Mr, [redacted] purchased a home with Gehan Homes located at [redacted] on 03/16/2015. The Sales Agreement Mr. [redacted] executed is subject to a Contingent Sale Exhibit which provides certain requirements for the sale of his current residence located at [redacted] ***... [redacted] ***. He was pre-approved by Brookhollow Mortgage, Gehan Homes' preferred lender, for a total purchase price up to $340,000. At the time of contract, Mr, [redacted] had analyzed the financial impact of his home purchase and was comfortable with staying at or under that budget of $340,000 after all option selections and discounts were applied. When he completed his design appointment on 04/02/2015, Mr. [redacted] signed off and acknowledged a final purchase price of $360,817, which is greater than his $340,000 budget. He complied with all contractual requirements including providing a deposit check for all of his design selections. Additionally, he even filled out a survey giving the designers and his sales person the highest praises allotted on the survey. It was Gehan Homes' belief and understanding at this time that Mr. [redacted] fully intended move forward with the purchase at the higher purchase price. Several options are available to Mr. [redacted] that would allow him to proceed with a purchase in excess of his budgeted amount. Mr. [redacted] provided no indication at this point that he was uncomfortable with the higher purchase price that was the result of Mr. [redacted] 's own option selections. When Gehan Homes made a routine inquiry regarding his purchase price, Mr. [redacted] stated to the on-site sales person that he felt as if he was "getting in over his head". In light of this information and in an effort to help Mr. [redacted] , Gehan Homes offered him the opportunity to return to the design studio and scale down the design selections on his home, bringing the purchase price back in line with the $340,000 amount for which he was qualified as there were several selections made that would have no material effect on the function or appearance of his home, These excess selections would be reasonable items to remove to move his purchase price back under $340,000. Mr. [redacted] refused to entertain the revision, and stated that he wanted to cancel the sales Agreement, Mr. [redacted] was reminded that his agreement was contingent only upon the successful sale and close of his home located at [redacted] and not on an over selection of options at the design center. Cancelling his Sales Agreement at this point and for this reason is a breach of the agreement which would result in a forfeiture of deposits, In addition, [redacted] ***, Gehan Homes' Sales Manager, had a conversation with Mr. [redacted] regarding Mr. [redacted] 's intent to sell his current home. Mr. [redacted] stated that he was going to take the home off the market, and was not continue the sale of the Gehan Home. This also is a breach of the Contingency Provision contained in the agreement. Again, this breach provides for the retention of any and all deposits by Gehan Homes resulting from Mr. [redacted] 's refusal to attempt to sell his current house. The Contingent Sale Provision Privilege addendum included in Mr. [redacted] 's contract expressly states that: "At all times, Purchaser shall diligently market and attempt to sell the Residence." Gehan Homes made several attempts made to work with Mr. [redacted] and accommodate his home purchase needs. Mr. [redacted] was advised of his requirements under the Sales Agreement he executed and was advised of the ramifications of his actions. He chose to cancel the agreement in spite of this information and Gehan Homes complied the terms and conditions contained in the Sales Agreement.
