Regarding dates: On 3/28/two proposals were createdOne
proposal for windows and one proposal stating that exterior home painting
would be approved only after the windows were installedProposals were not in
compliance with legal standards for contracts according to a construction attorney
Contractor delayed the window installation
multiple times over a week periodOn 5/2/ the
contractor arrived late which would have caused him and his helper to be there after I went to workBecause he smelled from drinking alcohol and was with an
unknown worker he hired online the night before, I expressed discomfort at
leaving them alone in my home Contractor got very angry and took the windows and
left me a signed note stating: “Windows were damaged, had to return.” Even
though two of the three windows were not damaged, as the contractor left he
told me he was going to Home Depot to get a refund for 'all damaged windows’The 3rd window had a minor flaw which I accepted for installation anyway. The window measurements were never called into question
Regarding painting: The $I paid the contractor was a window deposit which cannot be applied to painting as the written requirement to install the windows prior to painting was not met. Any work performed related to painting preparation was not
agreed toI informed the contractor’s worker *** of that before he did any minor painting prep work. The painter I later used to paint my home was recommended by a
neighbor and was never an employee of the contractor nor did he know the contractor.
My request for compensation: Contractor quoted the cost for the post and
fascia work he performed was $300, which is why I am asking for
only $back from my $window deposit
When contractor Gene McCormick, sent me a threatening note on
May 6, 2014, I engaged an attorney to communicate with himOn July 5, contractor
Gene McCormick, sent me another threatening letter. Due to threats, contractor has been instructed to
address all communications to my attorney. Legal authorities have been

consumer complaint #.#[redacted].   Thank you for the opportunity to spend my time responding to a complaint. I believe this is the one from [redacted].   First off [redacted] has no idea of what really happened at [redacted]. She was not there for the entire time of construction and was only...

around at the very end.   First of we did complete one contract almost in its entirety (the only thing left was a door.   [redacted] withheld information which was critical and slowed the job. First of the did not give me the CCRs of the building which they should have as the first thing that need to be done was to inform the Property management company of the project and to submit drawings and certificates of insurance. I did not comply with this as I had no knowledge of this and could not give an entity that I was not aware existed information. Any way we were working on the Electrical and the Original builder had miss labeled the main breakers with the wrong address and we turned off the wrong buildings electricity because it had the address for [redacted] on it. (side note: we saved [redacted] about 12k because they were paying the bill for the other building which was in full production and [redacted] had no activity at all.) The other building called the property management company and they sent out an electrician to see what was wrong, he came out and found us working and the breaker off. He informed the management company and the sent someone out and forced us of the property because we had not filled the proper forms. This was of course not our fault as wew did not know of the management company or the forms prior to this, [redacted] should have given them to us pripor to us bidding the job.   This created a delay because we needed [redacted] to sign a Change order and provide the forms to the management company. [redacted] took weeks to sign the documents.   The next delay was caused by the management company as they need to approve the project. We sent the plans to them but they would not allow the TI the way that [redacted] wanted it. I was the instructed by [redacted] to make a new set of plans (which they refused to pay for even though the agreed verbally) Redrawing the plans took more time. In the interim I suggested to [redacted] (contact at [redacted]) that he go around to the other buildings in the park and see if anyone else had done something close to what they wanted. Please also note that the management company did not want us to start until we had a permit. Well I resubmitted the plans to the city with the changes. The next day [redacted] emailed me that they had found another building in the park that had done the identical TI that they originally wanted. About a week latter They gort approval for the original idea. Back to the city who was not happy about the third change. We received a list of corrections from the city and sent them the corrections. We then got a second set of corrections which We responded to and the city was in the process of accepting.   During the time that we were waiting for approval we did a lot of work and got as far as we could because the next step would involve covering the materials which we could not do because it needed inspected. I let [redacted] know that we could go any further until we had a permit. [redacted] got the city a permit but it was for the wrong set of plans. I know that because I know which set they had that was stamped by the city. Because of all the waiting Kartheh want some type of assurance that we would be done in 1 month but I could not do that knowing that we still had issues with the permit and you never can control a city and its plan review.   Any way [redacted] wanted a meeting which I went to and wanted me to sigh an new Very poorly written contract which contained a liquated damages clause (means that I pay them if I am not done on time) for a $1000.00 per week and did not include all the change orders. I refused to sign the new contract and a few days they breached the first contract by sending me an email saying that I was not allowed on the property or to finish the construction. I have tried to get on the property to retrieve may tools and belongings. [redacted] did respond and say they would give me back the tools but have never responded to any emails requesting permission to retrieve said belongings.   Once again I did note receive notice of this complaint in a timely manner, The Revdex.com used an old address that we had when we were a member but we got tired of giving 500.00 per year for protection, I mean that is actually criminal.     Any questions feel free to call [redacted]   Thank you   [redacted] President Gene McCormick Construction

