presented under our insured's Motor Truck Cargo Insurance PolicyWe were contacted via telephone by *** *** *** on October 14, and advised that Mr***'s Toyota Camry sustained damage to its hood, bumper and headlight during transport from Florida to ConnecticutMr*** forwarded photographs of his vehicle reportedly just prior to transport, and immediately after transport along with the bill of lading for the transportAfter receiving notice of the claim, we attempted to reach our insured, and requested information and documentation required to confirm coverage for this loss under their Motor Truck Cargo PolicyWe requested the identity of the driver and the power unit involved in the transport of the cargo, as the driver and the power unit must be listed on the policy in order for coverage to applyWhile awaiting the information from our insured, we assigned an appraiser to inspect Mr***'s vehicle and to write an estimate for the repairs of the damage being claimedThe TTA Appraiser completed a repair estimate in the amount of $1,Despite our efforts both verbally and in writing to obtain the information required to confirm coverage, our insured failed to cooperate with our investigation, and provided no response to our requestsAs our insured failed to comply with the conditions of their policy by failing to provide us notice of the loss, by failing to provide proof of loss, and by failing to cooperate with our investigation which prevented us from confirming coverage, we issued a Reservation of Rights letter to our insured and planned to follow with a coverage denialAlthough coverage under our insured's Motor Truck Cargo Policy does not apply to this claim, as a gesture of good will and irrespective of the fact that the Insured continues not to cooperate, we will issue payment for the loss in the amount of the TTA Appraiser's estimate of $1,less the policy deductible of $1,000.00, which equates to a payment of $It will be Mr***'s responsibility to collect payment of the $1,policy deductible directly from our insured should he choose to pursue itPlease feel free to call me should you have any questions or require any additional informationVery truly-yours;
