Genesis Credit Management Reviews (40)

This is the response to Revdex.com complaint ID [redacted].  On 12-29-14 a settlement arrangement was made for [redacted] to pay $947 to be released from the file only or a grand total of $1608 to be paid to settle the account in full and release both [redacted] and [redacted] from the account and both...

people would pay half the settlement of $1608.  [redacted] only paid his portion of $947 on 1-30-15 to be released from the file.  [redacted] never paid her half of the settlement, therefore she still owes.  The notes are very clear that the $947 paid only by [redacted] was to release him only from the account and the remaining balance would be left for [redacted] to pay on her own.  Ms. [redacted] admitted she has a copy of the paid letter we sent to [redacted] and it specifically only has [redacted] name on it because only he has been released and only he paid.  Her name is not on the letter because she never paid her portion and still owes.    Thank you,
Crystal S[redacted]
President / Genesis Credit Management

Revdex.com,
Thetc 947 was the total settlement amount. We were advised there was no way t split it. After that amount was paid I had called and confirmed that the account was then taken care of. The paper we received does state that the account is settled and closed. I was told that because [redacted] was in prison it would be difficult to split the settlement amount of 947. I told them if they could provide proof in writing that the account was split or that the debt was still owed I could try to see what I could do but instead they threatened to garnish my wages and hung up on me. I have spoken with both [redacted] and Mike and they agreed the account was never split and that 947 was the total settlement amount. Also I had contacted the original creditor about the debt and they advised that genesis had not made them aware of a settlement and that they only received 146 of the 947 paidI have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.Regards,[redacted]

We received a dispute letter from [redacted] on 2-3-16 and mailed proof to her last known address as requested.  We have also contacted our client for additional documentation to support this debt and since we have not gotten a response we went ahead and removed the account from Ms....

[redacted]'s credit report.

Thank you for investigating this for me. I'm just looking for physical documentation of our interactions and agreements.

Proof has been mailed out as per request to [redacted]  [redacted]  [redacted].  We have a new representative that is handling the account and we have set a reminder to call next Monday 6-13-16 as per Mr. [redacted] request.  At any point in time Mr. [redacted] can also call our office and speak with Stephanie M[redacted] at 425-320-4010, she is the new representative that would be happy to help.

Complaint: [redacted]I am rejecting this response because:
Proof was never mailed out and never recived. All I know is what the old agent and my employer has told me. No mailing was ever recived from this company. I refuse to pay anything that can not be verifyed. Also by law they are required to send me the idimised statement for review. Sincerely,[redacted]

I have reviewed the attached complaint and am responding with the following information. Our office does not employee anyone with the name of [redacted]. However, this account is assigned to [redacted], who is the president. It is my experience that she sets a high bar for professionalism and complies with all...

state and federal guidelines in the collection of consumer debt.As a result of conducting an investigation into the matter I am clear that no violations took place. For clarification, our agency is not required to accept partial payments.  We do not make demands for payment in full within the first 30 days of receiving the account, and we do NOT report to credit at any time that is not allowable by law.

My elderly mother applied to live in the Vintage apartments in Silverdale. A senior living facility. Her credit was horrible due to medical bills. My husband and I had to co-sign for her to get in the apartment. She lived there for 4 years and paid her rent on time each month. Each year we would have to re-sign when she renewed her contract. This last year we did not need to sign because she had established herself as a good tenant. Shortly after she had a series of health issues and was hospitalized. She had to be placed in a nursing home to receive the full time care she needs. She was placed on Medicaid. I gave notice to the apartment building when I paid her February rent on 2/3. I wrote on the envelope she would be out on the 28th of February. When I called a week later they said they had not seen the note. I cleaned and moved everything out of her apartment and turned in the keys on the 28th. Shortly after I called and asked about the damage deposit. She proceeded to list $2600.00 in charges. One months rent due to the late notice and other charges, all legitimate except for the rent. My mom was in a power chair and had ran into the door, the fridge, cabinets and all had to be replaced. The carpet was trashed, she spilled regularly. I received a phone call yesterday from a woman from this company demanding payment for the charges. I told her they could not hold us responsible since we did not renew the co-sign agreement. She said we originally signed and notarized a uncontested agreement and we were responsible. She said because it was over 30 days if they did not receive payment today it would go on our credit reports today. I was speechless, and she said, because I wasn't responding I was claiming "a refusal to pay". She said she could pull my credit report today and find the available credit to pay. I asked her how she goes to work each day? How she could do this to people and live with it. After she hung up, my brother called and paid the charges. We have never experienced anything like this or been treated by anyone in this way. We did this for my mom to have a safe place to live near to us.

