Yours truly,[redacted] [redacted] [redacted] Termite Control

I sent George Webb an estimate and demand for payment for $16,400. If he wants to negotiate on that I would be willing to see what we could work out. There are also attorney fees, inconvenience fees, and time from work fees, which are involved which I have not yet included in any bills as of yet. I want to get this work done ASAP as we are without use of our home which we bought in this condition based on his inspection.
The entire roman tub needs to be removed as the hot mop and pan is cracked and needs to be replaced. this entails going a minimum of 6" above the top of the tub ridge and over any and all steps. All new tiles must match. Water fixtures may need to be replaced to conform with code. This needs to be completed per code.
The wall between the bathroom and bedroom needs to be removed and replaced due to rot within the wall.
The subfloor needs to be removed and replaced due to rot.
floor joists need to be removed and replaced due to rot.
The toilet needs to be removed and replaced as it can not be placed back in due to code.
Any unforeseen damage that is uncovered during demo must also be properly fixed.
Any testing required by code must be completed.
Any and all permits must be pulled.
The owner of the home will retain the right to make changes to the area/s involved as needed during construction as long as they are within code. This may include the use of different materials, floor plan, plumbing, and/or electrical.
Construction will only take place through the entry of the sliding glass door of the master bedroom and everything will be returned to normal when completed. There will be no access to the main house. Any and all access points to other areas of the house will be separated by protective coverings in order to prevent the spread of any dust, debris, or hazards.
The property will be kept in a clean fashion daily.
The owner has the rights to have a general contractor inspect at any point along with county officials.
The work must be completed within 14 calendar days from start. Penalty for each day after 14 days in which it is not completed. There will be no delays in starting work and it must be started within 1 week.
A minimum of a 25 year warranty will be given for all work performed which includes leaks. This must be a documented warranty which will include any manufacturers warranty. Installation must be performed by a certified company by the manufacturer.
Also if any other items need to be replaced once the permits are pulled in order to pass code (ie. replacement of other toilets for water saving ones, water fixtures in other areas of the home need water saving features) those will also be performed.
Any homeowner fees, time off work, relocation, inconvience, or damage to property will be paid by company doing the work to the homeowner.
I retain the right to add or remove items from this list.
These are the terms given by the contractors which have given estimates.
Thank you,

In California, going after small a small business is a sport.  There is no downside to the complainant, no negative consequences, no adverse consequences.  All the adverse consequences are suffered by the business owner.  Mr [redacted], a law enforcement officer, sees an opportunity to have his bathroom re-modeled at my expense, and he is more than willing to use all the consumer protection laws to his advantage to extort the money that he wants.  The fact that he may destroy my business and my life in the process means nothing to him. Only his ego matters to him.  He has been to court over 40 times in Fresno.  The bottom line now is he wants me to pay him $16,400 or he will do his best to destroy the business that I have created over the last 17 years.  During those 17 years I have performed over 15,000 inspections.  He has now made a complaint to the [redacted]. This is the 3rd complaint during those 17 years.  Mr [redacted] wants his pound of flesh, and a pound may be OK, but not two legs and an arm.  So, shall I "suffer the slings and arrows of outrageous fortune, or take up arms against a sea of troubles, and so oppose them."  I shall oppose Mr [redacted]'s extortion attempt.

I am rejecting this response because: George Webb replied with the same statement as he previously did. This complaint is not resolved and George Webb is not acting in good faith.

Complainant is requested to respond with a day & time to start the repairs. If repairs are commenced by this company, complainant is requested to refrain from creating a hostile working environment, refrain from trying to micro manage the repairs, and, for insurance purposes stay out of the work area while work is in progress.

I am rejecting this response because: George Webb Failed to do his due diligence for section 1 clearance. He fradulently signed off the clearance without proper reinspection that was documented in the original inspection and incomplete on the final inspection by George Webb. He admitted that he missed this damage somehow and that he had trainees with him that day that may have overlooked it. There was no insulation covering the area of damage as he states. I have proof that the area was not covered at the time or for quite some time before this inspection. Water stains and and rot were also around this area that should have been an indicator for a reputable licensed inspector. A formal complaint has been filed with the Structural Pest Board of California. George Webb continues to try to add blame onto other people for his error. George Webb is a paid licensed business that is to locate and detect damage. George Webb Termite and Pest has failed in their job and their roll as a licensed entity and refuses to pay for damages. They want to address the issue with patchwork and improper structural support. I will not release this complaint until George Webb Termite and Pest pays for the repairs to be done related to their failure to perform their job correctly.

Review: George Webb was the company used for the escrow pest report for my home purchase. This service was paid for by the seller of the home. George Webb signed off the section 1 clearance without a proper second inspection and failed to recheck areas that he initially maked as a section 1 issue. George Webb also failed to recognize the fact that the sub floor beneath the master shower/tub was completely rotted away and falling through the floor into the 3' crawl space below the house. After escrow close I went under the house to run some cable wire and noticed this damage. After contacting George Webb he came out and reinspected the sub floor. He stated that somehow he must of overlooked this. He offered to replace the the sub floor by lifting the tub and sliding out and in the new sub floor or giving me $1,200.00. In order to do this work correctly the bathroom needs to be gutted as there is also rot in the walls around the shower and on the main support beams under the house. His fix would be a bandaid that will just reoccur as there is still a leak in the shower pan that needs to be replaced also (which he said doesnt need to be replaced). I had a professional leak test company come out which stated that the shower pan is leaking. The estimate cost for this fix is just over $16,000 (this will more than likely increase once demo begins). George Webb instead of taking blame for not doing his due diligence for a job he was paid to do, has tried to place the blame on other people including myself. I let him fix a fascia board that was rotted that he also missed in the inspection. His company not only did poor work that can be seen visually but, also left the old wood and their scrap wood behind for me to clean up. Their worker lost traction backing up on the lawn in the front yard and dug a hole with the tire about 6" deep which he left like that. Furthermore this was a VA home loan which requires a section 1 clearance in order to prevent things of this nature from occuring on these types of loans.Desired Settlement: I am requesting that George Webb pay the damages as requested in a letter sent to him which included the construction estimate. I also stated that if he did not pay by the dealine, and I needed procede with further actions, that he would then be responsible for any fees incurred prior and post the request. There are current attorney fees and inconvienence fees that are now due on top of the estimate, and that will continue to accrue until this is rectified.
