As per our membership agreement and NYS cancellation policies we can not accept what you provided as proper reason to cancel out of term. However, if you guys needed to freeze the membership I would be more than willing to help you with that. it is typically $10 a month, but I will do waive that fee since there is medical reasons. Also, as per your signed agreement we do always need to verify all notices given to the club. [redacted]{The above e-mail was the second response sent to you after you replied to my e-mail, also sent on 9/**}Marc - I wanted to get back to you right away, however I will not have an answer for you until our corporate headquarters reviews the issue. I forwarded all the paperwork you sent to me to their offices for review. As of now I put your membership on hold starting 10/**/2015. We require 30 day notice for all cancelation or freezes, and you first sent us paperwork last week which was 7 days before your bill date, therefore both accounts are overdue. Your payments for today did not go thru. When we reach a resolution I will let you know.Thank You!{Above is the 3rd reply to your email sent on 9/**}__________________________________________________________{Below is the response that I sent to you on October [redacted] in reference to the complaint from the Revdex.com saying that we did not answer your cancel request:}[redacted] - On October [redacted] you contacted the Revdex.com stating that we did not contact you after your cancel request was made. Highlighted above is the email that was sent to you on 9/**/2015. Attached in this email is the signed agreement that both you and your spouse signed when you enrolled into our facility. On page 2 we explain our cancel terms. The wording is stated below:9) RIGHT TO TERMINATION AND CANCELATION(a) If, during the term of this contract, the member should become permanently physically disabled whereby he or she shall have been unable to receive all services contracted for, (our club) sent by certified or registered mail, you shall be relieved from making further payments. Anyone claiming benefits under this paragraph shall supply the clubs consulting physician with satisfactory written evidence of substantial physical disability.On 9/** I explained that your cancel proof was being forwarded to another office for review. The reasons why it was not immediately accepted or denied was because the medical proof you sent to us was from well before the date you both enrolled and signed for the agreement. We only accept cancel requests if there is a new disability that prohibits use of the gym, both you and your spouse signed up for our facility and received copies, in and hand and thru email, of our terms. Also, the injuries that both you and your spouse had a Dr. write were not considered to be a permanent disability. Both our consulting physician and a board certified trainer said the injuries which your Dr. said would not allow you to work out at all and ever again would have been prescribed by our consultants with exercise and stretching. Also, whenever 2 people that joined together are cancelling because of permanent disability at the exact same time we always review the situation as it is very rare th at two individuals on the same day and time would be told by their doctor that they are permanently banned from working out because of their new physical issues. And as stated in my original email response I had needed time to further review your situation. Also in the contract attached explains our freeze policy. It basically says that the freeze is in time only and that you must pay your monthly payments, "billings will continue and must be paid as scheduled" Since I did not accept your cancel request right away I assumed you would like to have your membership frozen while you were waiting for a response. This is why both you and your spouse were billed for 9/**/2015. And as explained in the original response both account were overdue since the credit card on file did not approve the charges. If your cancel request does not get approved you and your spouse can pay the early termination fee of $150 each and I can cancel both of your accounts immediately with no further payments being owed. I will also waive the payment for 9/**/15 so the total amount for both of you will only include the cancel fee and no past monthly required dues. {Below is my response your reply to the above email that was sent on 10/*}[redacted] <[redacted]> 12:54 PM [redacted] I am sorry that you are unhappy with our cancel policies and that we only accept permanent disability as a reason to cancel, not injury or flare ups that temporarily delay your ability to work out. This is a good thing though, permanent disability is very serious and would you could never participate in any physical activity again and that would be horrible. I am more than willing to work with you and I don't want this to be a huge issue. We do allow medical freezes for up to 6 months where you are not billed anything and hopefully after 6 months you both will be feeling better and will be able to participate in light exercise. Since we have seated bicycles here with back support, light dumbbells as low as 1 lb. each, and basic classes for seniors/beginners/and people with non debilitating medical injuries, and equipment and a separate training area that allows you to stretch to help your flexibility and balance issues there should be plenty of options for you guys that will help you, and not hinder your physical success. Please let me know if you would like to freeze, if you would I will start the freeze from 9/** that way you both will not have an outstanding month due.If you still want to cancel you are going to have to pay a cancel fee. Its supposed to be 150 each so that comes out to 300, I really want to help so if you just don't want to come here anymore I would accept $200. That means you are only paying $100 each. And keep in mind both of you owe $50 on your account as we require 30 day notice to cancel and I am going to include that in the $200. This means all you have to pay is the $50 balance and the equivalent of $50 to cancel (100 each) That is a great deal for us and something we don't usually do. Our current cancel fee for all new members is $250 each! Hope this helps!I really don't want you taking offense to our denying the cancel request, but as per your agreement your injuries do not satisfy the qualifications, this is not personal at all.{Above was the response to the email reply you sent me where you said you did not want to accept our cancel terms}

Review: Me and my spouse submitted to the fitness club, medical certification that we are both disabled and unable to continue our gym membership, one of the managers (anthony) called and questioned the validity of our doctors note of disability and asked to send in x-rays or MRI's, to which we submited email to the club manager, copies of both of our MRIs and we have not heard anything back from them.Desired Settlement: I would like my husbands contract and mine cancelled due to medical disability.
