Febuary 3, Dear Representative [redacted] ***, I appreciate you reaching out to me regarding this complaint, [redacted] , affording us an opportunity to respond.If we were hired to complete extensive landscape improvements, with the ultimate objective of expanding [redacted] 's functional rear yard areaA large part of which was to remove and replace an existing wall and steps that had been installed and failed, by previous contractorWe agreed to new [redacted] wall block material and used [redacted] recommended installation processesAll work was given a five year warranty, as recommended by the [redacted] RepresentiveThe work was completed in August, 2008.The following spring, some issues began to appear as a result of hydraulic pressure from above the wallI contacted the [redacted] Representative to be sure our plan for correction might solve the problemWe were informed that as a result of uncommon weather conditions, of snow over the winter, the original recommendations given could not be expected to hoand [redacted] was thus not responsible for any results or damages as a result of hydraulic pressureWe/I did more research to determine what might be the best solutionWhen that solution was found, it was repairedAnother issue arose as a result of additional hydraulic pressureI again went to the [redacted] Rep, who was at this point, was interested in the issues and willing to make current recommendationsWe followed those recommendations and made the repairsAgain, more issues developed as a result of more water movement/pressureAdditional repairs were madeWe had been out on five occasions to make repairsThe last repair we made included removing the entire upper wall along with cubic feet of soil, transplanting shrubs, rebuilding the wall and replacing all of the soil with compacted stone to take away any possible water pressure from behind the wallIn essence, put one ton stone behind the wall, all at the recommendation of the [redacted] representativeThe water issue moved over 18' to the upper stairsAt this point, it was determined that a structural engineer would be needed to develop a proper solutionI made [redacted] aware of this, He indicated to he was not interested in putting any additional money into this project.We have been putting extensive amounts of money into this projectAlthough we are well beyond the five warranty period, we truly would like to see a solution to this situationWe believe we acted as we should have [redacted] was not charged for a professionally engineered wallI will not get into the specifics of the original negotiations, but I will say they went heavily in [redacted] 's favorAs a result of hearing from you at the Revdex.comI have contacted the Wali Professional at E.P.HenryBecause they have since changed the specifications for recommended wall materials for walls of this magnitudeI had requested that E.P.Henry replace all wall material to meet the new specifications if the home owner agreed to pay for the engineeringI would supply the labor necessary to complete the project as prescribed, with any additional or prescribed costs, as a function of the engineering, to go to [redacted] That might be one possible solutionIt may or may not be feasibleWe have exhausted any profits we may have received from this project long agoWe have financed much of these repairs ourselvesFortunately or unfortunately, I live right around the corner from [redacted] , in the same neighborhoodWe see each other around townWe see each other at church.I believe it is in everyone's best interest to resolve this issueNo one, including the local township had any idea of the water related issues or soil settling problems that would occur in this newly developed neighborhood(The township has made numerous repairs in this particular neighborhood and are continually monitoring this immediate area for new issues that do consistently pop up.)I understand that the Revdex.com is not here to act as a jury or mediation authorityIf you believe we are wrong, please let me knowI do anxious await your responseSincerely,Eugene L

functional rear yard area. A large part of which was to remove and replace an existing wall and steps that had been installed and failed, by previous contractor. We agreed to new [redacted] wall block material and used [redacted] recommended installation processes. All work was given a five year warranty, as recommended by the [redacted] Representive. The work was completed in August, 2008.The following spring, some issues began to appear as a result of hydraulic pressure from above the wall. I contacted the [redacted] Representative to be sure our plan for correction might solve the problem. We were informed that as a result of uncommon weather conditions, 90 of snow over the winter, the original recommendations given could not be expected to hold-up and [redacted] was thus not responsible for any results or damages as a result of hydraulic pressure.
We/I did more research to determine what might be the best solution. When that solution was found, it was repaired. Another issue arose as a result of additional hydraulic pressure. I again went to the [redacted] Rep, who was at this point, was interested in the issues and willing to make current recommendations. We followed those recommendations and made the repairs. Again, more issues developed as a result of more water movement/pressure. Additional repairs were made. We had been out on five occasions to make repairs. The last repair we made included removing the entire upper wall along with 600 cubic feet of soil, transplanting shrubs, rebuilding the wall and replacing all of the soil with compacted stone to take away any possible water pressure from behind the wall. In essence, put one 25 ton stone behind the wall, all at the recommendation of the [redacted] representative. The water issue moved over 18' to the upper stairs. At this point, it was determined that a structural engineer would be needed to develop a proper solution. I made [redacted] aware of this, He indicated to he was not interested in putting any additional money into this project.We have been putting extensive amounts of money into this project. Although we are well beyond the five warranty period, we truly would like to see a solution to this situation. We believe we acted as we should have. [redacted] was not charged for a professionally engineered wall. I will not get into the specifics of the original negotiations, but I will say they went heavily in [redacted]'s favor.
As a result of hearing from you at the Revdex.com. I have contacted the Wali Professional at E.P.Henry. Because they have since changed the specifications for recommended wall materials for walls of this magnitude. I had requested that E.P.Henry replace all wall material to meet the new specifications if the home owner agreed to pay for the engineering. I would supply the labor necessary to complete the project as prescribed, with any additional or prescribed costs, as a function of the engineering, to go to [redacted].
That might be one possible solution. It may or may not be feasible. We have exhausted any profits we may have received from this project long ago. We have financed much of these repairs ourselves. Fortunately or unfortunately, I live right around the corner from [redacted], in the same neighborhood. We see each other around town. We see each other at church.I believe it is in everyone's best interest to resolve this issue. No one, including the local township had any idea of the water related issues or soil settling problems that would occur in this newly developed neighborhood. (The township has made numerous repairs in this particular neighborhood and are continually monitoring this immediate area for new issues that do consistently pop up.).