Review: Issue with language and disposition of Billing Collector. We had an outright screaming match and threats were not needed. Although I am disputing the balance with the original company the debt comes from, the approach taken was inappropriate and demeaning. This was rude and unprofessional. I was flat out told that I did not want to pay the balance due to prior calls to me. this is unfounded and rude, and to end it saying that legal action will be taken was a bit much. I am in the position to set a pay plan for the balance, but was told that I did not want to. Question- How do you collect any type of balance like that?

Requested to speak to a Supervisor several times, which did not happen.Desired Settlement: Treat me as you would like to be treated. If I could pay the amount and avoid any contact from this type of business I would have. I am inclined to ask who really wants to deal with people like this for any reason?

Response:

This is in regards to complaint ID [redacted]. There are two sides to every story and according to our notes and records the foul and hostile language came from [redacted]. The collector working the file tried on numerous occasions to get Ms. [redacted] to not speak to him in such a rude fashion for he was just doing his job in trying to help her resolve the debt placed in our office. Either way, if she truly wants to resolve the debt and set up a payment plan there are other representatives in our office that can help her.

Review: I have an old apartment debt that I owe (I believe. This company refuses to send me an updated bill so I am just going off of what I remember). I started paying on it and then I stopped. I was going to file bankruptcy but decided not to. I was starting to pay off the bills from the companies that actually send me a statement. This company called me some time over a year ago I believe and I answered since I had started to pay back my old debt and said I would pay if they would send me a statement or bill. [redacted] refused. She said they have sent me everything they are going to send me. I did not make any payments at that time since she refused to send me a bill on what I was paying. Some time passed and I received notification at my work that they are serving me for a judgment. I called and they did accept payment arrangements. [redacted] told me this would only be through August 28th and then she would call me to set up something different at that time or see if I could pay the bill off in full. I did not receive a phone call to make new arrangements so I sent a payment yesterday 9/11/2014 by my online bill pay. I also received 3 calls from this company yesterday but I was busy all day at work and was not able to call them back until later that evening. They had tried to take out $200 from my account yesterday even though we had no payment arrangements set up past August 28th 2014. [redacted] left me a voice mail message at 8:01 am this morning stating she did get my message from last night and they will not be sending me a statement and me sending in a payment by mail is not acceptable. If I don't call her back by 5:00pm today there is nothing she can do to help me. I took a break from work and called her back and explained that we did not have a payment arrangement set up past August 28th. I advised I would like something in writing showing where my payment is being applied. [redacted] said they don't have to send me anything and they will not. The law doesn't make them so they won't do it. She said I am on a voluntary payment plan so nothing will be sent about the payment plan. I told her I did not want anything about the payment plan. I want a itemized billing statement breaking out what my balance started at and all the payments I have made and where they have been applied. She again said they don't have to do that and will not. [redacted] then said that I had a payment plan set up still and that I did not follow it. I advised it was only through August 28th and then I was supposed to be called by her to extend it or pay it off in full. She then started saying I had arrangements for payments to come out every two weeks indefinitely. This is not the case and more proof to show how imperative it is to receive documents showing where my payments have been applied. Then [redacted] contradicted herself and said I don't have a payment plan set up and she wasn't going to call me she isn't going to babysit me. I said you just told me we do have a payment plan set up and now you say we don't. She said you defaulted so nothing is set up and the only way you can make payments is by your debit card # on file. Payments in the mail is not going to be acceptable. After what just happened there is no way I would trust this company with my debit card # any longer. I now have to cancel my debit card and order a new one. I want to pay this debt but I don't feel comfortable to continue handing over money on something I don't even know if it is being applied to and what the balance is and what it started at. [redacted] told me that she already called my work this morning and re-verified my employment and will proceed that route. I am sure she did try and call but she lied about saying she had already re-verified my employment. The office that does that wasn't even in for the day yet when I talked with [redacted]. I fully agree I need to pay this and plan on paying it but I don't feel comfortable without a current itemized billing statement. I was in the wrong by not paying this off in the first place 3 or 4 or 5 whatever years ago it was that I set up arrangements and defaulted. I really appreciate that they made arrangements with me again and was going through with them. They were only through the 28th though so whatever [redacted] put in her computer was false. They record all their calls so they can pull that up and see that it was only through the 28th so running my card on yesterday was outside of the bounds. I didn't have the funds in my account so that didn't matter in the long run but now I am very uncomfortable. I want to get this taken care of but I don't want to work with [redacted]. She is not a nice person. I understand I owe the debt. I wish to correspond by mail only at this point. However from what I gather from [redacted] they will not correspond by mail at all and are now going to sue me because of the payment plan arrangements we had that I followed to a T and she tried to extend them without calling me to set up something past the time we agreed upon all because she is not my "babysitter."Desired Settlement: I would like to continue to make payments and make them by mail (online bill pay). I need an itemized billing statement to continue with the high payments I have been making. I will make $50 payments every 2 weeks until I receive an itemized statement in the mail. I don't want to be made to only make them by debit/credit card since my card was already ran outside of our arrangements. This might all be a moot point as [redacted] advised they will be taking legal action...however I don't understand this when I want to pay and agree I need to pay the debt. I just would like some written confirmation. Thank you!

