I am writing to express my dissatisfaction with my builder [redacted] located on [redacted], Massachusetts. I live at [redacted] Massachusetts. I am one homeowner in [redacted] of [redacted], the only completed phase of a [redacted] Phase development. When I purchased my home on 3/19/10, the adjacent buildable lots were in a natural state. Since such time, one lot has been the recipient of commercial dumping, collecting large amounts of materials, such as logs, sand, gravel, piping, metal, machines, trash, plastic, wood chips and a toilet to name just a few of the items. **. [redacted] has been approached by the homeowners who have requested his presence at a meeting to discuss the removal of this debris, informing him that the sale of the home of an elderly person directly in front of the debris was hindered on multiple occasions due to the unsightly piles. Correspondence, in writing, has gone on for 10 months, including two written commitments from the builder specifying dates he would remove the debris and level the sand piles. [redacted] failed to meet those commitments. The homeowners contacted the town building commissioner, the Board of Health, the local paper, the EPA, the Conservation Committee, and the local police. A septic hole was subsequently filled as requested by the homeowners, a commitment was made by the builder to provide signage (which has not been fulfilled) and on 3/19/12, [redacted] began removing the debris off one of the adjacent properties only to put the sand piles directly behind my immediate backyard, to height that far surpasses my six foot vinyl stockade fence. [redacted] has failed to respond to my requests for a face to face meeting and prior to relocating the piles of sand from one backyard to my backyard, [redacted] had his secretary call me and state “I have some good news and some bad news, we are going to clean-up the junk on the property on Monday, I can’t believe they left a toilet on the property, but they will be moving the piles of dirt directly behind your home.”

I believe [redacted] actions to be unethical and borders on harassment. I have retained counsel and informed my State Representative. One year and one month after I owned my brand new home, I had a substantial foundation crack that was allowing water to seep into my basement. [redacted] was contacted numerous times to look at the situation in my basement and failed to return any of my phone calls. It is important to note that this foundation crack was previously cited in my Homeowners’ Inspection report and provided to [redacted] prior to my closing as a potential problem.
