I have included all documentation concerning this tenantShe was breaking a leas and asked us to expedite tenancy so she would not have to pay rent for the balance of the leaseWe completed all tasks to rerent the property and did the appropriate walk through with herShe had a sub lease that was agreed upon by the owner which caused a lot of damage and lack of property maintenanceThe amount she is questioning is for labor of maintaining the yard and salt for a softwater system , air filters etcI have included the tenants history and a letter from the owner requesting me to maintain or at least help the tenant to maintain the property.We accomplished other cleanup in the interior without charge to the tenant and gave her receipts for the other minor items listed on her last statement and as you might notice she never mentions thisWe try very hard to please all our clients and tenantsI am sure you see this all the time.If I need any further information to clear this matter up please let me know

We have already mailed a deposit in full to this tenantShe left the property in great shapeShe left before the tenancy ended on March 31, and we mailed the deposit to her on April 5, We enjoyed her tenancy and would recomend her to any other management companyIt looks as if she expected her deposit emmediately which is not procedure but we sent it as soon as we completed all check ups on the property and were impressed as to the way she left the propertyFrank / Manager

Our company was hired by our client as a representative of the owner in as much as ALL leases per the area we work show ALL information as to the companies address and proper telephone numbers to respond to all our clients needsI have reviewed leases from many management companies and all do not
and will not divulge personal addresses and numbers of the clients we representMy client has requested that as a company we NEVER divulge there personal information as it is why we were hired to do our job to take care of ALL issues for the tenant and relay all messages and requests made by the tenantThe complaint made was answered by many emails and the tenant seems to think he has a right to the personal information of our client and it will not happen as per the respectful request of our client

As I stated in the original response, I represent the owner and I have included a letter given to me by her explaining her requests as to giving any of her personal information outEvery management company that I have seen as per leases do NOT give out there clients information , that is why we are hired as there representativeI have included the email conversation that we had and made it clear the owners wishes .I have done my job in relaying the owners wishes to the tenant and hope this resolves this issue. The events that occurred leading up to my complaint against *** and GEM State Property Management:I find it insulting and surprising that ***, the owner, who visited the home multiple times made any type of comment in regards to her property when her son, her, and the neighbors commented on the property being kept better than *** herself If she felt like it wasn’t being kept up, why did she not saying anything the multiple times she came to the home and walked around the property Additionally, neither she nor *** ever sent me a violation notice at ANY time during the time I lived in the homeThe traffic hazard she is referencing occurred AFTER I asked *** to have the property mowed and cleaned He even charged me for them Why all of a sudden did a traffic hazard occur after nearly three years of me living in the home and asked *** to have someone take over mowing the lawn? Why would she comment that I kept the inside of the home immaculate and not the outside? That doesn’t make senseShe didn’t like the idea that I didn’t want to hire a professional landscaper I didn’t have to I maintained the property in a reasonable manner UNTIL I began my move and agreed with *** to have his brother take care of the property She NEVER reported any complaint to me *** only told me about the complaint when I continued to complain to him about his violation of having people in my home when I wasn’t there I kept asking him if I could see the complaint He told me I would never see it because the owner is the only one who gets it If it was such an issue when the complaint was issued, why not bring it to my attention? Because by then, it was ***’s brother who was supposed to be caring for the property Obviously I was caring for the property very well prior to having him taking over the mowing and trimming She is just as much at fault for ***’s actions I am not disputing ***’s charges of the clean up to the riding arena I agreed to I am disputing his violations and the additional $he needs to refund me I am not disputing the fact that I ended my rental agreement with GEM State Property earlyI had requested an early termination of the agreement around the beginning of August ***, the owner of GEM State Property Management, agreed and even told me he could be my realtor (I was ending my agreement so that I could provide a better home/ living environment for my children)I declined his offer to be a realtor for me; more so because of the way he treated me throughout the duration of my rental agreement and I didn't trust himI sent him a written notice of the date I would end my rental agreement with him (September 30, 2015)I paid the entire month's rent for September. I am disputing his actions while I lived in the home His comments of “We accomplished other cleanup in the interiour without charge to the tenant and gave her reciepts for the other minor items listed on her last statement and as you might notice she never mentions this” are horribly insulting He had painters, carpenters, and other people in my home the last month I lived there I will explain these details; he should have been responsible for the cleanup He wasn’t I cleaned up the home His comment “I am sure you see this all the time” is dismissive and insulting Also, *** insisted I did not mention the “clean up” his wife had to do, I want to be sure all of the facts are detailed in my complaint. When I gave *** notice to vacate the home, he informed me that the owners wanted to paint the