[redacted] , the individual who wrote this complaint, was notified that all merchandise sold by GBY is on a "As is, Where is" basisMr [redacted] , on his own will and volition, ordered two additional loads from us at reduced prices in lieu of his first issue with Home Depot products. In several text messages I personally received from [redacted] , he indicated he would be defaming our company unless we refunded him for merchandise he knowingly bought in the condition of "As is, Where is"As he had already initiated defaming statements online before his text messages began, his sole intent of writing this and other complaints was to cause unneeded harm to our name and not actually discuss a product-related issue - because the product he received was fineMr [redacted] is misrepresenting the merchandise received; there's no other way to say thisNot one time had he sent us pictures of the load receivedIn fact, he waited days AFTER receiving his electronics load before he began calling and emailing his malaise for the productThis leads us to believe his complaint to the Revdex.com is completely fabricated, and lacks any formal evidence other than what he's put in his written claimsMoreover, I personally cannot "rip off" [redacted] because I sold the load to him based off a condition that was supplied to meMoreover, merchandise sold by GBY Liquidations comes from retailers that sell them to liquidators like GBY as salvage, customer returns, and in some cases overstock and newThe electronics load was shipped directly from a Walmart distribution centerMr [redacted] chose to purchase the merchandise at pennies on the dollar knowing the condition of the goodsGiven this, and the fact Mr [redacted] knowingly and willingly chose to defame us rather than approach us within an amicable time frame of receiving his last load, he is not entitled to a refund nor will we honor further requests, threats and texts from him asking for such

This below response from the company is just not true First, I called, emailed and texted many times from the very day I received the product I did not wait over a month to contact the company, contacting the Revdex.com is basically my last option prior to seeking legal action Second, the email below and the invoice both refer to "electronics" I received no "electronics" at all The shipment was all cell phone cases from discontinued phones and screen protectors, which are not electronics I have included a copy of the invoice for reference The invoice reflects $560,in original retail value and if the sticker prices of everything I received is added up it would total well below $200, Third, I did not threaten or make inaccurate remarks about the company in any way Lastly, the company did try to present a resolution to the shipment by offering a discount on a 4th order This was the third order I have placed and the company is correct in saying they offered me a lower price to compensate for the low quality and mis-representations of the first two order.I do not wish to receive a discount on another order The invoice does state the shipment is accepted without return, however, I did not receive what I purchased I am clearly asking for a refund of the purchase price Complaint: [redacted] I am rejecting this response because: Regards, [redacted]

Again, the response is just not accurate? I did send photos upon receipt, which did not match the photos that were sent with the initial offering of this load? As far as inspection, the load was shipped direct from Walmart and I was never offered an inspection? After our first invoice, I asked if I can visit the warehouse and was told most of the shipments are direct from the supplier and therefore there was no need to visit Biloxi? The company and their representatives are trying to make this a personal attack claiming that I am a bad business person and had bad dealings with the owner in the past, which I have never done business prior to March with this company or any other liquidator? I have been courteous and professional in my dealings and that can be seen in the text messages and emails? I did give honest and professional reviews on several liquidator websites, which can be viewed online, which are factual and not defamatory in nature.I guess this can go back and forth forever but I have said what I need to sayFrom this point forward I think we will both be repeating ourselves unless the company makes up more allegations and claims? I am still asking for a refund of my purchase, but any solution needs to be in cash because I do not desire to purchase product from this company to make up for the issues.Isn't there an arbitration process that can be utilized to resolve this case fairly?? ? Complaint: [redacted] I am rejecting this response because: Regards, [redacted]

Mr*** is, in fact, misrepresenting the load he received and HAS sent text messages to me which I saved claiming it was in our best interest to refund him or he would defame us.Mr*** is, in fact, a customer we have tried countless times to appease, to no availHe's simply out for free merchandise and is STILL yet to produce any mitigating proof the load is as he received itWe confirmed with Walmart regarding what he got, which was NOT a full load of casesTherefore, we believe Mr*** has no other intention but to create written complaints that are completely baseless to obtain financial gainOn each load we sent, he had some complaint regarding the presentation and contentIf the individual was made happy twice in a row, but was made whole the remaining two times, I could understand his positionHowever, each load we sent him came with negative feedback despite our best efforts in explaining the process of buying wholesale merchandise with a "return/salvage" conditionOur disclaimer of condition is clearly visible when a customer buys, and is afforded the opportunity to passMr*** did not. Moreover, all customers are afforded the opportunity to request a physical inspectionMr*** did not.As we have tried to offer this man a merchandise discount on a 4th load, have weathered his veiled threats and excessive moral ambiguity regarding this load's content and presentation, we have exhausted what we feel are fair and equitable resolutions to his problemTherefore, we consider this case closed and will be honoring our "As is, Where is" policy which dictates no refunds are given once merchandise is accepted and delivered successfully to the customer

