This company had completed work for us on a deck years agoWe had talked about an addition we had considered doing and he agreed to look at plans we hadThe following day, tornadoes struck our area causing significant damageWe knew he would be very busy and the plans would not be on his priority listWe had a follow up call about months later to request the plans be returned since we hadn't gotten any estimates or anythingNo return callWe did this about more times over the course of the last yearsOn 5/13/13, I called him againThe conversation went as follows: "Hi, [redacted], this is [redacted]." "yeah" "You did some work for us on [redacted] about years ago and took some plans to look at; and I have called multiple times.." "Listen, [redacted], stop with the attitudeI am having a bad day and I don't need this over $plans." "Dude, sorry you're having a bad day but they're actually $plans and we want them back" "I have boxes of plans in my office, I don't keep them that longCan't you get a copy?" "I don't have the plans to make a copy; it was a retired architect that did them." "Well can't you get them redone?" "The man is dead; I'd like my plans back" "Well, I have a million dollar project that is going wrong right now, I don't have time for this" "I'd appreciate you looking" "I'll get right on that." and then he hung up on me.I find this behavior completely unprofessionalI know that in this recount, you can't really get the feel for how abusive and hostile he was on the phone with meSure, a bad day, but no reason to talk to anyone that wayMy $plans may not mean anything to someone working on a 'million dollar project', but they mean something to usI take ownership in we didn't call him as much to get the plans returned but we were being considerate due to work that we were sure he was having to do from the stormIf he wasn't going to do the work he should have returned them, not gotten rid of them or misplaced them.Desired SettlementI would like him to return the plans or reimburse us the $that we paid for the original plansI honestly feel he hasn't made any effort to look for the plans, much less return them.We will be able to provide supportive documentationIf it doesn't meet the resolution that we find appropriate, we will pursue this in small claims court.Business' Initial Response [redacted] called me on the date specified on the complaint with a very bad attitudeI responded to her that I was having a terrible day and asked her what I could do for herShe responded after over years that she needed her blue prints backI told her that we do not keep blue prints for that longI asked her why she cant get another copy from the architectShe said the architect had died and that was her only set of drawingsI told her that I would look for themUnfortunately I wasn't able to locate themWe have been in business for some timeWe dozens of sets of drawings and the reason for this is when you give out a set blue prints it is standard practice that they are contractors set to keepI have never been given original set of blue prints in all my years of businessIf I had been aware that these needed to be returned I would have been happy to do soI am truly sorry for the situation at handConsumer's Final Response (The consumer indicated he/she DID NOT accept the response from the business.)If identifying myself on the phone and reminding [redacted] that I had called multiple times with the same request is "having a very bad attitude" then I am guiltyWe had called him several times, the first one being within months of him receiving the plans, requesting they be returnedHe had been told when we gave them to him that they were the only ones we hadHe never contacted us with a review of the plans, or an estimate, after taking the plansThere was no follow up on his part about the project which was the original intent of giving him the plans in the first placeOtherwise, what would have been the reason for allowing him to take the plans if we weren't hoping to do the project or looking for feedback regarding the project? I find his response to be unacceptableHe absolutely knew these were our only set of plans for the projectHe had been called multiple times requesting they be returnedAgain, that is what set him off in the conversation; when I reminded him that this wasn't the first phone call made about the plansI don't feel he has made an effort to look for the plans, nor do I think he is remorseful for the way that he spoke to me on the phoneI think he was completely unprofessional and arrogantMy "measly" plans were insignificant to him because he was working on a "million dollar project" He should remember that past customers are referral sourcesThis individual is unprofessional and doesn't even appear on the registry/licensing board of contractors for the state of MAI'm actually glad that we didn't have him work on the project because I would imagine he would be awful to work withHe obviously is unable to handle stress appropriately evident by him needing to yell at a former client on the phone.I would like to reiterate that [redacted] KNEW the plans were our only copy and that he had been contacted multiple times requesting they be returnedWe had thought we were being considerate in not badgering him the first months he had the plans because the tornado struck in Springfield within hours of him receiving the plans and we thought he would have been incredibly busy with repair projects.I continue to feel we are owed the cost of the plans.Business' Final Response [redacted] myself and employee spent a good amount of time looking for your blue printsI would like to help youIf your not comfortable talking with me can you please call [redacted] XXX-XXX-XXXX she is apart of my office staffI have a couple suggestions on how we can resolve thisFirst- I realize your architect cant be reached but there must be someone that can locate his recordsIf you have any information that could help us try to get them such as his practice name or phone number we will do the research from thereMy other suggestion if that fails is that we split the costI feel like that is fair and hope that you feel the same
