At this point in time, we have no way of knowing if the earrings Ms. [redacted] has in her possession are the same ones we sold to her. However, we can assure her that we inspect our jewelry regularly for quality and there have been no issues. Furthermore, Ms. [redacted] only had 90 days to return her merchandise if dissatisfied. That point in time has long since passed. We want to note that even if Ms. [redacted] had returned the earrings in that time frame, she would not have been provided with a refund for what she paid, not the retail price or value of the items. We are not obligated to provide Ms. [redacted] with anything as we have pointed out, but we are willing to send her a check for what she paid as a courtesy. We have Mr. [redacted]’s complaint and we apologize that we failed to meet his expectations. As Mr. [redacted] mentioned in his complaint, he had previously filed a Revdex.com complaint regarding the same issue. On March 1, 2016 we investigated and informed Mr. [redacted] that District Manager Mr. Masaryk has called the National Customer Relations (NCR) when this issue has happened and with Mr. [redacted] present. NCR confirms that everything is ok; however, the registers won't read the check. Mr. Masaryk advised that the checks are being denied by the electronic check clearing house in Florida. The registers will not read the checks, this is a system issue and there is nothing that can be done when the registers don't sync.
We would also like to note on February 24, 2016 Mr. [redacted]’s concern was also addressed by our Executive Member Support team and was provided the above information and, as a one-time offer, he was issued $100 Shop Your Way Reward points for his inconvenience. While we understand that he is dissatisfied that the store was unable to cash his qualified check, the fact remains that on several occasions we made Mr. [redacted] aware that this is an intermittent problem and the issue has nothing to do with the store or the associates. With that being said, since we have addressed the issue brought forth in Mr. [redacted]’s complaint, we have closed our file.

Upon receiving Mr. M[redacted] complaint, we reached out to him to provide documentation of the duplicate charge. Mr. M[redacted] complied and he advised that he had filed dispute with his credit card company. We subsequently explained to Mr. M[redacted] that since he disputed the charge with his credit card company, we are not able to process a refund. His credit card company should be able to see that the charge was processed twice and issue a credit; however, if for some reason the credit card company declines the chargeback, we would process a refund after confirming that no credit was issued to his account. Mr. M[redacted] can respond to Melissa.L[redacted] for further assistance if his chargeback is declined. As to Mr. M[redacted] concerns with the quality of the part that was replaced, we would like to clarify that his range was manufactured by [redacted] under the Kenmore branding, as Sears does not manufacture any products. Furthermore, at the time that [redacted] modified the bake burner, the manufacturer’s warranty on Mr. M[redacted] had already been expired for nearly two years, which means that he had no coverage in place to cover the cost of parts or labor. Lastly, the service bulletin that was issued in February of 2017, simply explained that a new bake burner was available and it has been improved so that the burner flames would be more even. This means that if the part failed, the new style of bake burner would be installed; however, since the part was only modified to improve the performance of the range and not to address a safety issue, the normal repair costs apply. Therefore, Mr. M[redacted] is not entitled to a refund for his range repair. In summary, since we have addressed Mr. M[redacted] concerns with the charges for his range repair, we have closed our file. [redacted] Perhaps you should discuss this with the sales person who obviously misrepresented the product. I was not told anything about a dollar for dollar replacement. His name is [redacted] from the Greenville NC Sears store. I was uneasy about the purchase because of the price reduction. I was assured that Sears had checked out the [redacted] dishwasher and there was no need for concern. I was told if there were any problems I should call Mr Wright. He gave me his card. I called several times. No response to any of my voicemails. Also the technician was told the information about the sale. I explained all of the information to the Sears technician. How is it that the response from Sears presumes to know what we've been through in our experience from the sale of the dishwasher to the information shared during the 4 visits from the technician. I regret that I believed the Sears salesperson our family has bought appliances from Sears prior to this experience. We will not do this again nor we will recommend Sears to anyone.

I am rejecting this response because: I can't believe Sears is willing to LOSE a longtime customer and not refund a $27 item that I CANNOT USE, all because I was THREE DAYS outside the "30 day" return period. Again, I have an electronic receipt (which was sent to my email) showing my purchase. And finally, SEARS certainly DID NOT widely publicize the fact that they had adopted such a STRICT and INFLEXIBLE refund policy. Had I know this was so, I would have been diligent in returning the item as soon as possible. Seeing how inflexible Sears is in dealing with its customers, neither I nor my family will ever shop there again.

