To whom it may concern,As this situation is long and complicated, we will try to keep this as succinct as possibleTo *** *** settlement statement, the box was indeed not checked "As-Is", and per her request all "issues" with the boat were fixed to perfect working condition. As the boat
is used and brokered, we always verbally indicate the boat is sold "As-Is". In this situation we addressed and fixed all issues per *** *** request. As the vessel is older, and a brand that is no longer available, parts were not easy to come across. In multiple situations, parts had to be found over the internet, i.eeBay.com. Despite all of her complaints and issues with the boat, she loved her test drive, asked for the items to be repaired and we complied with her request as soon as parts were made available. Her settlement for a complete refund will not be agreed upon as she refused the boat despite our dealership going well above and beyond for her and fixing all the concerns she had with the boat. We worked out a deal with the bank to have her refunded her loan amount which has been settled. *** *** will not receive her deposit back as she held up the boat all summer long with her decision to purchase the vessel and her insistence all repairs were to be resolved, which they were. Please see the below statement regarding her specific issues along the timeline: *** *** purchased the boat on 5/27/She gave a deposit, however it took a fairly long time to get her approved for the loan and to get the actual financing. The lien funded on 6/16/2017.She had a problem with the prior owners paperwork to get her trailer registered. Due to some error in communication with *** *** and the ***, she was unable to register her trailer that was purchased with the vessel. We had to send one of our associates with a power of attorney to the *** to help her out, something we never due for customers and only agreed to to appease *** *** *** complains about spending time at the *** to no avail, to which this is not an issue Gerard's can help her with. Lines at the *** cannot be helped and the paperwork that she was given was the exact same paperwork that we used with power of attorney hence there was no reason for her to fail to get her own trailer registered. This is is highlight the level of customer service she received to attempt to help her resolveShe picked up the vessel once it was funded and was not happy with items and brought the boat back days later. When *** *** took delivery of the boat, all navigation lights worked, once she trailed it home, a wire must have been loosened which caused the navigation lights to failOnce she brought the boat back it was a simple loose wire and that issue was resolved. She complains about lack of gasoline in the boat, where *** *** did not request any gas to be put into her boat therefore we did not put extra gas in the boat. To the point of the latter half of *** *** complaint, her "friend" *** communicated with high hostility towards nearly all associates involved, even those whom went out of their way to help both *** *** and ***To the repairs, *** *** wanted the radio to work, trim gauge to read, gas gauge to read & trim to work properly. All of these items were fixed, therefore the boat was not sold "As-is" and her chief complaint is moot. With the confusion and "crazy" way the repairs went; this situation was brought on as the days progressed. Parts for ordered from everywhere they could be found. Some that came in were incorrect and therefore had to be re-ordered and installed. The trim and fuel gauges were in what is called a "cluster" gauge which was very difficult to find, however we did replace it. Hours and Hours of service work went into searching, ordering and installing different parts that *** *** requested to be fixed. The summation of this situation is as follows:*** *** agreed to purchase the vessel with a $2,deposit on 5/27/2017*** *** was funded via *** Bank on 06/16/2017During her test drive she loved the boatAfter she picked up the boat, she asked to bring it back due to a few issues (previously discussed)Once she dropped off the boat we began to find the parts, order parts and replace partsAll items were fixed, the boat had been detailed and tested in the water; all issues and concerns were resolved*** *** decided she wanted to return the boat, Gerard's Marina does not offer returns on boats, we will fix the issues where they may beSince this was a new situation, the GM and owner worked together to find out how the bank wanted to deal with the situation, which is where the "auction" concept came fromOnce the bank agreed the take the lien off and refund the money *** directly withdrew the funds from our accounts and sent us the proper paperwork.*** *** returned the trailer paperwork and plate to which she would then come back to pick up the trailer plate to return to the *** herselfSince all issues were resolved, *** *** will not receive a refund for her deposit. The contract she signed on her loan agreement included an "As-is" clause where any implied warranty would be voided, regardless she was given a refund for her lien amount.
