To reiterate, Dr. Litman refused to see me unless I received a referral and paid the full amount for another eye exam. When I spoke to him, he was rude and condescending on the telephone. Dr.Litman that told me that I had to keep the lenses because they were specifically prescribed for my eyes, that I could not exchange them. Furthermore, Dr. Litman did not give me a trial pair of contact lenses to make sure the different lenses that he prescribed, without my permission, were a good fit for me. In my previous response, I provided picture evidence that ***'s B*** and A*** are not the same contact lenses. The product number for the B*** contact lenses is *** and the product number for the A*** contact lenses is ***. Clearly, I understand what private labels means and these are not the same product. In addition, Dr. Litman and his staff were more self-interested in the rebate that the office would receive for my purchase of the A*** contact lenses. The contact lenses were purchased at Dr. Litman's office so the refund must come from Dr. Litman's office. Fact, I clearly emphasized to Dr. Litman and his staff to order theB*** contact lensesIn the end, Dr. Litman prescribed a different band of contact lenses, A***, without my permission

August 1, 2014*** *** called on June 3, and told my staff that his eyes were red because he was not fit with *** B*** Toric lensesHe was told that the A*** Toric lenses that he received were identical to the B*** Toric lenses and that the contact
lenses did not cause his red eyesIf was recommended that he be evaluated for his red eyes but he refusedTried to call him several times and on June 12, 2014, I spoke to him and informed him that the A***s Toric lenses were identical to the B*** Toric lensesI also informed him that the contact lenses did not cause his red eyesI asked him to return the pair of lenses he hod been wearing so I could have them evaluated by the contact lens manufacturerHe also refused to do this, I believe other factors contributed to his red eyesA*** Toric lens is a private label lens that is made for the *** *** franchise doctorsAttached is a response from Ron D***, Director, Corporate AccountsAlso, attached is c highlighted product reference guide shot clearly shows that B*** Toric and A*** Toric lenses are identical.Sincerely,Gary SLitman, O.D

On 08-15-14, you sent me a message that the case was closed. The patient's most recent concerns are the same concerns as his initial complaint on July 12, 2014 I addressed all his concerns in my response on August 1, 2014.
To reiterate, I recommended he be evaluated for his red eyes and he declined and I recommended that he bring me the lenses that he claimed made his eyes red and he declined. In my response, I provided from the manufacturer [redacted] in that B[redacted] and A[redacted] contact lenses are the same. The patient appears to not understand what private label means. It means that B[redacted] toric lenses, manufactured by [redacted] and A[redacted] toric lenses manufactured under a private label by [redacted] for [redacted] doctors are the same lens. If the patient has concerns, I roommend that he contact [redacted].Facts
Contact lenses were ordered on 03-26-14; patient did not call with any complaints until June 3, 2014. I did not dispense a trial pair of contact lenses because the patient was ready wearing B[redacted] lenses which are the same as A[redacted] toric lenses.