To whom it may concern:

It has been a struggle to get Ms. [redacted] to commit to any kind of payment arrangement from the beginning which is why we had to start a lawsuit against her. We were nice enough not to go to court to obtain judgment and allowed her to set up small payments instead. Once again no payment was made and no communication was made in the month of September. We did just receive a $50 payment and it was applied to the account and a receipt letter acknowledging receipt of the payment was mailed out. When Ms. [redacted] was served with lawsuit papers it included a summons and complaint with a breakdown of the charges to know where the payments are being applied. Our letters are computer generated and we do not have a letter saying you are on payment arrangements or a letter showing a breakdown of where payments are applied, they are applied to legal costs first of course, then the principal amount listed in the complaint and then interest. All of this information has been provided and communicated to Ms. [redacted] several times in the past and has been ignored which is why legal action was necessary. Any payments we receive we will apply to her balance but we did not agree to $50 payments every 2 weeks and with size of the remaining balance we may need to go back to court. I personally listened to the conversation between Ms. [redacted] and the collector handling this account, [redacted], and during the entire conversation Ms. [redacted] was trying set up payments for September forward and all Ms. [redacted] did was interrupt and argue so no arrangement could be made. If Ms. [redacted] would like to speak with someone else regarding this account and set up amicable payments that is fine, otherwise we will continue legal action if necessary.

Revdex.com,

I have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.