I called the 800 number on the back of a sears cards, and was told I have a zero balance. But the automated system also said the info given me did not reflect other charges. I hope I do not have to go through anything else with Sears.., like them adding a restocking fee after I filed with the Revdex.com for their conduct. Should that occur, I will indeed inform you. to return Christmas seasonal items for a refund.
As clarification, our ''hassle-free returns and exchanges'' are based upon returns and exchanges within the parameters of our stated refund and exchange policy. As Ms. [redacted] mentioned in her complaint, the copy of the receipt provided clearly states the following: Most items have a return policy of 30 days from purchase but may vary by item. However, it also states, “Restrictions Apply. See Sears.com, signs posted at registers, or an associate for details”. Mr. [redacted] could have followed the instructions on the receipt to review the policy posted at the registers, online or simply asked an associate for details. It is a consumer’s responsibility to become familiar with a retailer’s return policy. With that being said, the Sears return policy states “Christmas season items cannot be returned after December 25. Christmas items purchased after December 25 are final sales and cannot be returned.” Since the items Ms. [redacted] received are Christmas décor items and were purchased on December 3, 2016, then they must be returned with a receipt on or before December 25, 2016.
We would like to note that nationwide our stores have been applying the policy without exceptions for any consumers since it was unfortunately abused for so long we needed a radical course correction. It would not be fair to make an exception for Ms. [redacted], when no one else has received one. Ms. [redacted] indicated that she was not offered an option for an in-store credit, but that is precisely what we mean when we say we are not making exceptions; there are no options available. Accordingly, as we were just adhering to our posted return policy, we are unable to honor Ms. [redacted] request.

pair of pants after the 30-day return period had expired.
As clarification, Sears does have a 30-day Satisfaction Guarantee period on most items. A customer has 30 days from the date of the original purchase to make a return, with some exceptions listed on our return policy. Our return policy is available online at Sears.com, posted at the registers in our stores or a consumer can ask an associate for details at the time of purchase. It is the consumer’s responsibility to acquaint themselves with a retailer’s return policy; particularly for a small appliance purchase.
Since [redacted] pants were purchased on December 31, 2015 and he attempted to exchange/return the pair of pants on May 1, 2016, he was clearly over the 30-day “hassle-free” return or exchange period. We would also note that most retail stores set parameters on the time frame that merchandise can be returned since it can always be difficult to sell items well past the season they were offered and Sears is no different. Accordingly, as we were just adhering to our posted return policy, we are unable to honor [redacted] request.

I am rejecting this response because: I believe the letter is far to vague. It does not reflect specifically indicate what the problem is with the air conditioner unit and the steps that must be taken in order to resolve the problem. I do not want to continue to be in this situation that Sears will not complete the work needed to repair or replace my air conditioner. This is the basis of the original complaint. Sears has failed to be responsive and follow up on the problems identified with my air conditioner unit made by their own technicians. So far they have successfully delayed the situation that it is now too cold to run the air conditioner. I would like the letter to reflect the past actions that Sear failed to follow up on and to provide a more directive in describing the action that must be taken to address the findings they already have on record of the documented problems described by their technicians.

As clarification, some time ago our online website began hosting other retailers through our Sears Marketplace program. The goal of our marketplace is to provide items that might not be available through our own online channels, so that we become a “one-stop” online shopping destination. With that said, each vendor is responsible for the merchandise displayed and for providing customer support for any of their orders. Each vendor has their own return policies as well.
Our records indicate that Mr. [redacted] placed his online order for the garbage disposal with [redacted], a marketplace vendor. The vendor’s return policy for the garbage disposal was listed online for Mr. [redacted] review prior to his purchase. It states “Hassle-free returns: 14 days money back, buyer pay return shipping and 15% restocking fee. Original shipping cost is not refunded. Returns must be in the original manufacturer box, with all content, including all paperwork. Items returned without "Return Merchandise Authorization" (RMA) will not be refunded.
Mr. [redacted] received the garbage disposal on May 25, 2016 and discovered that it did not fit his kitchen. On June 16, 2016 Mr. [redacted] contacted us and requested to return the product. He was informed of the restocking fee and that he would be responsible for the return shipping cost. A request for an RMA was sent to the vendor for the return. Upon receipt of Mr. [redacted] complaint, we reached out to [redacted] regarding the return. [redacted] replied that the return is considered a customer error, not theirs. [redacted] will accept the return and for customer satisfaction, they will provide a return shipping label at no cost to Mr. [redacted]. However, the 15% restocking fee will be applied. Mr. [redacted] accepted the offer and a return shipping label was emailed on June 27, 2016. A refund, less the restocking fee, will be issued to Mr. [redacted] upon receipt of the garbage disposal. In the interim, since we have addressed the issue brought forth in Mr. [redacted] complaint, we have closed our file.

