I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below
In October 2013, we brought my wardrobe into Georgie’s and at
no time was it explained to my husband and I nor did either or us sign an
agreement that there was a day requirement to cash payment from Georgie’s if
and when the wardrobe was sold. ***, the
sales associate from Georgie that we worked with, exchanged contact information
with us and explained she would give me a call if we received an offer or if
she needed to bring the price down. In
fact *** had reached me a few times between October and February to
discuss the price. The last call I
received from her she indicated she had a buyer but want to negotiate a
price. We agreed to $774. She said she would let the customer know and
then call me back if they decided to buy it.
We had not heard back from her and assumed the customer decided against
purchasing the wardrobe since she had been good in the past at contacting us. On May 17th of this year my
husband and I were planning his mother’s funeral across the street from Georgie. When we finished we decided to stop in at
Georgie to check on the wardrobe as I had not heard from *** since February. As soon as we walked in we notice our
wardrobe with a sold sign on it. I asked
the sales clerk and she checked in her files and found the check made out to
me, and a thank you card, thanking me for doing business with them. At no time did the associate for Georgie indicate
the check would not cash In fact, her
full intention in giving me the card with the check was for me to receive
payment. On June 2, upon trying to
deposit the check from Georgie, my bank sent me a notice of insufficient funds. This tells me Georgie either closed the
account prematurely or the balance was too low at the time of the deposit. Neither of these reasons are acceptable
reasons to not provide us payment. We
entered a business agreement with Georgie for 60% of the sold price of our
wardrobe, and their initial intentions were to pay us. We did not get payment because of
insufficient funds in Georgie’s account, not because of a timeline
agreement. There is no such agreement in
place with us.
I reject the owner’s response. A representative from Georgie made it a
business practice to contact me regarding my wardrobe. I was promised a call when the wardrobe sold
which never came. Had I been contacted about
the sale, and as I had been in the past, I would have picked up the check
sooner. When I did make an effort to follow
up I was handed a check made payable to me for the sale of my wardrobe. That check should be honored in addition to
the bank fee for trying to deposit insufficient funds
I have attached the paperwork I have received from Georgie pertaining to this matter I also have the "Thank you" card mentioned above however, I did not scan or attach it but can if it is requested.