[I don't believe the call was listened to listened to without prejudice against the caller (me). What I was arguing was that nothing was set up for September and I was never contacted either to make any arrangements past August. As I stated in my phone call with [redacted] and in my complaint I filed here. [redacted] continued to interrupt me. It was a two way street. If you listened to the call with an open ear you did hear that. I trust that you did hear that but do not want to communicate that in this complaint. That is fine. My complaint is not really on that call. The main complaint is wanting my balance in writing and to continue the payment plan but not by the debit and credit card you keep on file and run whenever you feel like it. My point as I stated in my complaint and my phone call with [redacted] is that nothing was set up past August and you tried to debit my account in September and that was never part of any agreement. As I stated in my complaint I would like to continue with larger than $50 payments but I do not feel comfortable doing that through my debit card ran by you since you did not follow the agreement. I already put this in the complaint. Since you listened to the call you know that [redacted] told me that sending in payments is not acceptable it must be done by the debit card that you keep on file. Since your company was refusing to send me any sort of acknowledgement of where the payment was going I rightfully did not feel comfortable doing payments that way any longer. I also told [redacted] and let you know in the complaint I filed that I sent the $50 two weeks ago, September 11th 2014. I sent another $50 yesterday by online bill pay. I'm not sure why you say you just received the one I sent on the 11th today the 25th that is not what my bank states but that does not matter I am sending payments and you are getting them. I want to increase them and will increase them once I have in writing what my balance is. Since you were vague in your response to me I don't know if you put the balance on what you sent me or not. If the balance is on there I will begin sending the larger payments October 10th. When you get the $50 payment I sent yesterday please don't assume I am still only sending $50 that is what I sent yesterday and off the timeline you just gave saying you just received the $50 I sent on 9/11/14 it seems there is a very long delay. I have no problem agreeing to send in payments larger than $50. I do not want to do business with you over the phone. I would like to do it in writing. It was proven that your company or specifically [redacted] can not be trusted. I don't know what one it is. I was told the payments were only to be set up through August and then we would do new arrangements and that never happened but you still tried to debit my card for the $200 that was not agreed upon past August. I was not contacted to continue the arrangements. I was expecting a call. If [redacted] expected me to call and set up new arrangements after August she should have indicated that. She said she would call me. You also responded to my complaint that no arrangements were set up for September. That is correct. Since none were set up why did you attempt to debit my account? Actually I don't really care about any of that at this point. I only care about setting up new arrangements. I will send more as soon as I get my current balance in writing. If you listen to all the calls between me and [redacted] you will see that she did not follow through on the arrangement were set up. If I can continue to make payments and make them by mail I would love to do that. I am no longer going to leave my debit card on file with you. I still have not been given what my balance is. You state how you applied to legal fee's first and all that. I understand that. I didn't ask about that. I want to be told what my current balance is, in writing. It is very sketchy that your company is unwilling to do this. Having letters that are computer generated is not an excuse not to send someone what their balance is. I don't see why you need to proceed with legal action when I have willingly agreed to continue making payments and said in my complaint I am only doing the $50 until I receive in writing what my current balance is. Your response did not indicate if you put the balance on what you sent me or only put on there that you received my payment and applied it to my balance. Once I have received my balance in writing either in response to my complaint or by USPS mail I will send higher payments. It is very scary to continue to make large payments without any accounting for where they are being applied. I don't even know if they are being applied to my account. I'm not talking about the legal fee's. Obviously legal fee's are part of my account. I just want my balance in writing. Thank you for your time on this. Once I get my balance in writing I will know where I stand from there. Obviously interest will continue to be added. I understand that.]

Revdex.com,

I have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.

I paid off my balance in December 2015. I did not realize the balance was paid in full since this company does not send balances. That is totally fine I am not disputing this. I received a letter from Genesis Credit Management with my final payment returned (not cashed) to me saying I have overpaid and this account is paid in full. On January 30th 2016 they are reporting to the credit reporting agencies that I still owe a balance of $8 and it is an open collection account. If this is correct why did they send me the letter stating my balance is paid in full and return my final payment?

Review: I received a call from this company about a month ago concerning a collections account I was not aware of. This company contacted me and threatened to take me to court and have me detained if I did not pay the account in full. I have been in contact with them over this past month trying to arrange payment plans. The initial call they were so verbally abusive to me I started crying and was very scared. I'm more than willing to pay my debt however I've requested them to mail me written confirmation of my claim and they refuse. I was told to make a payment over the phone or I would go to court. I refused because I have never received written notification and they refused to disclose the address they sent the one and only notification to on 3-31-2011. My mother has tried to help me with the account and establish a payment plan. The supervisor advised my future is ultimately up to her decision and when she decides to take action against me. Again I am more than willing to pay my debt but this company is horrible and abusive and non cooperative. I can't verify if this is a scam or not. I was also told to c[redacted] my credit report and to get all of their information in addition to the creditors information from that report. They refuse to mail me any documentation to support their payment requests. There have been numerous heated discussions between myself and them and they violated my rights to know I was being recorded more specifically on 3-20-14 as the supervisor "[redacted]" mentioned it at the end of our conversation. When I advised [redacted] she was in violation of the Fair Debt Collection Practices Act with her and her colleague [redacted] abusive and unfair practices she responded with "you don't know your laws and I'm not obligated to be nice or do anything for you".Desired Settlement: I would like someone else to handle my account preferably another company if at all possible because I want to pay my debt which again I was not aware of and I do not care to get verbally abused every time I call. In addition I need written documentation of the amount and the creditors information sent to me which I have been refused. Moving forward I am unable to access my free credit report as this company advised me to do to obtain all their information. I have made mistakes in my past and I am trying to resolve it with absolutely no cooperation from this company or its employee's. I am anxious to resolve my debt and help with resolving my issue.. Thank you