lie for money and can be small.   We did get an 800.00 dollar deposit from Ms. [redacted]. Which toughly confuses me as the first name she gave me was not even close to that name. I also asked her to sign the contract I had brought with me. She would not and said she would send it in a week or two. I am a contractor i.e. person that uses contracts to show intent and fowoll the law. It is against the law to perform work without a written contract. Any way I took the money with the promise of a signed contract coming soon. I never got a contract until a week befor we were to start. I cannot order materials without a signed contract and actually have to wait 3 days because of the 3 day cancellation period. So, I did not order the windows until a couple days before the job was to start.   A MAJOR point that Ms. [redacted] is leaving out is that we changes a large beam out in the front of her house and a long piece of fascia in the rear. We also power washed her home and prepped for paint. The cost to me for all this work was over $1,200.00 and valued at $1,600.00. She also did not really seem to understand the language in the contracts as she had a handy man create a trench instead of hauling off several yards to lower the soil from here weep screed. She also used my guys to do the paint (ex-employees)   When the windows got in Ms. [redacted] was not behaving rationally and was glaring at us (I think actual fire was coming out of her mouth). I told her the windows did not fit as it was so uncomfortable to be there and she showed no signs of letting up.  I did not give her back the 800.00 because I used it to pay for the paint contract that she breached. She also had a lawyer contact me and gave him half of the story also. When I filled him in with the full story he left me alone. He also told me to not contact her. I find this very frustrating as she is putting out bad pr on me and I have no way of stopping her. She is the one who did wrong. Review: On March 4, 2014 I paid [redacted] McCormick a cash deposit of $800 for a $1300 labor and materials job to install 3 windows in my home which he said would take about 3 weeks. After months of endless delays, excuses and unreliable communication, he brought the windows to install on May 2, 2014. He arrived several hours late with a very strong smell like [redacted] had been drinking alcohol. With him was a laborer he did not know who he just hired from a listing on [redacted]. (The laborer let me know he was not comfortable with [redacted]'s behavior or state of mind. Because [redacted] was late and could not finish the job by noon as agreed upon, I would have had to leave to go to work while they were still working instead of them being finished on time. When I expressed my discomfort with leaving the two of them alone to work in my home because of the his alcohol smell and the unknown laborer, [redacted] got very angry and put my windows back in his truck and drove off.

Before [redacted] left he told me that all 3 of my custom ordered windows were 'damaged', (which they were not except for one minor flaw on one which was the only flaw we saw when I examined them with him and also when he examined them with the person he picked up the windows from at special order department [redacted] that morning.). [redacted] said he would return all 3 'defective' windows to the store to get his money back. However, he did not refund my window deposit.

Then he contacted me by e-mail and threatened to sue me for the value of the painting proposal if he saw anyone at my home doing a painting job that I had previously agreed to let him do. (The original agreement stated that he had to install the windows first before painting and that the entire job needed to be completed by April 22nd.) He ignored all requests to refund my money.

I deeply regret hiring [redacted] McCormick Construction and would like to prevent others from a similar experience.

I welcome the opportunity to provide extensive documentation as needed.Desired Settlement: I would like to have the $800 window deposit returned to me.

However, because his workers did several small jobs at my home, including replacing a post and a fascia board I am willing to subtract $300 and to settle for $500 return of the $800 window deposit.

