As in my previous replies, Mr [redacted] is the Co-buyer and the loan and his Wife [redacted] is the buyer and the only way to remove her name from the loan is to refinance the loanAnd on 1-4-we received a payoff request from [redacted] and on 1-5-another payoff request from [redacted] Dealership later that day we followed up on the payoff for funding and we was told the deal was UTF unable to finance down payment problemslater that same day Mr [redacted] was in the our office making his payment and we offered to refund his payment to allow him use that money as the Down Paymenthe declined and said thanks for the offerOur Company takes pride in trying to satisfy every customerHowever, Mr***, was offered several alternative solutions to resolve his compliantAt this time we've closed this complaint in our office

I [redacted] have talked to Mrs [redacted] and have told her where to look on her paperwork showing where the price can change at any time and offered for her to get them done at Sam Swope Mitsubishi in the futureI also explain to her that not only [redacted] but all of the Sam Swope Auto Group had discontinued the Road Side Program

Mr***, was in our office yesterday 1-5-making his monthly paymentHe was very apologetic for the language he used that last time he was in our officeI advised him that I received a request for his payoff and I offered him monthly payment back to help make the down payment on the new vehicle I had no ideal he was still not satisfied

For your reference, details of the offer I reviewed appear below.A man from Sam Swope did contact me today regardiing my complaintIn my opinion, he was rudeI would try to talk and he would interrupt meHe did say in the paperwork (which I did not get a copy), the oil changes and road service was subject to changeHe did tell me I could bring my car to Sam Swope Mitsubishi for oil changes, I told him I've had my share of rudness from everyone at Sam Swope and General AcceptanceMy issue is we were promised road service for the life of the loan, that was ended without noticeThe vehicle didn't have a jack when we purchased itThey had to order a jackThen I get a flat tire to find out I don't have a lug nut wrench to take the tire offWe had to purchase one ourselvesIF they would have notified people the road service was cancelled, I could have gotten AAA (which I have now)I will continue to make my payments (as I have done so) and I DO NOT want anyone from Sam Swope or General Acceptance to contact meThese people are rude and think they can talk down to customers even when you call in to make payments.Regards,*** ***

left her a message, and sent an email explaining our intentions to help herWe were able to speak with the co-buyer and explained that the company that repossesses vehicles for us charges us for itemization and storage of personal property left in vehicles; so as a goodwill gesture we are not requiring them to pay the fees associated with the itemization and storageThey can make arrangements to pick up their personal property at their convenience

During 2008 our customer freely entered an agreement to purchase an automobile from Sam Swope. As part of the...

purchase he requested a loan from [redacted] LLC ([redacted]). His loan was approved and our customer again, on his own free will, agreed to the terms of the loan with [redacted]. In 2010 our customer defaulted on his agreement. [redacted] made numerous efforts to contact him by mail and by phone but were unable make contact. For this reason [redacted] had no other choice but to secure the collateral for the loan by repossession. As required by Federal and State law his vehicle was sold at auction and all proceeds were applied to his remaining balance. Again, as required by law, [redacted] sent letters both regular and certified mail to our customer last known address explaining that there was a balance still due on his commitment.
After sending the notice to our customer and not hearing a response on paying the deficiency, we again reached out to him with phone calls and more letters but we were unable to contact him or get a response. Because of his failure to respond, we had no other option but to turn his account over to an attorney which resulted in more cost on his part. Our policy which is normal in these cases is that once this is done all communication with our customers is handled exclusively through the attorney.
About two years went past, and our attorneys also made numerous efforts to contact our customer until they finally were able to talk to him. They were unable to set up any type of arrangements with him to pay his balance. At some point our customer offered to pay, I believe, $400.00 on nearly a $5,000.00 balance that was owed. [redacted] agreed to reduce that balance to $3,800.00, but our customer declined.
[redacted] is prepared to make one final goodwill gesture of $1,000.00. If paid within 30 days [redacted] will stop further collections. As per Federal and State laws his account will show “Settled for less than full balance” on the credit bureau, and because the remaining principal balance is over $600.00, [redacted] will be required to issue a 1099C to him and the IRS for the remaining amount.