[redacted],

This is in response to case # [redacted] complaint from [redacted] against Genesis Credit Management. In Mr. [redacted]'s complaint he says that he was contacted and threatened to be taken to court and that we would have him detained if he did not pay. This is absolutely untrue, we would never tell someone they would be detained if they did not pay. We do have an in house legal department so if there was employment as an asset we could take legal action and he could be taken to court. Mr. [redacted] is very upset and unhappy about the debt that is owed and took his frustrations out on our collectors. There is another person on the account who has already paid more than their half and it is Mr. [redacted]s responsibility to pay his portion. Proof has been send to Mr. [redacted] and he has been able to set up voluntary payments with us, he has been told to go ahead and mail in payments for the amount he is able to pay. He called in to us and updated his address and said he would start mailing in payments. It seems we have been able to resolve this and work out payment arrangements, if there is anything else you need from me please let me know, thank you,

I just recently moved out of my old apartment complex and gave notice. I did not have my new address at the time so I left my phone # on the Intent to vacate letter. I received no final bill from this apartment complex. All I got was a call from Genesis Credit stating I need to pay now. Since I did not hear from my apartment complex I was very shocked to be getting this call. The representative Alex that I talked to was so rude about the entire thing constantly telling me I was a liar and refusing to assist me in trying to figure out what was going on. I was not late once for a single payment so I was sure this was a mistake. When I tried to tell the representative Alex that I would not pay anything until I can confirm what was going on they interrupted me at I will not pay anything and then began to speak over me and state they will simple seek legal action and then hung up not even giving me a chance to continue to speak. So when I called back using caller ID I got the same person on the phone who asked why I was calling. I told them that nothing had been discussed and I wanted to resolve the issue. When the representative kept refusing to provide me with the information as to why I was in collections and would not give me details I simple asked If I could setup payments which they told me no they can not. I then drove to my old apartment complex and spoke with them in person. They apologized and then told me that they get payments from this company all the time and that it is not required to make the payment all at once.

Review: I filed a previous complaint on the company four months ago with the Consumer Financial Protection Bureau. In their response they said they would send validation and they STILL HAVE NOT SENT ME ANYTHING REGARDING THIS ERRONEOUS ACCOUNT. This is absolutely ridiculous! This company has violated Finance Code Chapter 392 Section 392.201. The law says that they must send all files concerning that consumer no later than the 45th day. I originally disputed this account in September and never received anything. Validation will not do at this point and time. THIER TIME TO INVESTIGATE AND REPORT TO THE CONSUMER IS UP!!!Desired Settlement: I want this erroneous account deleted from my credit file NOW!

Response:

Genesis Credit Management has never received any dispute letter from Ms. [redacted] requesting documentation to be mailed and have never communicated by phone requesting documentation to be mailed either. We did receive a request in February and proof has been sent in the mail as requested. The balance due is a very small amount and we are more than happy to discuss the account with Ms. [redacted] if she would like to call our office to discuss in person instead of through complaints. We cannot remove the account from her credit report without proof from her that the account has already been paid or until it is paid in full to us. As far as Genesis is concerned we have complied with her request in sending documentation to prove the debt owed.

Review: [redacted], the manager of [redacted] in [redacted], Idaho, offered to settle my account for $1,375.00 and Genesis Credit Management refused to honor this agreement. I have made a counter offer of $480.00 plus fees owed to Genesis Credit Management, but they refused to help me in any way. I have already contacted the Revdex.com Snake River Region (ID#: [redacted]), but, unfortunately, they were unable to resolve this matter with [redacted]. Genesis Credit Management continues to report TWO instances of collection debt on my credit report for an amount well in excess of the amount owed. After trying to work with [redacted] at Genesis Credit Management I was told that they were also unwilling to settle my debt, nor remove the negative collection marks on my credit report.Desired Settlement: I would like this matter resolved in the following manner:

1) A written apology from [redacted] for their poor customer service, and;

2) A billing adjustment from [redacted] and Genesis Credit Management reducing the amount I owe to $480.00 plus agreeable service fees, if any, and;

3) Immediate removal of ALL negative credit reporting to ALL three of the credit bureaus.

This is my last effort to handle this matter outside of court. I sincerely hope that these unnecessary legal expenses can be avoided.

