Complaint #*** ResponseRegarding Section 1, Gemini will continue to stand by to our original statement.Gemini had called the customer to inform that the customer’s order had arrivedThe customer had obviously received the message, therefore arrived to Gemini Bridal to try the dressThe customer in question as stated previously in our original statement left without comment.Regarding Section 2, the products are based off of the designer’s standard sizes which is also indicated on the order agreementThe customer can peruse the order agreement as the customer already has a copyThis had already been indicated in our first response to Revdex.com (Revdex.com).Since the customer has not paid the remaining difference for the product, the product can obviously not be altered in any way because the customer had not fully paid for the productShould any problems arise after the customer had taken the product to the tailor the product will obviously not be the sameHence the need to have the customer pay the difference for the product.Regarding the complaint, it is obvious at this point of time that the customer had never intended to buy the product, as they had possibly changed their mind during the time that Gemini’s product was being shipped to GeminiHence the refusal to pay the remaining differenceThe customer was also aware that the product was final sale, resulting in their actionsThis is accented by the fact that the customer had left “without comment” especially if there were so many glaring problems/defects in our product as they pointed out in the complaint letterThese allegations began a month after the wear date.A customer would have stated all problems when they first try on their dress and not leave without comment and wait a month before giving out such accusationsIf the defects were truly pointed out during the fitting a manager will have been involved in the matter and the matter dealt with immediatelyHowever no problems were pointed out during the fitting and the customer had indeed left with no comment.Gemini will dispute the allegations the customer had made to Revdex.com regarding Gemini’s products, and that Gemini had not contacted the number the customer has provided.When the customer had first made these allegations, Gemini had immediately launched an investigation into this incidentThe results of the investigation prove that the product is brand new and that Gemini had indeed contacted the customerShould the dispute continue and Gemini’s evidence is required, due to the legality issues, this dispute will need to be taken to the next level.The product in question will continue to be in Gemini till September 15, 2017, afterwards Gemini will follwith the agreementIf the customer decides to pithe dress, and pay the difference they will have until the date stated above to do soGemini has already made an exception by holding onto the product due to the special circumstances

Response to statement of Gemini Bridal in regards to our complaint ID#***Gemini did not call or speak to anyone regarding the arrival of the dress.Gemini claims this information is recorded in their system, along with who made the call and provides the date of January 21, which we have no record ofGemini had no answer for our questions of who they spoke with when they called, if they spoke to someone, or if they left a voice mail.We have detailed cell phone records that identify both incoming and outgoing calls and clearly show that no incoming call from Gemini was ever recorded.Gemini has provided various conflicting stories, such as the person responsible was a sales rep named Tiffany, who they dismissed and was not available for Gemini to talk to in regards to our complaintThey did not say when Tiffany was dismissed.Later on, Gemini claimed it was a person named StephanieGemini was elusive as to whether this person who they claim called had left a voice mail, or if they spoke to someone.Gemini has still refused to provide us with this information, and we believe they are unable to do so, simply because the fact is Gemini never calledGemini states that "the customer did come in to try the dress but left afterwards without commentThis statement is deceptive and false.This dress was tried on at least months prior to our request for a refund and Gemini was well aware of our dissatisfaction long before we requested a refundGemini had ample opportunity to rectify the situation but chose not to.When *** originally tried on this dress on December 2, 2016, it was far too smallAs (we were told) this was the only size they had available in stock at the store, Gemini said they would order the dress in the appropriate size, and a seamstress named Tiffany took ***'s measurementsWe were required to pre pay for shipping, as well as for half the cost of the dressWe were then told we would be called when the dress arrived.My daughter went to Gemini Bridal in February (as she lived with a family in the Edmonton area for the school year) to check to see if the dress had arrived, as we had not received a phone call, and I urged her to go to the storeGemini presented her with a dress, which looked worn, with pulled seams, identical to the rack dress she originally tried on in December when we were both at the storeGemini claimed this was the dress she ordered inWhen she tried on the dress it fit exactly the same as the rack dress fit, which was at least sizes too smallShe could not fasten the dress.*** did not leave "without comment" as Gemini claimsWhen *** tried on the dress, she was shocked that it was the same and did not even come close to fittingShe expressed her concerns to Gemini about this immediately and was told, at that time, that Gemini would arrange to have another tailor come in and "make it fit", but not until she paid for the rest of the dressMy daughter disagreed and said she was measured already and she understood the reason her measurements were taken were to have a dress arrive that was in her sizeGemini refused to address her concerns, she was treated rudely and left in tearsShe contacted us afterward to tell us what had happened.Regarding sizing, Gemini has not explained how body measurements can be taken, yet still result in a size that does not even remotely fitEven if the designer has specific measurement standards, if a 34/27/measurement equals a small, medium, large, or whatever the designer labels it as, the size ordered should still reasonably fit the body that the measurements were taken fromThis did not happen at all as the dress was not anywhere near fitting my daughterGemini has never returned our callsWe initiated all contact with GeminiGemini would evade our inquiries by claiming they needed to look into the matter and would call us backWe would wait to hear back for a period of time and when we received no call we would phone back again to follow upThis process continued for months prior to the Grad Ceremony which was in MayGemini was aware the date of the ceremony was May as it is stated on the Invoice.On the Invoice, the Wear Date' stated was May 2016, which was an error as it should have stated Calls we made to Gemini (as verified by phone records)March 2nd March 11th March 13th March 29th May 9th (calls that day)June lit (after Grad Ceremony had passed)June 5thWhen I initially called Gemini to discuss the problem, I was told that I needed to come In to the store to talk to the sales rep, Tiffany, who was responsibleI explained I live nearly hours awayI was told (by a male employee) that he could not speak for Tiffany or look into the problem until I came in person when Tiffany was available.In subsequent calls we were told that Tiffany was dismissedThen we were told there never was a Tiffany it was someone named StephanieEvery time we spoke we received a runaround.After many unreturned calls and runarounds, we realized my daughter was not going to have the dress for her PromShe purchased a dress elsewhere at the beginning of MayOn May 9th our phone call to Gemini was to seek a refund as it was obvious at that point that Gemini had no intention of bringing the dress In as we had ordered and paid half ofWe were again told that Gemini would have to look into it and have a manager contact usAgain, we were not contacted by anyone as promised.We called again June 1st and finally on June 5th, to discuss a refund, which Gemini had no intention of honoringWe informed Gemini that we would proceed with a complaint against them if they would not refund our moneyGemini was unconcerned.In summary, we called Gemini on occasions regarding this situationGemini did not call us even once.*** ***

To respond to Customer Order Agreement [redacted] First we should address that Gemini did inform the customer when their product arrived so that it can be picked up, this is recorded into our system therefore we are able to confirm who had made the call. All customers leave either an email or phone...

number with Gemini so that when their product arrives they will be informed/ or left a message. We had called this customer on January 21, 2017 to inform the customer that the dress had arrived. The customer called back on June 1, 2017 and wanted a refund. Unfortunately the item the customer had ordered is unable to be refunded which had been explained to her on June 1, 2017. It should also be noted that the customer did come in to try the dress but left afterwards without comment. Regarding the product that the customer ordered, it was indeed the correct size since measurements have been taken on the date ordered which is also confirmed by the customer. The product itself also completely follows the designer standards which includes the sizing. This is all indicated on the order agreement and all measurements shown on it is specially ordered to match the standard size. Gemini completely followed through with the contract/agreement with the customer.
