The aforementioned business promised a thorough clean up of debris utilizing a wood chipper near my residence but have failed to do so as promised.On March XX XXXX my family entered into a contract with Gatorwood Inc. To log a portion of the family farm. The timber buyer [redacted] stated that a wood chipper would be used to clean the portion of logged timber which is beside my residence. After failing to complete the promised work I contacted him and a meeting was held with an additional employee of Gatorwood who stated that he would have someone to come in with a bulldozer to clean the area in a couple of months. Additional contact with [redacted] concerning this matter has yielded negative and argumentative results.Simply stated this company has failed to comply with the promises which were made at the time of contract by the timber buyer [redacted] who has become a straight up [redacted].AIf a man is only as good as his word....he simply ain't [redacted]. Property owners beware.I wish to have no further contact with [redacted] as no positive results will be accomplished but will gladly speak to another representative of Gatorwood Incorporated concerning resolution.Additionally...failure to complete will result in civil action as I have already contacted the Lenoir County Clerks office.Desired SettlementTo complete the promised work.Representatives of the company had stated to give them a month to complete the work.I have given them that. I have tried to be tolerable of a bad situation. I was told initially that the left behind wood would be chipped and made to look pretty. I was then told they were not going to do that. I was then told a bulldozer would be sent to clean up the area. That has not happened. Additionally I was asked to find someone locally to give an estimate on cleaning up the area. This person was told that his price was too high for [redacted] to approve aND that approval would have to come from a superior company member. I have been totally jerked around by this company and wish that another company would have completed the removal of timber from this property.Without the help of a reasonable representative of this company I will be forced into yet another time wasting interaction of civil court. Your help is needed and greatly appreciated.Business Response /[redacted]/I visited the landowner to view his complaint earlier this summer with our buyer [redacted] was very cordial. Upon my inspection, the logging job looked great, and I could see our crew had made special care to clean the areas adjoining his yard allowing him to extend his yard as he had asked. They also made special care to haul off a tree that [redacted] had previously cut and was on the edge of [redacted]'s yard. Our crew removed it from the edge of his yard. My understanding of his complaint that day was that we had not chipped a large pile of debris on the edge of his yard and the timber harvest area that had been dumped on an old barn site. At the time of the contract, our buyer told [redacted] we would take care to cut the area adjoining his yard with care removing as much of the debris as possible. What we did not know at the time, was that [redacted] had dumped a large amount of tree debris and stumps from a tree job (from another piece of property) some years earlier. There was no way of seeing it as it had grown over with dense vegetation. It had nothing to do with the harvest job and was not part of the contract as we are never responsible for trash and debris dumped in the woods by third parties. Again our buyer, [redacted] had no idea the foreign debris pile was there, [redacted] was referring to the debris on the edge of his yard that was currently growing there as part of the tract of timber. We are remiss that there was a misunderstanding between [redacted] and our company. And we hope we have satisfied his complaint. This site has been clean cut by our company and is ready for reforestation as stated in the contract. It was not part of our contract or has it ever been customary for us to be responsible for debris dumped on our clients land by third parties. However, s a gesture of good faith, I told [redacted] we would hire a bulldozer contractor to come and do his best to push the pile of debris from his other land and smooth it out as to make it more esthetically pleasing. I informed him that it may be a month or more, at which time he told me no problem, as long as it got done in the next few months. He also stated that he knew it was not part of our contract and that we did not contractually have to do anything and seemed very happy at our promise to hire a bulldozer to help him get it smoothed out, solely at our expense. We left, I thought, on good terms, as we were doing multiple things for him that were not part of our contract and were doing so at our additional cost solely because it is our practice to leave all our landowners on good terms. It has taken till now to get a bulldozer crew there; due to weather, break downs, as well as my understanding that as long as it was done this summer Mr. [redacted] would be happy. We have made two seperate attempts to smooth out this pile and in doing so we have found metal, barn pieces and concrete in it as well as the truckloads of large tree debris. We hope Mr [redacted] is happy with this extra work. It is my feeling that we have gone above and beyond, at our expense and time, to do things that were and are not part of the timber contract. The site was logged using all Best Management Practices and is ready to replant, as per our contract. We hope the additional work from our logging crew (out side of our contract) and the additional work from the bulldozer crew (also outside of our contract) is more than sufficient to make our client happy. I am extremely proud of the logging job. It was done professionally and with the up-most care, and wish [redacted] nothing but the best in the future. First...I have only been living at the aforementioned address for about a year now. I have not dumped any brick, tires or metal objects on the property. It is present but was not dumped by myself. This same debris was present on the day that your buyer made the statement( in front of myself and two additional witnesses) that this area would be chipped and made pretty. No additional debris was added, excluding debris from your logging company, since the date of his statement.He was WELL AWARE of the contents on the property. I am well aware of the contractual components of the contract but was told, and believed, that this additional work would be done simply because I was told that it would be. Additionally the bulldozer which was sent to the property, for a agreed upon resolution, did not complete the work that you had described and promised.No debris has been pushed to the existing woods as was promised. From your note to the Revdex.com it is assumed that you and your company are wiping your hands of this matter even though this matter has not been reconciled and resolved to the description that you and your employee have described leaving me the property owner with the costs associated with the promised work.As I have told your buyer , Mr.[redacted] I will have no additional contact with him as my patience with him has expired. Quite frankly none of this would have happened without [redacted] unsolicited untruths and promises made at the time of contract to myself, my Aunt and [redacted] of Kinston. I do agree that most of the area that your company logged was left in a satisfactory condition but the property adjacent to my residence could never be classified as professionally logged. Truthfully, [redacted]