Response:

To whom it may concern,

This is in response to case ID [redacted] vs Genesis Credit Management. Mr. [redacted] claims he has a letter from the manager of [redacted] saying he only has to pay $480. That letter is dated 2009 and was an offer due at the time of move-out before being turned over to collections. Since the $480 was never paid at move-out, the entire balance was turned over to Genesis for collections. On November 6, client services for Genesis called [redacted] and verified there is no settlement offer and the full balance was due and they were not willing to settle at all. We tried to explain the account is past statute of limitations but they still don't want to settle. We at Genesis then attempted to offer a 50% settlement with Mr. [redacted] but he was unwilling to cooperate. He also complains that we are showing up on his credit report for the full balance owed of $2155.00 plus interest. We have this account in Statute status and have been credit reporting that it is statute since August 2014 with a zero balance. We are not attempting to collect this debt because it is statute. Mr. [redacted] called in wanting to resolve but his offer cannot be accepted by us or by [redacted] because it is too low.

Revdex.com,

I have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.

[To assist us in bringing this matter to a close, we would like to know your view on the matter.]

Dear [redacted]:

Attached please find the settlement statement I received from [redacted], the client of Genesis Credit Management (GCM), indicating that he was willing to negotiate my final pay-off balance. I am proposing a counter offer to [redacted]'s original proposal, but am having no luck in even reaching him or anyone with [redacted].

I have already submitted a claim against [redacted] through the Snake River chapter of the Revdex.com, but they were unsuccessful in working with them either. I am also attaching a copy of the letter I received from them.

I am currently a property manager at my current employment and I have been in front of a judge on several occasions and I know what charges I should pay and which ones are trumped up as per the "industry" (i.e., late fees). My offer of $480.00 is a reasonable offer and I wish to make amends with my original creditor, but they have proven themselves to be impossible to work with. My last hope was to get help from GCM, but their efforts have been to no avail. If I can't get any remedy through this avenue then I have come to my wits end on how to resolve this.

I look forward to any help or advice you may offer in this matter.

Sincerely,

Regards,

Business

Response:

The document Mr. [redacted] has provided is the same statement we have that gives the breakdown of the charges owed totaling $2,155.00. At the bottom of the statement it does reflect a settlement offer of $480. Again, this is from 2009 and the offer was made at the time of move out. Since the $480 was never paid at the time of move out, the entire balance was turned over for collections. We at Genesis did contact [redacted] again on 11-18-14 and found out that the new manager in charge of their collection accounts has agreed to accept the $480 if Mr. [redacted] still wants to pay. Again, this account is passed statute of limitations and we have been credit reporting statute with a zero balance. Please let me know if we can be of any further assistance, thank you

Revdex.com,

I have reviewed the response made by the business in reference to complaint ID [redacted] and find that this resolution is satisfactory to me.

I accept the offer to settle my collection debt with Genesis Credit Management for the amount of $480.00. Please have them send me a statement showing the new balance due. The statement can be mailed to:

[redacted], Idaho [redacted]

I would like to thank you and everyone at GCM for helping me get this matter resolved after five years.

Regards,

Review: They continue to harrass my work place for debt that is not my debt. They call my corporate office asking for me through a phone number of my companies that I did not know existed and even after telling them they have contacted the wrong person they continue to harrass the people working from the corporate office of my company.Desired Settlement: I do not want them calling me and especially my company, when these types of things can possibly affect my companies outlook of myself.

[redacted],

This is in response to case # [redacted], [redacted] against Genesis Credit Management. We are a third party collection agency with limited skip tracing tools. The information provided to us did not indicate the [redacted] we are looking for was a **. When we skip trace to try to find someone we call the phone numbers that are provided based on the name search. We found an employment number for [redacted] and called it twice. The first time we called [redacted] rudely hung up on us so it was not confirmed that the [redacted] we were looking for didn't work there. 12 days later we tried again and spoke with [redacted] who confirmed his father does not work at that location.