Mr. [redacted] is, in fact, misrepresenting the load he received and HAS sent text messages to me which I saved claiming it was in our best interest to refund him or he would defame us.
Mr. [redacted] is, in fact, a customer we have tried countless times to appease, to no avail. He's simply out for free merchandise and is STILL yet to produce any mitigating proof the load is as he received it. We confirmed with Walmart regarding what he got, which was NOT a full load of cases. Therefore, we believe Mr. [redacted] has no other intention but to create written complaints that are completely baseless to obtain financial gain. On each load we sent, he had some complaint regarding the presentation and content. If the individual was made happy twice in a row, but was made whole the remaining two times, I could understand his position. However, each load we sent him came with negative feedback despite our best efforts in explaining the process of buying wholesale merchandise with a "return/salvage" condition. Our disclaimer of condition is clearly visible when a customer buys, and is afforded the opportunity to pass. Mr. [redacted] did not.
Moreover, all customers are afforded the opportunity to request a physical inspection. Mr. [redacted] did not.
As we have tried to offer this man a merchandise discount on a 4th load, have weathered his veiled threats and excessive moral ambiguity regarding this load's content and presentation, we have exhausted what we feel are fair and equitable resolutions to his problem. Therefore, we consider this case closed and will be honoring our "As is, Where is" policy which dictates no refunds are given once merchandise is accepted and delivered successfully to the customer.

Again, the response is just not accurate.  I did send photos upon receipt, which did not match the photos that were sent with the initial offering of this load.  As far as inspection, the load was shipped direct from Walmart and I was never offered an inspection.  After our first invoice, I asked if I can visit the warehouse and was told most of the shipments are direct from the supplier and therefore there was no need to visit Biloxi.  The company and their representatives are trying to make this a personal attack claiming that I am a bad business person and had bad dealings with the owner in the past, which I have never done business prior to March 2016 with this company or any other liquidator.  I have been courteous and professional in my dealings and that can be seen in the text messages and emails.  I did give honest and professional reviews on several liquidator websites, which can be viewed online, which are factual and not defamatory in nature.I guess this can go back and forth forever but I have said what I need to say. From this point forward I think we will both be repeating ourselves unless the company makes up more allegations and false claims.  I am still asking for a refund of my purchase, but any solution needs to be in cash because I do not desire to purchase product from this company to make up for the issues.Isn't there an arbitration process that can be utilized to resolve this case fairly?

products. In several text messages I personally received from [redacted], he indicated he would be defaming our company unless we refunded him for merchandise he knowingly bought in the condition of "As is, Where is". As he had already initiated defaming statements online before his text messages began, his sole intent of writing this and other complaints was to cause unneeded harm to our name and not actually discuss a product-related issue - because the product he received was fine.
Mr. [redacted] is misrepresenting the merchandise received; there's no other way to say this. Not one time had he sent us pictures of the load received. In fact, he waited 47 days AFTER receiving his electronics load before he began calling and emailing his malaise for the product. This leads us to believe his complaint to the Revdex.com is completely fabricated, and lacks any formal evidence other than what he's put in his written claims. Moreover, I personally cannot "rip off" [redacted] because I sold the load to him based off a condition that was supplied to me.
Moreover, merchandise sold by GBY Liquidations comes from retailers that sell them to liquidators like GBY as salvage, customer returns, and in some cases overstock and new. The electronics load was shipped directly from a Walmart distribution center. Mr. [redacted] chose to purchase the merchandise at pennies on the dollar knowing the condition of the goods. Given this, and the fact Mr. [redacted] knowingly and willingly chose to defame us rather than approach us within an amicable time frame of receiving his last load, he is not entitled to a refund nor will we honor further requests, threats and texts from him asking for such.
