarantee my work and I did say I would go over any issues with my workmanship if there was anything. The first time she text me about a concern on the deck it took me 2 days to get back to her because I am as busy as most contractors are at this time. When I did, I asked her by text what the concerns were and I was not argumentative. I did make an appointment and went over to look at her concerns.

1. They had found one screw missing on the back side of a fence picket. I screwed this in, which only took a second.

2. There was one lower deck board underneath the outside water spicket that we did not screw down because we thought we might have to take it back up to re-route the water spicket. We decided to fix the spicket from the inside of the house. So, yes, I forgot to screw the deck board down after that decision. But when I came back the first time I screwed it down.

3. There were a couple of other deck boards where 6 screws were missing. I also took care of this on my first visit.

Response 7) On this response I do have before and after photos I can send to you if needed. On the upper deck that wraps around the pool when we took off the old deck boards many of the joist boards were rotten. At that moment I told *** and *** who were standing there that we should replace the whole thing which would be approximately a 22’ x 4’ section. They asked if it would cost them more money, and I said yes, it would cost more for materials and labor. They said they did not want to spend any more money. I told them I would repair what I could but expressed to them that it would only be a band-aide over the problem.

Response 8) The first time I met *** at ***’s to use her account to order materials as she wanted to do it that way. I said ok and that is what we did. I did use her account a couple of times. I wasn’t aware that she even had a ***’s card for me to use if I had known that prior I would have stayed at ***’s. The reason I had to switch to ***’s is because I have a credit card account there and I couldn't wait for her to get home to go to ***'s as it would have wasted the whole day.

Response 9) I told *** if I went to *** and hand-picked the materials out which can take hours, and load and deliver it that they can either pay the delivery charge OR I will just keep the rebate. I don’t have a construction account at ***. I have a credit card.

Response 10) I did not inform her at any time of my employees working with me or not working with me as a partnership. We both own separate business's and work together when it works for both of us. I am always responsible for anything my crew does and if there is an issue I always try to make it right.

Response 11) She called me back a second time regarding some deck boards that were shrinking. I replaced the ones I could with the materials I had left and there was a couple of boards that had splintered through no fault of mine, so I flipped the boards over and they were fine with that. Let me explain about the shrinking of the boards. Since the pandemic has been going on people are staying home more and doing building projects. The manufacturers of treated materials are shipping them out faster than they can let the material cure before shrinking. This is of no fault of mine when a board shrinks after being installed. I can’t keep going back everytime a board shrinks. At some point the homeowner should be able to change out a deck board if needed because of this issue.

We have photos of all of the installation, the rotten boards and everything if that helps.

I have gone above and beyond to make this homeowner happy.

I have reviewed the response made by the business in reference to complaint ID, and have determined the response would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

We are not surprised that this business is not willing to work towards a resolution after the service we received towards the end of the project. The response of the business is full of dishonesty. Things that he agreed to during our conversations, have now changed once being brought to public attention.

1/2. The job was most definitely turned over to one adult and a couple kids The kids were probably 12 and 16, again not who we hired. Garry informed us that he had two adult helpers but one of the original guys he wanted to assist could not handle the work so he let him go. This was in the first section of deck. Garry was very rarely there unless we called him to come look at something and this is a fact. If he was always there, why was he shocked at the issues we brought up to him and appalled at the mistakes. We do believe if he was there, as I said, things would have turned out differently. I even brought this up to him at one point when showing him the mistakes. He agreed, shook his head and stated this is what happens when he was busy and trying to grow his business, acknowledging that he was absent from the job site. However, you still have to be responsible for the work done.

3. Materials were stacked in yard. The complaint was on trash, nails, screws and food being left all over the deck, roof and yard We picked up at least 10-12 screws each night. Saw dust was never swept up. The day he is referring to that he left boards and texted us later is true, but that was at the end of the project and it was one time that he asked about leaving trash during five months of work.Every other day, trash was left. One time does not make up for all the trash during the entire project. He may have no idea about food on the roof because again, he was not there.

4. The initial quote included the lower deck and that quote was $2800 less. We even asked him on the day we paid him, why the $2800 increase that we were not informed of previously and he just stated he can't help the cost of materials and what he needs. Even stated that he felt bad it was higher but he can't help it. It is a complete lie that it was due to us adding more work. All the deck was priced out, nothing added later that was not figured in. If it was due to an addition on the deck, why was that not questioned then.......because not the truth. We also asked him this night about the rebate and he stated he forgot it but would bring it back to us.

5. He knows exactly what I am talking about with going and telling others that we did not pay him. I confronted him about it in person and he denied it. We have a mutual acquaintance that he was telling we did not pay him in full, which is a complete lie. As stated previously, he was paid more than the quote and unfortunately paid in full the day the job was done. Our biggest mistake.

6. Took him well over 2 days any time we contacted him with concerns. He was very argumentative, rude and condescending towards people we had received other opinions. The fence picket that he is referring to was cut and installed incorrectly, still not corrected. There were several deck boards not screwed down, a couple raised areas that are a trip hazard and several boards not installed properly. As far as rotten boards that we did not want to spend money on replacing, also not true. He informed us of some rotten deck boards but stated the frame was solid. Stated he could reuse the frame but not the boards. We agreed to reusing the frame but replace the deck boards and that is what he did. Once complete the deck in that area looks like a roller coaster and is not secured correctly. He then states it was because the old deck was installed incorrectly and nothing he can do about it, after he informed us the frame was solid and would be fine.

8. ***s card, he was very well aware I had a ***s card in his name, he carried it until the project was done. He told us ***s ran out of boards so he had to go to *** but not to worry because at least we would have a few rebates to use. Of course that story is changing now. After promising the rebates several times, he then told us that *** put the rebate on his business account but he would get it to us. He lied about the rebates numerous times. Now has another new story saying the rebate was in exchange for him paying the delivery fee, we paid the delivery fee!! We feel like we were taken advantage of with the lies on the rebates and extra charges. Funny he now says he spent hours picking out materials because when I complained about the deck boards he stated he could not help what boards they gave him.

9. Boards should not curl, shrink and be defective within a few weeks of install if done properly. Again we only asked him to stand behind his work as he promised. We realize he does not feel he should have to do that and this is why we asked for a partial refund to repair what he refuses and to take care of the rebate that was promised to us on several occasions. We also realize that this is basically a site to vent and will probably get no where. We just can't understand or believe that someone who claimed to be so honest, trustworthy and stated would stand behind his work could be so dishonest. Unfortunately it is one word against another with no resolution and we will just have to consider it a hard lesson learned. We are not the type to criticize someone on social media but we will be sure to not recommend this business.