Mr. [redacted] says in his complaint that we "continue to harass his work place and continue to harass the people working from the corporate office of his company." We have called him twice in 2 weeks because the first time he hung up on us. I don't believe 2 phone calls in 2 weeks is considered harassment. I also do not believe calling a number and asking to be transferred to someone is considered harassment of the people working for the company either. We have updated our information and noted the file that the phone number we have is not good and will not call Mr. [redacted] again. If you need anything further please let me know, thank you,

Review: On Wednesday 11/13/2013 I received a call from [redacted]. [redacted]. She informed me that she was calling to collect a debt. After telling me who it was for and the amount I informed her I would be happy to pay if I did in face owe a debt. After asking my address I did notify her it had changed and I had not received any documentation on the debt. She informed me that because the mail wasn't returned from the address that I had in fact received the paperwork and had obviously ignored it. She then asked me to pay and I said that I could set up a payment for next month and then pay the rest at the beginning of the year. She asked my job status, hours I worked, and whom I was living with. I am a single mom so I live with my parents at this time until I can get back on my feet after my divorce. She was very rude and asked why I couldn't pay my debt if I was obviously paying little to no rent and even on minimum wage could have. I explained I had other bills and two kids. I admit after the harassing through the duration of the call that I did get rude back. As soon as I did she informed me that she was going to mark my file as refusal to pay and that I had just burned a bridge with her. I asked that she mail me the documentation and if in fact I owed I would be happy to pay and also added that she had mentioned it was a recorded call, if this was in fact truth they would be able to hear that I had not refused to pay. She refused to send me documentation and said that it was too late and she was filing legal action against me, then hung up. I called back to ask to speak to a manager, she put me on hold for a couple of seconds and got back on acting like she was someone else. I asked again to speak to a manager and informed her I knew it was still her. She then became rude again and said she was the manager. I asked her for the company she worked for and she refused to tell me the name of it. I again asked her to mail me documentation and she again refused and hung up on me.Desired Settlement: This is more for your information. She broke several consumer laws in this conversation and has continued to try and call me. I have also found complaints against them not only from me. I would like to know if she is in fact from an agency and or if this is a scam. I do not want another consumer to go through this abuse and or for it to be a scam and have someone taken advantage of.

Response:

We at Genesis Credit Management do in fact record our calls and I listened to both calls referenced in this complaint. I believe this complaint was started from anger for almost the entire comlaint is untrue. [redacted] claims the collector she was dealing with, [redacted], was harassing her therefore she became rude. After listening to the call [redacted] was very professional, never raised her voice and was simply explaining the options, laws, payment options and how she could help her get on small monthly payments and [redacted]'s response was "you don't have to be such a bh." Once a consumer starts yelling and using profanity then yes the collector has every right to not offer arrangements and terminate the call, the "verbal abuse" goes both ways. [redacted] claims she did not "refuse" to pay, however she was not willing to make a payment in November or secure an amount or payment date for December and never offered to pay the balance in January. [redacted] then claims [redacted] refused to send her documentation and said "that it was too late and she was filing legal action against her." This is in fact completely untrue. I personally listened to this converstation and not once did [redacted] discuss starting legal action against her. [redacted] then claims she asked for the name of the copmany and she refused to tell her the name of it. Again completely untrue. It is on a recorded line when she asked the name of the company she was told Genesis Credit Management. [redacted] did ask for proof and per the FDCPA we are only required to send proof in the first 30 days of collections. We have had this account in our office since June and she was not disputing the balance or questioning the amount due.

In the desired settlement section [redacted] claims [redacted] broke several consumer laws in this conversation, however I don't believe [redacted] knows all the laws and how they work and since [redacted] has never said "do not call me again" there is no reason for us to stop trying to get in communication with her to resolve this and set up arrangements. She wants to know if we are a scam because she has found other complaints on our company, well we are collection agency so naturally there would be other complaints and we are not a scam. [redacted] explained we have placed this account on her credit report, how could we put something on her credit report, for an apartment she knows and admitted to living in, if we were not a valid company? Also under complaint background [redacted] said we wouldn't give out the account number, she never asked for it. There are several claims against Genesis Credit Management in this complaint that are false. Like you said in your letter, there are two sides to each story and lucky for us we records our conversations to be able to prove this complaint against us is false. If you need any further information please feel free to call, thanks

No one enjoys receiving a phone call from a collection agency. The initial reaction is to become defensive and argue fiercely. At least, that is how I responded when I received a call from [redacted].. Though I am not thrilled about having to pay an outstanding balance – I believe her customer service and patience should be noted.. She carefully walk me through the cause of the charges, and explained multiple solutions as to how I may avoid similar fees in the future. Thank you [redacted]!