home and put in new carpet prior to a new tenant moving inI sent him two dates to work with so that I could be available and around the home when the painters and or carpenters were in the homeThe dates included after the weekend of September 11th and after September 20thOn the weekend of September 11th, while I was still moving out of my home, *** and the carpenter sales representative showed up at my home unannounced*** did not provide me with another time that the painters would be in my homeHe was vague and told me "next week"I told him the painters can begin with the taping and preparing of the walls after September 11th but no painting until after September 20th because I would still have personal property in the homeThe week of September 14th, the painters were in my home, I didn't know an exact date of when they would be thereMy daughter would return home from school and there would be people in our homeSeptember 19th, I went back to my home to move more of my personal belongings and I found painters in my home painting and all of my remaining personal property tossed in the garageThe painters told me *** told them to move everything out*** had moved my personal belongings out of my home without my consent and had people in my home without my knowledgeHe did not give me specific dates or times on their arrivalI agreed to allow the owners to paint and put in new carpet while I still lived there (albeit moving) with the understanding I would be provided with exact dates on when these people were to be in my homeI had paid for the entire month's rent for September and *** did not have my consent to remove my personal belongings from my home where I was still actively livingI found some of my property in the garbage along with my personal belongings laying in the grease in the garageI called *** and all he did was insult me and talk to me so rudelyI told him again, I should know when people are in my homeI not only have a year old daughter I had to be concerned about but my personal property was still in the homeHe told me he was going to have carpenters in my home at the end of the following week and I requested a dateHe told me he would let me know the dateHe never didI returned to my home a few days later only to find more people, the carpenters, in my home without my knowledgeWhen I asked the carpenters why were they in my home, they told me they contacted *** and told him their previous job was cancelled so they wanted to start early on this home's project*** never informed me of this or asked for my consentI contacted *** again with the same results as our first conversationThe painters and carpenters were using my personal garbage container to discard their plastic wrap and other itemsThey were removing my personal trash out of my garbage container and throwing their trash in itI had to use my neighbor's garbage container to dispose of my garbageI pay a monthly fee for my trash to be removed which included September*** was also charging me for a dumpster he had placed on the property because I agreed to allow the person he hired, his brother as it turns out, to clean up weeds, the barn, and mow the lawnHe told me it required a dumpsterThe dumpster he charged me for should have been removed right after this person completed the cleanup that I agreed toIt was not and he continued charging me by the day for the dumpster he placed on the property as well as all of the dumping of the dumpsterHe used the dumpster for additional maintenance the owner wanted him to do to the propertyI had no way of knowing what was really part of the cleanup I agreed to or the work the owner wanted done and neither did heHe was not there when his brother was there cleaning upI was and I would constantly remark to *** about the excessive days of the dumpster being thereAfter the carpenters completed their job, on the weekend of September 26th, I returned to my home and again found more people in my home*** never told me about themThey were there to replace old light fixtures for new onesI didn't contact *** again because I knew he would be as insultingNot only were there more people in my home without my consent but all of my cleaning I had done on the home was a mess againThe painters and or carpenters had left soda and coffee spills all over the counters, there was painting dust on all of the blinds, footprints in the bath tub, and toilets that did not get flushed. On September 30th, I met *** to complete the walk through on the propertyI didn't trust him so I had a friend with me as well as I recorded our entire conversation that occurred on that dayI had also informed him that when the painters he hired tossed my belongings out in the garage, they also tossed my belongings that were on the kitchen counter which included a set of keys to the shed that was on the property so I had no way of opening the shed to get my thingsHis painters lost my keys; he said he would send a locksmith out to remove the locks for meAfter the walk through, I asked him about the security depositHe told me he would have it to me in a weekHe would only charge me for the cleanup of the yard I agreed to and the dumpster (he told me he would subtract $for what the owner requested; I didn't agree to that). I did not receive my security deposit within the daysI followed the process provided through the Attorney General’s office On the evening of October 21st, marking the day rule, I emailed him requesting my security deposit to be returned with the itemized list of how any money out of the $2,deposit was spentHe replied that it was in the mailOn October 25th, I received the security depositThe check was dated October 22, 2015, the day after I had emailed him and a date beyond the day rule (it was not “in the mail” as he had stated to me)The check was for $out of the security deposit being returnedI emailed him the next day with the rebuttal of the expenses he charged me for and explained why he should be returning a minimum of $to meHe had charged me for the locksmith although it was his hired painters that lost my keys when they removed my personal belongings from my home without my consent*** told them to remove my thingsHe charged me for weed killer and weed and feed he had applied in May without my consent