 I do not have the shed and Gera Gardens still has my money.  Contrary to their statement, the property has 1-2" of topsoil on top of hard clay.  It was level and firm, I discussed this with them at time of purchase and was advised it would be no problem. .  They refer to clauses in the contract they breached.  They cannot have it both ways. I did not at anytime cancel this deal.  Mr. Andre G[redacted] did.  He stated to both myself and the homeowner that they were taking back the shed and refunding my money.  Please see attached signed statement by the homeowner that confirms my story.  They cannot cancel the contract and try to keep any portion of my money under a contract they breached.   Please note, they have refunded nothing, not even the part they do not dispute.  A google search reveals a history of this behavior on their part.

We did however provide her with a full store credit in the amount she paid , which her husband picked up and...

proceeded to purchase other items with. They purchased several different things and appeared to be fully satisfied with everything, leaving pleasantly and saying thank you. Thank you for your recent communication in regards to to the [redacted] complaint. A refund was given to the [redacted] account on the credit card that was used to pay the balance. A certified letter was mail to both [redacted], postal #[redacted] and [redacted] postal #[redacted], on July **, 2016, informing them of the refund. How ever both of these certified letters we not accepted at the time of delivery so they were scheduled for re-delivery on July **,2016. The re-delivery confirmation for [redacted] is #[redacted] ,  and for [redacted] is #[redacted]. The second delivery attempt was also not accepted by either party. At this time both parties have ceased communication with Gera Gardens but have received the appropriate refund so there is no longer a dispute in question. Review: I recently purchased a shed from Gera Gardens. They deliver the shed already built and install it on cinder blocks. Within weeks of the installation the cinder blocks began to shift so I called them and was told that they do a free "releveling" service for situations like mine. The person I spoke to told me they'd be coming the following week and they'd call me or my wife to let us know when. I told them that my shed is easily accessible and they do not need to enter my yard to address this issue and that if they were in the area it was okay to "relevel" even if we were not at home. Well, no one ever came or called so I called today to "reschedule". A woman there answered the phone and I explained what had happened and that I'd like to reschedule the "releveling". This woman argued with me about almost everything I said. She didnt seem to believe that I had scheduled the "releveling" earlier as she told me that thats not the way they do things, that she's worked there for 10 years and she knows how things get done, she also didnt seem to like my request to speak to [redacted] I believe), so she hung up on me. I wanted to speak with [redacted] as he was the person that helped me select and order the shed. I kept calling back to speak with [redacted] and she kept hanging up on me. After 7 call back attempts to schedule the appointment (she kept hanging up on me) I finally called and [redacted] answered. [redacted]'s response was that it must have been something I did to set her off and that he wasn't going to argue with me. I said I don't want to argue either but that he'd only heard her side of the conversation. I still don't understand that woman's reaction or how or why she dealt with a customer this way. [redacted] then hung up on me too. I respect that he's protective of his employees, but not at the expense of his repeat customers. I cant believe Im actually having to do this over something so simple but that woman's customer service skills are terrible. And frankly, Im shocked and disappointed in [redacted]. He's a businessman he should know poor treatment of customers will hurt his reputation and his sales.Desired Settlement: I want the shed releveled.

If they do actually relevel the shed I would want to schedule an appointment and be here when the job is done. I do not want anyone in or around my yard unless supervised.

Review: I purchased two Mini Barns from Gera Gardens. This complaint refers to the 8'x12'x4' Mini Barn purchased on 9/**/95. (I altered the other barn by insulating it, so I do not expect it to be covered by the warrantee). I noticed water dripping on the inside of the shed on May **, 2014. I looked at the roof and noticed that the roof tiles along one edge of the barn style roof were cracked along the entire length of the shed. The water was dripping in along this crack, and the plywood beneath the roof tiles was soaked from the water coming in the crack in the roof tiles. The wood siding on this side of the shed was also water damaged. I checked my original purchase papers and saw that the roof tiles were warranted for 20 years and the siding was warranted for 25 years. I called the company, and spoke to the [redacted]. When I explained the situation, he told me that they would not be able to install a new roof because of the water damage to the supporting structures under the roof tiles. I explained that it was the failure of the roof tiles which led to this damage, and he consented to have his office call me during the week to set up an appointment to send an inspector to look at the shed. I called his office Tuesday to make the appointment and the lady ([redacted]) working there said she would have to speak to [redacted] and get back to me within the hour. After several hours I called again, and she still was unwilling to make the appointment, and when I persisted and asked to speak to [redacted], she said "it wasn't going to happen this week" and hung up on me. I called again on May **, and spoke to a different lady ([redacted]). She told me it would cost me $75 to have an inspector come out to "give me an estimate". I said there should be no charge since the shed was still under warrantee, and she put me on hold to speak to [redacted]. She came back on to say that they no longer dealt with the manufacturer who made the shed I purchased and so I would have to pay to have it inspected. I said again that this was covered under the terms of the warrantee, and after speaking to [redacted] again, she said the inspectors could come that day within a 2 hour window (during which I would be away working). She said the men would call when they were on their way to my home and I was going to try to get home to be there. They called me after they had already been to my home. They said I could call the office in a week and get the results of their inspection. When I called a week later, [redacted] told me, after a lengthy hold, that the other shed that had been altered was not covered, which I fully accepted. When I asked about the shed with the broken roof tiles, she told me that hadn't been decided yet. Finally at the end of the day, she called and told me that the damage was not covered because there was a sprinkler head near the shed. I said that sprinkler heads are always placed next to existing structures, so that the spray can be directed AWAY from the structure. This is common knowledge, which the inspectors and [redacted] are certainly aware of, and can be verified with any irrigation company or by a picture of my sprinklers when on. I asked her to send me the determination in an email. This is the email I received:

It was a pleasure speaking with you earlier in regards to the warranty information you requested.