Review: Contractor stopped the projects in July, told us he was going on a two week vacation, but hasn't returned in months. There is a big hole in the ground, no cement has been poured for the foundation of second story bathroom & kitchen. Originally estimated 1 month to finish the job, it has been 7 months. He agreed to completion date of 4/10/14 at first, then stated a completion date of 5/1/14 when he requested a change order. He resumed work after 7/4/14 for a couple of days, but stopped working before the end of July (when he said he was going on two week vacation) now he is asking for more money, when we have already OVER paid him. there has been absolutely no progress made on our project. We are losing money as we have planned on renting out our 2nd floor. It has been 7 months.Desired Settlement: Either finish the job within the budget, or pay us back fro the money paid to him in advance for supplies (but no supplies were purchased and brought to the job site).

Review: Gene McCormick Construction, under the business name Solar Ease, installed a solar electricity system on our home in November & December of 2013. An important part of the service agreement included the company filing an application on our behalf for the California Solar Initiative (CSI) rebate with the California Center for Sustainable Energy (CCSE). Based on the size of our solar system, that rebate is approximately $588.00. [redacted] promised that he had taken care of that and the rebate should be in the works. On multiple occasions over several months via both telephone & e-mail we requested a copy of the application that was supposedly filed so we could follow up on the status. Our requests were met only with promises and reasons for delays. To date we still do not have the requested documents. The last commitment we received from [redacted] on April 30th was:

"I have to take care of budgets, marketing, sales, estimating all departments. I assure you I will get the CSI even if I pay you out of my own pocket. I just do not have enough time. I am working on 10 bids right now if I sell half I can get the assistance I need. I do work 12 to 13 hours a day plus run and spend time with my family. I get about 30 minuets a day for [redacted] and I need that.

I WILL GIVE YOU THE CSI IF THEY DO NOT."

On June 6, 2014 I spoke with a gentleman named [redacted] at the CCSE. He looked for a pending application for us under our personal names as well as under the names of Solar Ease and Gene [redacted] Construction. He was unable to find any indication that an application had ever been submitted. He also told me that in February the CSI rebate fund ran out of money and he wasn't sure if and when it would be replenished. Since our system install was completed in late December, there would have been rebate funds available for us if an application had been filed at that time.

That same day I e-mailed that information to [redacted] and demanded that he either get us the documents and proof that he had filed the application and that CCSE had it in their records or that he pay us the CSI himself as he commited to on April 30th. I specified that I wanted this by the end-of-day on June 10th. Once again I got the same non-response response that he would get to it by the end of the week and then by this past Monday 6/16. We still do not have anything we asked for.. (CDesired Settlement: At this time we would like Gene McCormick to pay us the $588 that covers what the CSI rebate we would have received if he had filed the application in December as promised.

I would like this in the file and on the web. First of all Mr. [redacted] did not mention that I actually bailed him out. We both had the unfortunate situation of knowing and dealing with [redacted] of [redacted]. Mr. [redacted] signed a contract with [redacted] and gave the salesman a check for over $1,500,00. I did work for [redacted] and was owed (and had checks (not worth anything)) for over $46,000.00. I can provide copies if you would like. Anyway [redacted] sent out an email stating they were going out of business. That meant that the deposit that Mr. [redacted] gave [redacted] was null, so if I had not came along and agreed to do the job for the same price as [redacted] minus the $1,500.00 The [redacted]s would have spent $1,500.00 on nothing. Of course Mr. [redacted] could have filed on [redacted]s contractor’s bond but that was done by over 10 other entities and we all got about 5% of what we were owed. As for the CSI rebate I did apply for it for Mr. [redacted] but was too late the CSI fund was depleted by the time It got to them. I could have sent it earlier but aside from trying to get money in because of the huge loss I was also busy filing liens and lawsuits, etc. I also had a very busy time getting printing and baners designed for a home show as Mr. [redacted] had promised he could provide them for me but a the last minuet pulled and left me hanging with less than a week to get ready! We did work it out though and I gave him a $600.00 Monitoring system in exchange for him not getting the Rebate. I would also like it noted that the Revdex.com sent me a couple letters, but the were not timely.
