Regards,
[redacted]    In response to [redacted]'s letter, I have sent some photos. The first photo from December 9th shows my shed being removed a few days before the tree guys came. They were considerate and took the time to go around my pavers, which were still intact but dirty with some leaves and twigs. But mind you, it was December. And notice that my driveway is not that big. You can see the road in the background. It doesn't really matter how big my driveway is; it was an inconvenience especially being as no one from Gerasimek called to inform me what was going on or when they were going to return. He said the shed needed to be moved for the tree by the driveway to be taken down, but he never mentioned the pavers. I thought once the shed was moved, they would have plenty of room to maneuver their equipment. As you can see in the second photo, they are parked on and standing right on top of my pavers. When I first complained about the pavers, he tried to blame the tree falling on it for crushing the pavers. When I told him that I didn't think it was the tree, but rather it was his equipment on top of it, he became argumentative. But you notice the branches in the upper right hand corner of the picture is said tree and is still standing at the time of the picture. He could have maneuvered around the pavers, but made a conscious decision to use the pavers as a resting pad for his equipment.    In the third photo, which was taken just after all the trees were taken down, you will see there are no stakes in the yard as [redacted] claimed. The staking didn't take place till a month after. The log that is supposed to be at the end of the driveway serves a purpose; it's there to guard the end of the drive and protect the well cap. Where he left it "out of the way", wasn't out of the way, but in the way of where the surveyors needed to stake the new house, while leaving my well cap unprotected. The forth photo shows all of this; the actual staking, the well cap, end of driveway, and where the log is supposed to be. The funny thing is that I could not have the surveyors come do the staking until the trees were down. I feel that he used my soon to be construction site as an excuse, as mentioned in in his return statement, to be careless and sloppy.    I could only send four pictures. If you need pictures of the crushed pavers, I can send them to you.

This is the first complaint filed against my business since It was founded in 1965. As my father before me, I pride myself on being a professional and courteous business owner and put the utmost effort into customer satisfaction.I met [redacted] to give a bid on removing her trees. She pointed out to...

me that she was getting ready to break ground on a new house that was to be built directly behind her existing house. She had stakes in the ground indicating where the foundation would be. I told her I could get all the trees to fall towards the center of this area as that area would be dug out for basement installation. There was a shed in her yard that was directly in the path of where the largest tree would need to be dropped and where trucks and equipment would need to drive to gain access to the work area. Not only my equipment, but all equipment to dig the basement and build the house would gain access to the back yard in the same way. I told her to call me when she had the area ready for me to start. She called and said she was ready and wanted me to start as soon as possible. Keep in mind this was December and weather can be unpredictable.  I dropped off some equipment but had to wait a few days for the weather to improve. I wanted to have it there so I could finish the job in a timely manner. I parked the excavator in the work area and the trailer was parked with only 2 wheels on the driveway leaving 90% of the driveway clear. The driveway was large enough to park a 30' 10 ton truck with a 20' equipment trailer side by side with another truck the same size towing a chipper.  I ensured that she could park at least 4 vehicles there if she wanted to.A few days later weather conditions improved and we got started. I accessed the yard and dropped the large oak tree exactly where I said I would - directly on the spot where the shed had sat.She called after the job was completed and paid for and complained about the broken pavers. I reminded her that I had made her well aware that I was going to drive equipment over that area and drop a large tree there as well. She admitted to me on the phone and again in her written complaint that, "Yes, I agree that maybe I should have moved them". She was so upset and even though I didn't feel obligated, I offered to replace the broken pavers, she said, "Forget it," So I did. Concerning the log by the well cap,I had to move it to gain access to the back yard from the driveway. I left it out of the way so the home builders wouldn't have to move it again. When she called and complained about it, I moved it back the next morning.Concerning her friend that she referred me to afterwards, I had set up a large crane in her paved driveway to remove a tree and made a small crack near the edge. I pointed it out to the husband and he didn't seem very concerned as his driveway had many cracks in it already. I insisted on compensating him as this crack was one I had made. If I had told him beforehand that I was going to crack the pavement, I would not have compensated him.Thank you for the opportunity to tell my side of the story.Sincerely,[redacted]

Review: I have used this tree service before when I had two trees fall on my shed. They were very fast and efficient. So when I decided to build a new house and needed trees cut down, I gave them a call. And just like before, they returned my call quickly the same day. They said they were able to come the next day, Wednesday, December 10. I came home from work the next day expecting my trees to be gone; there was a bobcat in my back yard, some kind of trailer parked in my driveway, trees still standing, and not a soul in sight. I called to ask what was going on. He said something about getting stuck. But, in the meantime, the bobcat and trailer sat like that for three days. It was an inconvenience being as I do not have a very big driveway. I had to park in my yard and it was wet out. And that is the reason they gave me for leaving their equipment there. They never apologized for the inconvenience or offered to come move the equipment. But being as I used them before, I gave them the benefit of the doubt and did not complain about it. They finally came on that Friday and removed five trees. A few days later, I noticed that the pavers in my yard were pulverized to pieces. They were not like that two days before when I had my shed moved. I have pictures to prove it. I called him to tell him about the pavers. He said "if you didn't want them ruined, you should have moved them". Yes, I agree that maybe I should have moved them. I just never thought they would be pulverized. I asked if he saw them and he said yes. I asked why he didn't come and knock on the door to make sure I didn't want them. I was not home, but someone else was there. And could have easily contacted me at work. He said " I thought you didn't want them being as you left them there". He moved the log that was in front of my well cap (which I had to call him to put back). And he also took the time to move a swing that must have been in the way. If he could do that, why couldn't he have asked about the pavers? I felt that because I was going to be escavating soon for my new house, that he showed utter disregard for my property. He left my yard a mess. The surveyors had a hard time walking in the yard. He did not leave my yard like that the first time. Pictures were taken of them taking the trees down. The pictures showed the equipment right on the pavers. When she was taking the pictures she didn't realize there were pavers where the equipment was sitting. When I talked to the owner on the phone, he was so argumentative and kept blaming me for leaving them there. He had me so upset that I said forget it. Fast forward a couple months. A friend of mine at work needed a tree taken down and asked who took mine down. I told her because I was trying to let bygones be bygones and let it go. But when she told me that they cracked her driveway. And that the tree service spoke with her husband and took money off the price, I was a little upset. When I called to question the tree service about my friend and his partiality. He kept saying their situation was different. I said "how Is that different? Both ways you destroyed property". He said " I can't control your emotions". He made me feel like I didn't have a right to be upset about the way he treated my property. If I were a man and upset about the same thing, would he have said that to me? If it were a cement pad?Desired Settlement: I would have liked him to take money off the price like he did my friend.