We have Mr. [redacted]’s complaint and we apologize that we failed to meet his expectations. As Mr. [redacted] mentioned in his complaint, he had previously filed a Revdex.com complaint regarding the same issue. On March 1, 2016 we investigated and informed Mr. [redacted] that District Manager Mr. Masaryk has called the National Customer Relations (NCR) when this issue has happened and with Mr. [redacted] present. NCR confirms that everything is ok; however, the registers won't read the check. Mr. Masaryk advised that the checks are being denied by the electronic check clearing house in Florida. The registers will not read the checks, this is a system issue and there is nothing that can be done when the registers don't sync.
We would also like to note on February 24, 2016 Mr. [redacted]’s concern was also addressed by our Executive Member Support team and was provided the above information and, as a one-time offer, he was issued $100 Shop Your Way Reward points for his inconvenience. While we understand that he is dissatisfied that the store was unable to cash his qualified check, the fact remains that on several occasions we made Mr. [redacted] aware that this is an intermittent problem and the issue has nothing to do with the store or the associates. With that being said, since we have addressed the issue brought forth in Mr. [redacted]’s complaint, we have closed our file.

Upon receiving Mr. M[redacted] complaint, we reached out to him to provide documentation of the duplicate charge. Mr. M[redacted] complied and he advised that he had filed dispute with his credit card company. We subsequently explained to Mr. M[redacted] that since he disputed the charge with his credit card company, we are not able to process a refund. His credit card company should be able to see that the charge was processed twice and issue a credit; however, if for some reason the credit card company declines the chargeback, we would process a refund after confirming that no credit was issued to his account. Mr. M[redacted] can respond to Melissa.L[redacted] for further assistance if his chargeback is declined. As to Mr. M[redacted] concerns with the quality of the part that was replaced, we would like to clarify that his range was manufactured by [redacted] under the Kenmore branding, as Sears does not manufacture any products. Furthermore, at the time that [redacted] modified the bake burner, the manufacturer’s warranty on Mr. M[redacted] had already been expired for nearly two years, which means that he had no coverage in place to cover the cost of parts or labor. Lastly, the service bulletin that was issued in February of 2017, simply explained that a new bake burner was available and it has been improved so that the burner flames would be more even. This means that if the part failed, the new style of bake burner would be installed; however, since the part was only modified to improve the performance of the range and not to address a safety issue, the normal repair costs apply. Therefore, Mr. M[redacted] is not entitled to a refund for his range repair. In summary, since we have addressed Mr. M[redacted] concerns with the charges for his range repair, we have closed our file. His name is [redacted] from the Greenville NC Sears store. I was uneasy about the purchase because of the price reduction. I was assured that Sears had checked out the [redacted] dishwasher and there was no need for concern. I was told if there were any problems I should call Mr Wright. He gave me his card. I called several times. No response to any of my voicemails. Also the technician was told the information about the sale. I explained all of the information to the Sears technician. How is it that the response from Sears presumes to know what we've been through in our experience from the sale of the dishwasher to the information shared during the 4 visits from the technician. I regret that I believed the Sears salesperson our family has bought appliances from Sears prior to this experience. We will not do this again nor we will recommend Sears to anyone.

