Review: I have paid in full for 35 lounge chairs and 67 headboards - 50% deposit at start of work 3/* check#[redacted] amt $22,201.25. May [redacted] from GBC requested the final payment: "The Project is in its last stages before shipping out. Payment is due 4 to 5 days prior to shipping delivery. Please remit payment at your earliest convenience so there is no delays to your project." May [redacted] sent the following e-mail "Yes we received the check on Friday...I am finalizing all of the specifics of this delivery with my trucking company." GCB cashed check#[redacted] amt $21,856.25 on May [redacted].May [redacted] e-mailed "I am afraid I have to cancel Tuesdays 5/** pickup from GBC As we were boxing up the pieces we realized that boxes been destroyed in a recent flood. Replacement cant be delivered until Tuesday." May [redacted]June [redacted], after 11 days and many e-mails from me requesting updates, I received this e-mail from [redacted]: "A few of the pieces did get damaged as well,..We have already sent purchase orders for fabric for both chairs and headboards that we will need to replace."June *, I requested that [redacted], the owner of GBC and person I had made the contract with, call me. He has never called me. I requested again on 6/** that he call me to discuss the situation and he has not called. June [redacted] sent this e-mail: "25 chairs/38 headboards have water damage. Some minor, but fabric needs to be replaced. Fabric has been ordered for both the chairs and headboards. Chair fabric has already arrived and being cut now. The new boxes are due in by Tuesday." 6/**June ** I requested that GBC refund the $21856.25 and request the funds when the furniture was ready to ship as per the contract. He has never acknowledged this e-mail.June [redacted] I sent an e-mail that asked 1) the est. date of fabric, 2) 2nd request to address the 22K that GBC has had for 30 days, 3) 2nd request for pictures of damaged goods.GBC has $44,057.50 from Cardinal Hotel and we have nothing. This is a breach of contract. Communication from GBC has been evasive, not forthcoming, stalled.Desired Settlement: The final payment of $21856.25 refunded until the order is ready to shipTo see pictures of all of the damaged furniture[redacted] to call me and respond directly to my questions.They have $44,057 and we have nothing. I would like that addressed and rectified. I am responsible for this money and I feel unsure that GBC is telling the full and true story of why there is such a delay in the furniture being delivered. My owners are concerned about the legitimacy of this company.

I sent you an email 2 weeks ago (you never responded back to me); [redacted] sent you an email I believe this past week. You have yet to approve the cost for boxing/trucking regardless when the balance is paid, we still need the approval. A final shipping date can not be set without your approval. Your email for the past 2 weeks has said you are away. I never heard back from you myself except for this email. This is about resolving and getting you your product.

Please confirm the cost as have been previously sent and we can get a trucking/shipping date finalized.

I find it a shame at this point you feel your recourse is besmirching my company name. I hope that you stop and work with me to resolve this. We have paper trails as well, but find that this type of relationship does not do anyone any good.

You are my client and I want you to be happy. So please work with us as it is a team effort and we all want this resolved.

At this time, I have been contacted directly by GBC Upholstery Inc regarding complaint ID [redacted], however my complaint has NOT been resolved because:

[Your Answer Here] There was a mediated conference call on Tuesday July [redacted]. In this call it was agreed that GBC would provide 3 items: 1) insurance claim form 2) 2 invoices from CF Stinson to prove purchase of fabric and amounts 3) photographs of all of Cardinal Hotel's 102 pieces of furniture.

They provided:

1) an acknowledgement of a claim. The form was redacted and name of insurance company and contact number was obscured. It was impossible to use this form to verify that an insurance claim was filed for the 62 pieces of furniture that GBC told me was damaged.

Re: this form the date of the acknowledgement of claim was May**. This is just 1 day before GBC contacted the Cardinal Hotel and required the final payment of $20,000 which was required 4 days before shipping the furniture.

May [redacted] of GBC contacts Cardinal Hotel and requests final payment. The contract states that final payment is to be paid 4 days before furniture is shipped. This claim form implies that GBC was fully aware that they were not going to be shipping the furniture in 4 days but still demanded final payment from the Cardinal Hotel. At this point it is clear that GBC was lying to their client, The Cardinal Hotel, about the status of the hotel's furniture.

May [redacted] sent an updated invoice and wants the hotel to confirm that payment will be sent out on the [redacted] or May [redacted] at the latest. In good faith the hotel sent the check (fedex overnight so as not to delay shipping)
