understand your disappointment that the listed apartments on our website were
not up to date. I understand that when
it was brought to the manager’s attention it was changed immediately. I’m
glad that we were able to tell you what the
correct price was while you were on the phone so you didn’t have to waste any
more of your time. It is unfortunate
that the website wasn’t updated at that moment when you were viewing. I do want to ensure to you that we were not
intending to “Bait and Switch” it was just a matter of the website not updated
in a timely basis. I also
would like to explain to you the difference in the base rent and the total
rent. There is a charge for the water
utility. If the apartment that a tenant
rents has its own water meter than the tenant would be responsible for paying
GCWW directly. If it doesn’t have it’s
own meter the tenant is responsible to pay us a fee for the water. This is a fee like a pet fee or parking
fee. These fees are added on to the base
rent. These are all explained before scheduling an appointment
(as we did to you), accepting a security deposit and signing a lease. This is common practice in the real estate
business and is understood by most renters.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.Gaslight Properties stated that "it is common practice" in the real estate industry to advertise one price, but change that price to a higher price verbally, adding fees for water,trash etc. that will be paid to the landlord as part of the rent payment after getting the prospective tenant on the phone. In the case of this unit, the price per month advertised online is $495. The actual price that will be paid by the tenant is $525.I have quoted below the applicable federal law, which states that advertisements for leases must include all one time and recurring payments. (See Item 4) below.)  It also seems rather obvious why the advertised price should be the price that is actually charged.  Having completed a thorough survey of available properties, particularly in the Clifton area, I can tell that it is NOT. common practice to verbally disclose additional fees that will be paid directly to the landlord after advertising a lower price online.  The reason this is not common practice is probably because it is illegal.A similar, but different scenario would be where the ad states that "tenant is responsible for utilities" in cases where those utilities would be paid to the utility company.  There is another company in Clifton that has a $69 trash/recycling/water/sewer fee, which is disclosed in their advertisements, not added verbally later on.In this case, not only were additional fees added verbally, but an entirely different price was advertised for the unit.  I was told on the phone that the original price was for a different unit in the building. Now the company is stating that the initial lower price, which included heat and all utilities was an "error" that they are pleased to have been able to correct. It is not my job to verify the accuracy of Gaslight Properties advertisements. Surely this responsibility should be handled by someone at Gaslight Properties.Needed to resolve the complaint:1) Change advertised prices to match those that are being charged2) Identify who at Gaslight Properties will be responsible for ensuring that future listings will not contain errors that need to be caught and corrected by me.  I feel that I will have to take on this responsibility for now, and continue to report discrepancies to the Revdex.com and to person at Gaslight who will be handling this new responsibility.

(a) In
general
If an
advertisement for a consumer lease includes a statement of the amount of any
payment or a statement that any or no initial payment is required, the
advertisement shall clearly and conspicuously state, as applicable—
(1) the transaction advertised is a lease;
(2) the total amount of any initial payments required on or before
consummation of the lease or delivery of the property, whichever is later;
(3) that a security deposit is required;
(4) the number, amount, and timing of scheduled payments; and
(5) with respect to a lease in which the liability of the consumer
at the end of the lease term is based on the anticipated residual value of the
property, that an extra charge may be imposed at the end of the lease term.
