customer took the vehicle to a different shop than where it was purchased. The shop replaced the transmission, under the requirement from the warranty company that they produce a document in writing stating that the transmission was to have a 12 month, 12,000 mile warranty of the part. The vehicle later started having the same issues with the transmission, and the shop that had done the transmission replacement did not honor the 12 month warranty. The customer has gotten Gary Higginbotham Auto Sales involved in an attempt to resolve the issue, and they have spoken at length to the shop where the work was done in an attempt to get them to honor the warranty, but they are unable to intervene further. As this is a warranty issue for work that was done elsewhere, they are not able to provide any relief to the customer. Revdex.com:
This doesn't resolve any of the problem. My main problem is the fact that this car was sold to me being a lemon. Even when I spoke to an employee he apologized bc he knew the car wasn't a good car. The inspection sticker isn't even filled out properly and there isn't a motor mount.
I have reviewed the offer and/or response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your . reference, details of the offer I reviewed appear below.

Review: Yesterday evening I put down a $500 deposit to hold a car the next morning I called and said I did not want the car I was told I could not get my $500 deposit back I have a receipt and nothing in writing stating that my deposit is non-refundable when I called the dealership to let them know that I was not getting the vehicle he told me I was not getting my money back and he basically hung up in my face and would not answer my returning calls.Desired Settlement: My desired outcome is just simply to return my $500 deposit.

To Whom It Concerns

Review: I purchased a used vehicle from this company and have proof that it was sold to be as an unsafe vehicle for me to drive. I haven't had the vehicle even a year yet and its had to be repaired 4 times already. The vehicle has no lower motor mount and the inspection sticker isn't filled out. Now that the transmission is broken again, I've asked for them to take the vehicle back and trade in for a better vehicle. They will not let me trade this vehicle in if it's not fixed. I feel this company should have done more to help me with this since they were the ones that sold it to me in the first place. I no longer want to be in a vehicle that is unsafe for me to drive. Now I have no vehicle because it is broken and I'm still having to make payments on it.Desired Settlement: I would like for this company to take this vehicle back and cancel my loan and refund me the money I have already paid on this vehicle. I no longer want to do business with them.
