With respect to the transaction with Mr***, the dealership had initially sold the vehicle in an "As-Is" conditionMr*** was assisted with the financing of this particular vehicle and had put $down payment on the vehicle at
the time of the sale
Mr*** was instructed to bring the vehicle in to the dealership for an appointment days after the saleIt was at this time that Mr*** did not show up for the scheduled appointment to have the vehicle serviced as originally agreed upon
Some days after the sale and Mr*** failing to show up for the scheduled appointment, he arrived at the dealership claiming that he would not be able to honor the contract and terms of the finance agreement due to various health reasons given to him by his doctor
At this time and upon inspection of the vehicle Mr*** was attempting to return to the dealership, it was found the vehicle, which was recently sold in a clean, detailed condition, was returned in complete disarray, full of mud inside and out of the vehicleUpon driving the vehicle after it was in Mr***'s possession, it was found at that time the transmission was fully operable as well as the engine was in complete operable condition, contrary to Mr***'s claims of the vehicle's running condition
Mr***'s demanded the dealership repay him $in return for his down payment for the financing agreementAt this time Gerald Wetzel Motors Inc., counter-offered Mr***'s request with the amount of $to be issued to the clientThis was offset by the state of the condition Mr*** returned the vehicle to the dealershipAt this time, Mr*** graciously accepted the offer of $to be returned to him for his down payment
Gerald Wetzel Motors Incproceeded to write Mr*** a check for $At this time Mr*** accepted the check and presented said check to US Bank to cashUS Bank at this time declined to cash the check for the reason of Mr***'s past due transactions with the lender and past unpaid banking fees to US Bank
Mr*** accepted the $cash ending the transaction