As for the warranty in question on your siding and roof:

The extensive water damage due to the sprinkler being placed several inches away from the unit voids the warranty of the siding and plywood.

The shingles will be covered by the warranty through the manufacturer with a prorated credit.

You will find a description of warranty details within the contract you received at purchase.

Gera Gardens would be more than happy to provide a roof shingle and siding repair for you. The roof repair costs would consist of the labor, and the siding repair costs would consist of the labor and the materials.

Roof repair labor: $795.00

Roofing prorated credit (to you): $88.89

Siding repair materials and labor: $450.00

Please contact us when you would like to set up a date for the work to be completed, thank you and have a great day!

As I explained to [redacted], the sprinklers are aimed to spray away from the shed. The warranty provided at the date of purchase guaranteed complete coverage for roof and siding failure. I expect the labor and materials to be fully covered. This would include not only the roof tiles, but the plywood beneath the tiles which has been damaged due to the broken roof tiles. If the repairs are delayed much longer, I expect there will be water damage to the supporting beams as a result, and I will want those replaced as well. Therefore I ask you to expedite your response. I asked [redacted] to provide me with the manufacturer’s name and contact information, and have not received that information. Please provide it. If you do not make arrangements to make the necessary repairs to the siding and roof as per the warrantee, I will be forced to take further action. Please get back to me as soon as possible. [redacted] and received the following email:

We stand by our professional findings, due to the results of excessive water damage and moisture, The structures have been altered as well. The manufacturer has viewed the many pictures we have of your structures, and stands by our findings.

Several things are apparent - Gera Gardens no longer deals with the original manufacturer of my shed. This is why they either will not or cannot provide me with the manufacturer's information. Because they no longer deal with this manufacturer, they would have to cover the cost of the repairs themselves, and they do not want to. The idea that a sprinkler that is positioned precisely to spray away from the shed to keep the shed dry, would have anything to do with the entire length of the roof tiles cracking along a pointed seam in the roof, thereby causing water damage to the roof structures and the siding, is absurd. They are using the sprinkler as an excuse to not honor their warrantee. I am submitting this complaint so that the original guarantee can be honored.Desired Settlement: I would like the roof tiles, supporting plywood, and siding to be replaced, on the unaltered shed, free of charge, as per the warrantee at the time of purchase.

After the initial inspection was performed , [redacted] was unhappy to learn that the shed she had purchased 19 years ago was not covered within the 20 year warrantee because of excessive water damage due to her sprinklers being placed directly against the side of the unit. Gera Gardens has offered to prorate a credit for the remaining one year of warrantee towards any work done on the unit. The warrantee is a limited warrantee , and is 19 years old. We would be more than happy to come perform the work necessary at cost of labor and materials. The warranty does not cover materials due to water damage. [redacted] called us numerous times yelling and threatening the employees that if we didn't rebuild her 19 year old shed free of charge that we would be hearing from a lawyer, in which we offered our attorney's information, and she declined. The unit is 19 years old , natural wear and weathering is expected, the damage occurring on her unit is due to the moisture caused by the direct sprinkler placement. Whether the sprinkler is directly facing the unit or not , the moisture it releases over a prolonged amount of time would cause the water damage.

I am attaching (1) a copy of the warrantee I received when I purchased the shed. It states that the Asphalt Shingles are covered for 20 years and that the Duratemp Douglas Fir siding is covered for 25 years. There is no mention of partial coverage or limited warrantee. As a side note, in 2005, Gera Gardens replaced the doors on my other shed and there was no charge for parts or labor, as per the warrantee.

[redacted] states that "Whether the sprinkler is directly facing the unit or not , the moisture it releases over a prolonged amount of time would cause the water damage". The sprinkler system was installed in 2011. I have attached a copy (2) of the sales receipt. That means the sprinklers have been used for only three seasons, hardly a "prolonged amount of time".

I am also attaching photos (3,4,5,6) showing the sprinkler head in question in operation. Only the 180 degrees facing away from the shed sprays water. The area behind the sprinkler is completely dry, as you can see in the photos.

As I stated in my complaint form, the roof tiles along one edge of the barn style roof are cracked along the entire length of the shed. I have attached a photo (7) of one of the pieces of cracked tile which fell to the ground. You can see how it deteriorated along the edge over time. The water was dripping in along this crack, and the plywood beneath the roof tiles was soaked from the water coming in the crack in the roof tiles, as shown in the photo from the inside of the shed supplied by Gera Gardens. This clearly has nothing to do with a sprinkler 20" above the ground which is spraying away from the shed, as you can see in the pictures. The roof is more than 6' above the ground.

I sincerely hope that my claim will be approved based on the evidence, and that the unconditional warrantee will be honored.