And finally, SEARS certainly DID NOT widely publicize the fact that they had adopted such a STRICT and INFLEXIBLE refund policy. to return Christmas seasonal items for a refund.
As clarification, our ''hassle-free returns and exchanges'' are based upon returns and exchanges within the parameters of our stated refund and exchange policy. As Ms. [redacted] mentioned in her complaint, the copy of the receipt provided clearly states the following: Most items have a return policy of 30 days from purchase but may vary by item. However, it also states, “Restrictions Apply. See Sears.com, signs posted at registers, or an associate for details”. Mr. [redacted] could have followed the instructions on the receipt to review the policy posted at the registers, online or simply asked an associate for details. It is a consumer’s responsibility to become familiar with a retailer’s return policy. With that being said, the Sears return policy states “Christmas season items cannot be returned after December 25. Christmas items purchased after December 25 are final sales and cannot be returned.” Since the items Ms. [redacted] received are Christmas décor items and were purchased on December 3, 2016, then they must be returned with a receipt on or before December 25, 2016.
We would like to note that nationwide our stores have been applying the policy without exceptions for any consumers since it was unfortunately abused for so long we needed a radical course correction. It would not be fair to make an exception for Ms. [redacted], when no one else has received one. Ms. [redacted] indicated that she was not offered an option for an in-store credit, but that is precisely what we mean when we say we are not making exceptions; there are no options available. Accordingly, as we were just adhering to our posted return policy, we are unable to honor Ms. [redacted] request.

pair of pants after the 30-day return period had expired.
As clarification, Sears does have a 30-day Satisfaction Guarantee period on most items. A customer has 30 days from the date of the original purchase to make a return, with some exceptions listed on our return policy. Our return policy is available online at Sears.com, posted at the registers in our stores or a consumer can ask an associate for details at the time of purchase. It is the consumer’s responsibility to acquaint themselves with a retailer’s return policy; particularly for a small appliance purchase.
Since [redacted] pants were purchased on December 31, 2015 and he attempted to exchange/return the pair of pants on May 1, 2016, he was clearly over the 30-day “hassle-free” return or exchange period. We would also note that most retail stores set parameters on the time frame that merchandise can be returned since it can always be difficult to sell items well past the season they were offered and Sears is no different. Accordingly, as we were just adhering to our posted return policy, we are unable to honor [redacted] request.

I am rejecting this response because: I believe the letter is far to vague. It does not reflect specifically indicate what the problem is with the air conditioner unit and the steps that must be taken in order to resolve the problem. I do not want to continue to be in this situation that Sears will not complete the work needed to repair or replace my air conditioner. This is the basis of the original complaint. Sears has failed to be responsive and follow up on the problems identified with my air conditioner unit made by their own technicians. So far they have successfully delayed the situation that it is now too cold to run the air conditioner. I would like the letter to reflect the past actions that Sear failed to follow up on and to provide a more directive in describing the action that must be taken to address the findings they already have on record of the documented problems described by their technicians.

As clarification, some time ago our online website began hosting other retailers through our Sears Marketplace program. The goal of our marketplace is to provide items that might not be available through our own online channels, so that we become a “one-stop” online shopping destination. With that said, each vendor is responsible for the merchandise displayed and for providing customer support for any of their orders. Each vendor has their own return policies as well.
Our records indicate that Mr. [redacted] placed his online order for the garbage disposal with [redacted], a marketplace vendor. The vendor’s return policy for the garbage disposal was listed online for Mr. [redacted] review prior to his purchase. It states “Hassle-free returns: 14 days money back, buyer pay return shipping and 15% restocking fee. Original shipping cost is not refunded. Returns must be in the original manufacturer box, with all content, including all paperwork. Items returned without "Return Merchandise Authorization" (RMA) will not be refunded.
Mr. [redacted] received the garbage disposal on May 25, 2016 and discovered that it did not fit his kitchen. On June 16, 2016 Mr. [redacted] contacted us and requested to return the product. He was informed of the restocking fee and that he would be responsible for the return shipping cost. A request for an RMA was sent to the vendor for the return. Upon receipt of Mr. [redacted] complaint, we reached out to [redacted] regarding the return. [redacted] replied that the return is considered a customer error, not theirs. [redacted] will accept the return and for customer satisfaction, they will provide a return shipping label at no cost to Mr. [redacted]. However, the 15% restocking fee will be applied. Mr. [redacted] accepted the offer and a return shipping label was emailed on June 27, 2016. A refund, less the restocking fee, will be issued to Mr. [redacted] upon receipt of the garbage disposal. In the interim, since we have addressed the issue brought forth in Mr. [redacted] complaint, we have closed our file.
