that she had seen a mouse, and we immediately called [redacted] ([redacted]) to schedule an inspection.  On 11/09/16 [redacted] conducted an inspection of Ms. [redacted]’ apartment and told us they found no evidence of mice.  However, [redacted] did lay glue traps throughout her apartment.  Our maintenance supervisor, [redacted], went with another maintenance man, [redacted], to inspect Ms. [redacted]’ apartment and neither could find any evidence of mice.  They did find one small hole in her bathroom and made the necessary repairs to fix it.  On 11/14/16 Ms. [redacted] called the Rental Office complaining of seeing mice again and [redacted] was called to come back out to do a second inspection of her apartment.  On 11/15/16 [redacted] did a second inspection, and again, found no signs of mice.  The written service report given to us by [redacted] for the second inspection stated “Cluttered living conditions throughout the apartment make it almost impossible to control mice.  Placed glue boards in kitchen and laundry, no activity was found.”  (Copy attached)Ms. [redacted] stated in her complaint that [redacted] had told her at the first inspection that “several openings were found”.  We contacted [redacted] in regards to these findings and they told us that they have no record of stating that to Ms. [redacted] in their notes, nor does the technician recall telling Ms. [redacted] that they found any openings.  Perhaps there was a misunderstanding and the technician was just speaking of how mice gain access in general.  In any case, we are more than willing to repair and/or fill in any holes or openings that may allow access for mice but our maintenance staff and [redacted] cannot find any additional openings other than the one that was discovered and repaired in the bathroom.  The property manager, [redacted], has tried on several occasions to reach Ms. [redacted] by phone to discuss the situation with her, but was unsuccessful.  On 11/21/16 the maintenance supervisor went to Ms. [redacted]’ apartment and asked her to show him where the holes and/or openings are and she stated “That’s between you and [redacted], you need to take that up with them.”  On 11/21/16 [redacted] called Ms. [redacted] again to discuss the situation with her, and again, she did not answer and did not return [redacted]’s call. After conducting numerous inspections of Ms. [redacted]’ apartment by our staff and [redacted] with no signs of mice, and after repairing the one hole in the bathroom that was found when inspecting her apartment, we feel that this issue has been resolved at this time. We would like to set her mind at ease about that. Neither the rental office, nor the main office had any idea that the owner would call on November 3, 2016 and start a special. That is the date the owner notified us and the leasing office.Ms. [redacted] stated that she applied early, but wasn't planning on moving in until the end of November. It is a normal process to apply in advance, as the application and holding fee reserves the apartment for the applicant until they move in. If Ms. [redacted] had not applied in advance, the apartment would probably not have been available for rental.Unfortunately, we are unable to give Ms. [redacted] the special that began after she turned in her application for rental. As stated in the advertisement on our website, the special for $150.00 off the first months rent is for new applicants only”. If we allowed Ms. [redacted] the benefit of the special, it would actually violate what we put in our advertisement and we would have to give it to all of the other applicants that applied prior to the beginning of this special. Therefore, we cannot give the special to any of the applicants that put their application in prior to November 3, 2016, the beginning date of the special.Again, we do appreciate Ms. [redacted]’s business and look forward to her continued residency with Applegate Farm Apartments and hope that she can understand our position in this matter.Respectfully,[redacted] Applegate Farm, LLC

Our business procedure is to pull up the carpet and inspect for any pet damage in every apartment when a tenant vacates. The carpet was pulled up and inspected in [redacted] before and after Ms. [redacted]’s occupancy by the same maintenance man. We keep a “carpet...

hold” document with every tenant’s file after they vacate. It was noted on the carpet hold of the previous tenant of [redacted] that there was “no pet damage” to the carpet. After Ms. [redacted] vacated, the carpet was pulled again and there were pet damage stains on the back of the carpet along with a strong pet urine smell in the carpet and padding. The red stains Ms. [redacted] refers to in her complaint were noted on her move-in inspection and was not the reason the carpet was replaced. Most surface stains can be removed by our professional carpet cleaners, however, the smell of pet urine in carpet and padding is extremely difficult, if not impossible to remove. The carpet located at [redacted] did not have pet damage before Ms. [redacted]’s occupancy.

This response does not satisfy me because the fact remains that I did not, and do not, own a pet. I do not know how this "urine smell" got there because I never once had an animal in the apartment. Ms. [redacted] also stated that the carpet for [redacted] was not pulled up prior to my.move in, and that it was only deeply cleaned. As I have not seen the documentation of proof that it was pulled up that is now claimed to be owned, I stand by my belief that the resident prior to my move in caused this pet damage. 
 
I will not pay $399 for damage I did not cause.