Review: We had a horrible experience with this company via three phone calls on November 24, 2015, in which they tried to harass and intimidate us into paying that day $717.46 that we simply needed further information about. We did not agree with the charge made against us from a property management company. They refused to answer our questions, told us "we were irresponsible, they questioned our integrity, and wondered what kind of people we were." They told us they would report us to collections immediately if we did not pay it then. However the document they sent us dated November 12, 2015, states we have 30 days to write them a written dispute. When we repeated that back to them they got angry and hostile and insisted we only had until December 1st or they would essentially "ruin our credit and we would never be able to rent again." This was a contradiction to what they sent us IN WRITING.Desired Settlement: We would simply like further explanation of the cost of the charges made against us from the property management company, as we only received a vague list with no explanation, descriptions, or individual costs and we had already paid a $1200 deposit and paid our rent faithfully every month. I spoke to the Property Management company yesterday as well, and they told us they would be happy to give us those answers but that it must go through Genesis Credit Management legally. She encouraged us to write them a letter of dispute in which they in turn would send to her. GCM also stated in their letter to us that we had 30 days to do that in which "their office will obtain verification of the debt." However when we called them back to tell them that, they got angry and mad and told us there was ZERO chance of that happening or helping and threatened to report us on December 1st if we did not pay the full amount by then. We are simply trying to write a dispute against the charges so we can make sure we are getting charged a fair and accurate price. They told us we were not allowed to do that (a contradiction to their letter.)

Response:

This is in response to complaint ID [redacted]. I personally listened to the recorded conversations that took place on this account and a breakdown of the charges was provided per request and there was a payment made to settle the account. This account has been settled in full for $555 on 12-11-15 and was never reported to any credit bureaus.

Review: This company is refusing to issue any documentation about the debt they are collecting on. I have issues with their credibility if they won't comply to this simple request. They have agreed to a payment plan to resolve the debt, but will not provide documentation to the agreement for the repayment plan, either.Desired Settlement: A printed statement from the company that they are representing the original provider of service, as well as documentation of payment receipt and the repayment plan that was agreed to.

Consumer

Response:

Thank you for investigating this for me. I'm just looking for physical documentation of our interactions and agreements.

Business

Response:

To whom it may concern,This is in response to case ID [redacted]. If someone makes a payment we can provide a receipt letter so they have a receipt for the payment made for their records and if they pay the balance in full we can provide a letter stating the balance is paid in full. However, we at Genesis Credit Management have a company policy where we do not supply letters that break down a verbal payment plan agreement. Mr. [redacted] has made a monthly $20 payment February 2015 through May 2015 and has now defaulted on his payments due to not receiving this letter. If he would like proof of the debt owed we can certainly mail that to him so he knows the breakdown of the charges for the bill that he has already been paying on. We are a very credible company and can comply with most requests that our consumers have in order to make them feel more comfortable in paying their debts to us, however we just do not supply payment plan letters. Thank you,[redacted]

Review: Company is trying to collect a non-valid debt I have disputed. I disuputed the debt 5 days after I received the collection notice and wrote a letter as well as sent a picture to backup the fact that we cannot be charged tor new carpeting in the apartment we used to be in. We are not responsible for the previous tenants damage. I disupted it and also asked for the debt to be validated. Never received a response and due to unfair colleciton practices and going against secion 809 of te FCRA and not validaing the debt, they are in non-cmpliance of the act. They also are reporting it on my credit report which they legally cannot do when they don't validate the disputed debt. They are in violation and I want it removed from all credit reports. I will sue them and due to the violaiton they will have to pay $1000 for reporting a non-validated debt and will go that route if I have to.Desired Settlement: Remove disputed debt and non-validated debt from credit report or will have to go to court.

Business

Response:

We received a dispute letter from [redacted] on 2-3-16 and mailed proof to her last known address as requested. We have also contacted our client for additional documentation to support this debt and since we have not gotten a response we went ahead and removed the account from Ms. [redacted]'s credit report.

Consumer

Response:

Revdex.com,

I have reviewed the response made by the business in reference to complaint ID [redacted] and find that this resolution is satisfactory to me in regards to removing disputed debt from my report. I have already filed a small claims suite, but will not need to push this part of the complaint. I will still have to move forward with the 2nd part of the issue that they are in violation of 3 Fair Debt Collections rules.