or knowledgeI had no idea he applied those things and he applied them without my consentHe charged me $for the cleanup of the property that included all the additional work the owner wanted done to trees that lined the propertyHe charged me for the dumpster that remained on the property for over a monthThe charges were excessiveI also informed him that his painters that he allowed to remove my personal belongings had broken my personal belongings to include a ceramic figurine that had been in my family for over years, my mother's wedding rings (she passed away ten years ago) were missing out of the box that the painters removed from my home, clothes and blankets they had tossed in the garage were damaged with grease stainsHe replied with further insults about how I didn't keep up with the propertyI again, informed him of the reasons he needed to return the $to meHe was responsible for all of the damages caused by his hired personnel. While I lived at this property, *** would not only talk to me so disrespectfully, he was insultingI spoke to him and the owner multiple times to fix the refrigerator that continued to go out and hundreds of dollars’ worth of food was ruinedHe and the owner told me to call the repair personThe repair person informed me the refrigerator needed to be replaced, otherwise it was the thermostat and any time I hear it "go off", I should just slap itI told *** thatThe refrigerator was never replaced and I can't tell you how many times the refrigerator was "slapped"The sprinklers were in desperate need of replacingThe sprinklers were so bad, in several areas, the yard had bare spots because the sprinklers didn't work and the main valve was so rusted, it split opened and water was going everywhereI contacted *** about it and it took him nearly three weeks to repair the main valveThe HOA had to turn off the water until it could be fixed In ***’s letter that was attached to ***’s response to the complaint, she mentioned that *** expensed her for pruning, applying weed and feed one and then again the following month *** NEVER pruned any of the trees and he only applied the weed killer once (the one time he tried to charge me for his labor) Again, I can't tell you what a nightmare it was to be a tenant of GEM State Property Management The information I have provided is repeated behaviors by *** and GEM State Property Management; it is also his reputation in the community as I have found several media sites with the same complaints from previous tenants of theirs. The issues were: While I lived in the home, he would arrive unannounced and do things to the property without my consent or knowledge and then try to charge me for them. While I lived there, I requested repair or replacement of the refrigeratorThat never happened and they told me to call the repair man if I needed any further repair requestThe new tenant that lives there now is having the same issueShe removed that refrigerator and bought herself a new one. I felt harassed while I lived in the home because I didn't hire a landscaper and took care of the property myselfMy neighbors and the owner's son remarked about how great the property lookedThe owner herself visited the property several times and thanked me for taking care of her property*** wanted to hire his brother who he claimed was a landscaperI didn't want that while I lived thereSo I felt like *** purposely remarked poorly about the property to the owners so that he could hire his brotherHe hired his brother after I moved out of the home and now the new tenant has to deal with him and she has complained about his poor quality of work. *** allowed people into my home without my consent while I was actively living in the homeI have a right to privacy that he violated multiple times. *** gave the painters he hired permission to remove my personal belongings without my consentHis negligent act and breach caused my personal belongings to be lost and damaged. ***'s hired personnel used my personal trash receptacle for the removal of their garbage and he charged me excessively for a dumpster he kept on the property for over a month. ***'s hired personnel left a multitude of messes in the home that I had to re-clean. *** charged me fees for his negligent acts; the locksmith was needed due to his painters removing and losing my keys. *** was excessive in his charges for cleanup that he was doing outside of maintenance I had agreed to. *** did not return my security deposit within the daysI had to email him requesting it. He was insulting and lacked professionalism.I have the pictures of the mess his hired personnel left after I cleaned the home as well as recorded conversations between *** and myself

The 190.60n is for the that we charged for labor ONLY for chemicals applied to the landscape that the tenant did NOT take care of as we stated in the last complaint and this was told her via phone conversation thus she can say we never stated it, we learned our lessonThe keys she can not prove only supposition while she allowed a lock box to be installed on the door so she could break the lease as stated beforeAs you might notice she continues to add more items as time goes byeShe NEW that the lock box would be installed so the vendors could do there job to comp[lete the property so she could break the leaseAs you see we included the copy of the lease to show the end date when the lease was endedShe is asking for 190+ and it includes the LABOR ONLY for remeding the weeds and weed and feed of the property requested by the owner as you have already recieved from us and the keys as she sugjests without proof asked me to remedy to expidite the move (verbaly) and the balance for the air filters that she never changed and the soft water salt she never filled causing the system to shut down created ALL glass showers etc to become very dirty , we cleaned with NO charge to her as she and her rep viewed at the walk out. Again we charged nothing (stated before) for the cleaning she left us to do and was aware ofWe had the entire property painted inside and new carpeting installed leaving nmo carpet cleaning nor wall cleaning or fill which saved her money. As a management company I do not know what more we could do to satisfy the tenant. Thank you*** ***
